About modification of some orders of the Government (reduction in compliance of the regulatory base in the field of protection of the child)

Based on article 12-3 of the Law No. 140/2013 on special protection of children, being in risk situations, and the children separated from parents (The official monitor of the Republic of Moldova, 2013, Art. No. 167-172, 534), with subsequent changes, article 5 of the Law No. 370/2023 on the child's rights (The official monitor of the Republic of Moldova, 2023, Art. No. 488-491, 864) DECIDES: the Government

1. In Regulations on the procedure of repatriation of children and adults - the victims of human trafficking, persons which are in difficult situation, and also children without maintenance, approved by the Order of the Government No. 948/2008 (Official monitor of the Republic of Moldova, 2008, Art. No. 152-153, 949), with subsequent changes, to make the following changes:

1.1. in all text, except for Item 56:

1.1.1.tekst "The Ministry of Health, work and social protection" in any grammatical form shall be replaced with words "Ministry of Labour and Social Protection" in the corresponding grammatical form;

1.1.2. in all text of the word "Ministry of Foreign Affairs and European Integration" in any grammatical form shall be replaced with words "Ministry of Foreign Affairs" in the corresponding grammatical form;

1.2. in item 4 of the word "Ministry of Public Education" shall be replaced with words "Ministry of Education and Research";

1.3. in Item 37 of the word of "the initial individual plan" shall be replaced with words "the individual plan of the help";

1.4. add with Item 37-1 of the following content:

"37-1. If the last residence of the child and his family was registered in the settlement located on the left coast of Dniester, territorial agencies of the public assistance through the territorial structures appointed according to regulations of the Order of the Government No. 957/2023 on creation, the organization and functioning of territorial agencies of the public assistance provide conducting case according to the procedure of work with case, with respect for the highest interest of the child.";

1.5. in Item 56:

1.5.1. in paragraph one the text "The Ministry of Health, work and social protection will provide sending necessary specialists from subordinated public medical and sanitary organizations of the corresponding profile" to replace with the text "The Ministry of Health at the request of the Ministry of Labour and Social Protection appoints one or several profile specialists who will be sent to the country of destination for escort of person throughout all transit or will meet this person in Item of crossing of frontier of the Republic of Moldova";

For holding procedures for repatriation of persons specified in Item of 2 this provision, the Ministry of Labour and Social Protection pays daily allowance to attendants/attendants from the organizations which are under supervision of the Ministry of Health, Ministry of Internal Affairs and Ministry of Labour and Social Protection. Daily allowance is financed by the means of the government budget provided in the budget of the Ministry of Labour and Social Protection.".

3. In the Instruction on the mechanism of intersectoral cooperation in the field of identification, assessment, the direction, the help and monitoring of children - the victims and potential victims of violence, neglect, operation and trade, approved by the Order of the Government No. 270/2014 (Official monitor of the Republic of Moldova, 2014, Art. No. 92-98, 297), with subsequent changes, to make the following changes:

3.1. 14) of Item 5 to state the subitem in the following edition:

"14) the report on psychological assessment - the document constituted by the psychologist who includes the description of specific features of the identity of the beneficiary, assessment of its condition at the time of receipt of psychological assistance, the forecast of its further development and the recommendation about the solution of psychological problems and/or to improvement of its emotional, cognitive and social condition;";

3.2. state Item 23 in the following edition:

"23. The report on psychological assessment is constituted according to the regulatory base developed in this respect.";

4. In the Order of the Government No. 760/2014 about approval of the Framework regulations on the organization and functioning of Service of foster education and the minimum quality standards (Official monitor of the Republic of Moldova, 2014, Art. No. 282-289, 815), with subsequent changes, to make the following changes:

4.1. in appendix No. 1:

4.1.1. in Item 2 "special" to exclude the word;

4.1.2. the word "approved" shall be replaced with words "which affirms as item 4";

4.1.3. in Item 5:

4.1.3.1. in the subitem 3) shall be replaced with words the word "placements" "the planned placement";

4.1.3.2. 6) to state the subitem in the following edition:

"6) long-term placement - the planned accommodation of the child in family of the foster tutor for one year before achievement of 18-year age by the child. In case of continuation of training in educational institutions (lyceums, organizations of professional or higher education) the child keeps the status of the member of Service before the end of training (but only before achievement of 23-year age by the child);";

4.1.3.3. add with the subitem 12) of the following content:

"12) the individualized plan of services - the plan constituted in writing on the basis of the model approved by the order of the Minister of Labour and Social Protection which includes set of special interventions concerning the child on the basis of assessment of his requirements in connection with his health, the needs for leaving, physical, emotional, educational requirements, carrying out free time, socialization etc., developed and implemented during accommodation of the child in Service.";

4.1.4. state Item 6 in the following edition:

"6. Users of services of Service are:

1) the children who are in risk situation, and the children separated from parents, according to provisions of article 8 of the Law No. 140/2013 on special protection of children, being in risk situations, and the children separated from parents;

2) children with limited opportunities, parents or persons on whose care there are children needing time for recovery;

3) the minor parent with the child in situation of risk of separation (further - the minor parent);

4) the minor pregnant woman if corresponds to the situations specified in the subitem 1) (further - the minor pregnant woman);

5) child of the minor parent.";

4.1.5. add with Item 9-1 of the following content:

"9-1. The children placed in Service are not considered as the children who are on complete providing the state.";
