1. Approve the enclosed Rules of carrying out monitoring of the projects realized within the national project on development of entrepreneurship for 2021 - 2025.

2. Recognize invalid:

1) the order of the Minister of national economy of the Republic of Kazakhstan of September 7, 2020 No. 62 "About approval of Rules of carrying out monitoring of the projects realized within programs of financial support of entrepreneurship within the State program of support and business development "The road map of business-2025" (it is registered in the Register of state registration of regulatory legal acts for No. 21187);

2) the order of the Minister of national economy of the Republic of Kazakhstan of December 2, 2021 No. 103 "About modification and amendments in the order of the Minister of national economy of the Republic of Kazakhstan of September 7, 2020 No. 62 "About approval of Rules of carrying out monitoring of the projects realized within programs of financial support of entrepreneurship within the State program of support and business development "The road map of business-2025" (it is registered in the Register of state registration of regulatory legal acts for No. 25687).

3. To provide to department of the state support and protection of entrepreneurship in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of national economy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the first vice-minister of national economy of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of carrying out monitoring of the projects realized within the national project on development of entrepreneurship for 2021 - 2025

Chapter 1. General provisions

1. These rules of carrying out monitoring of the projects realized within the national project on development of entrepreneurship for 2021 - 2025 (further – Rules) are developed according to the order of the Government of the Republic of Kazakhstan of October 12, 2021 No. 728 "About approval of the national project on development of entrepreneurship for 2021-2025" (further – the National project), the order of the Government of the Republic of Kazakhstan of December 31, 2019 No. 1060 "About some measures of the state support of private entrepreneurship" (further – the Resolution No. 1060) and the Mechanism of crediting and financial leasing of priority projects approved by the order of the Government of the Republic of Kazakhstan of December 11, 2018 No. 820 "About some questions of ensuring long-term tengovy liquidity for the solution of task of available crediting" (further – the Mechanism), and determine procedure for carrying out monitoring of projects, implemented within the National project.

2. Action of these rules extends including to the projects approved within the State program of the support and business development "The road map of business-2025" approved by the order of the Government of the Republic of Kazakhstan of December 24, 2019 No. 968 and the Mechanism.

3. The joint-stock company "Fund of development of entrepreneurship "Lady" (further – the financial agency) performs monitoring of implementation of the National project / Mechanism regarding guaranteeing on the credits / to financial leasing / to bonds, subsidizings of part of rate of remuneration by credits/part of rate of coupon remuneration by bonds/part of markup on goods and parts of the lease payment constituting the income of Islamic banks and provision of state grants for realization of the new business ideas based on the Resolution No. 1060.

4. In these rules the following terms and determinations are used:

1) bank – bank of the second level, including the Islamic bank performing activities within realization of Rules/mechanism;

2) bank loan (further – the credit) – the amount of money provided by bank to the entrepreneur based on the agreement on provision of bank loan on the terms of urgency, the paid nature, recoverability, security and target use. The credit line belongs to bank loan also.

For Islamic bank the credit is understood as financing – the delay or payment by installments of payment for goods provided by Islamic bank / Islamic leasing company to the entrepreneur and/or provision by Islamic bank / Islamic leasing company of property (leasing subject) to the entrepreneur on the terms of leasing (lease);

3) the agreement on provision of bank loan / microcredit (further – the loan agreement) – the written agreement signed between bank/IFI and the entrepreneur under the terms of whom the entrepreneur is granted the loan. The agreement on opening of credit line also belongs to the loan agreement.

For Islamic bank the loan agreement is understood as the agreement of financing – the written agreement signed between Islamic bank and the entrepreneur under the terms of whom the Islamic bank grants commercial credit to the entrepreneur – the buyer or the seller of goods or provides to the entrepreneur property (leasing subject) on the terms of leasing (lease) (the general agreement of financing within which the Islamic bank and the entrepreneur sign separate agreements on provision of commercial credit (financing) also belongs to the agreement of financing;

4) grant – the public funds allocated to the grantee on a grant basis according to the agreement on provision of grants for realization of the new business ideas according to conditions of Rules of provision of state grants;

5) the grantee – small business entity to which according to the solution of tender committee the grant for realization of the new business idea is provided;
