About approval of Rules of carrying out monitoring of the projects realized within measures of the state support of private entrepreneurship

1. Approve the enclosed Rules of carrying out monitoring of the projects realized within measures of the state support of private entrepreneurship.

2. Recognize to invalid:

1) the order of the Minister of national economy of the Republic of Kazakhstan of June 1, 2022 No. 41 "About approval of Rules of carrying out monitoring of the projects realized within the national project on development of entrepreneurship for 2021 - 2025" (it is registered in the Register of state registration of regulatory legal acts for No. 28338);

2) the order of the Minister of national economy of the Republic of Kazakhstan of September 18, 2023 No. 162 "About modification and amendments in the order of the Minister of national economy of the Republic of Kazakhstan of June 1, 2022 No. 41 "About approval of Rules of carrying out monitoring of the projects realized within the national project on development of entrepreneurship for 2021 - 2025" (it is registered in the Register of state registration of regulatory legal acts for No. 33445).

3. To provide to department of the state support and protection of entrepreneurship of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and its placement on Internet resource of the Ministry of national economy of the Republic of Kazakhstan after day of its first official publication.

4. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of carrying out monitoring of the projects realized within measures of the state support of private entrepreneurship

Chapter 1. General provisions

1. These rules of carrying out monitoring of the projects realized within measures of the state support of private entrepreneurship (further – Rules of monitoring) are developed according to the subitem 2) of Item 3 of article 16 of the Law of the Republic of Kazakhstan "About the state statistics" and the order of the Government of the Republic of Kazakhstan of September 17, 2024 No. 754 "About some measures of the state support of private entrepreneurship" (further – the Resolution) and determine procedure for carrying out monitoring of the projects realized within Rules of subsidizing (further – Rules of subsidizing), Rules of provision of guarantees within guarantee funds (further – Rules of guaranteeing), Rules of provision of state grants for the subjects of social entrepreneurship (further – Rules of provision of state grants) approved by the Resolution.

Action of these rules of monitoring extend including to the projects approved within earlier existing programs of support of entrepreneurship specified in the Resolution.

2. The joint-stock company "Fund of development of entrepreneurship "Lady" (further – the financial agency) performs monitoring regarding guaranteeing on the credits / to financial leasing / to conditional obligations / to forward agreements / bonds / options, subsidizings of part of rate of remuneration by credits/leasing/part of rate of coupon remuneration on the bonds/parts of markup on goods and lease payment constituting the income of the Islamic banks / loans issued through crowdfunding platform and provisions of state grants according to the Resolution.

3. In these rules of monitoring the following terms and determinations are used:

1) bank – the legal entity, being the commercial organization which according to the Law of the Republic of Kazakhstan "About banks and banking activity in the Republic of Kazakhstan" is competent to perform banking activity. The Development Bank of Kazakhstan joint-stock company also treats bank;

2) the bank credit / loan (further – the credit) – the amount of money provided by the creditor to the entrepreneur based on the agreement on provision of bank loan / the option agreement / the forward agreement on the terms of urgency, the paid nature, recoverability, security and target use including within the agreement of financing under concession of monetary claim (factoring). The credit line belongs to bank loan also.

For Islamic bank the credit is understood as financing – the delay or payment by installments of payment for goods provided by Islamic bank / Islamic leasing company to the entrepreneur and/or provision by Islamic bank / Islamic leasing company of property (leasing subject) to the entrepreneur on the terms of leasing (lease);

3) grant – the public funds allocated to the grantee on a grant basis according to the agreement on provision of grants according to conditions of Rules of provision of state grants;

4) the grantee – the subject of small and medium entrepreneurship, including subjects of social entrepreneurship to whom according to the solution of tender committee the grant according to conditions of Rules of provision of state grants is provided;

5) the agreement on provision of grant – the tripartite agreement in the form approved by authorized body on entrepreneurship concluded on the web portal of information system of subsidizing in electronic form between the regional coordinator, the financial agency and small business entity under the terms of which the target grant on realization of the business ideas is provided to the entrepreneur;

6) the accounting period – the calendar accounting period which begins on January 1 and comes to an end on December 31;

7) "green" projects – the projects directed to increase in efficiency of use of the existing natural resources, decrease in level of negative impact on the environment, increase in energy efficiency, energy saving, mitigation of the consequences of climate change and adaptation to climate change determined on the basis of the approved classification (taxonomy) according to the ecological legislation of the Republic of Kazakhstan;
