About the organization of activities of the International center of digital technologies

For the purpose of realization of the tasks determined by the Presidential decree of the Republic of Uzbekistan of October 5, 2020 No. UP-6079 "About Approval of Strategy " Digital Uzbekistan — 2030 " and Measures for Its Effective Realization" and also creating favorable conditions for development of export of software products and IT services, active attraction of foreign investments and implementation of internationally acknowledged front lines the practician and institutes on protection of the rights of investors I decide:

I. Purposes

1. Determine main objective of this Decree creation of conditions for:

(a) broad investment attraction to the IT sphere, creation of the favorable circle for business, and also forming of competitive and attractive ecosystem at the international level;

(b) attraction of venture capital by the IT companies, and also further strengthening of their legal guarantees in case of the conclusion of contracts with the international partners;

(c) development of export of services in the field of information technologies and business processes, and also ensuring effective integration into world economy;

(d) stimulation of activities of the leading domestic companies in the field of digital solutions and innovations, and also training of qualified personnel;

(e) forming in the country of the favorable legal circle for foreign investors and implementation of effective mechanisms of reliable protection of their rights.

II. Organization and management of activities of the International center of digital technologies

2. Take into consideration that according to the Presidential decree of the Republic of Uzbekistan of February 1, 2024 No. UP-25 "About First-priority Measures for Creation of the International Center of Digital Technologies" is created the International center of digital technologies "Enterprise Uzbekistan" (further - the Center).

3. Approve:

(a) Structure of Management board of the International center of digital technologies "Enterprise Uzbekistan" (further - Management board) according to appendix No. 1;

(b) The description of borders of the territory of the International center of digital technologies "Enterprise Uzbekistan" according to appendix No. 2*.

4. Approve offers of the Ministry of digital technologies, the Ministry of Economics and finance, and also the Ministries of investments, the industry and trade providing:

(a) creation of directorate of the Center in the form of joint-stock company, determination as its single shareholder of Directorate of the Technological Park of Software Products and Information Technologies LLC;

(b) financing of activities of bodies of the Center by fund of development of digital technologies, receipts from the services rendered by bodies of the Center, monthly expels of residents of the Center, and also other sources which are not prohibited by the legislation;

(c) establishment for residents of the Center of special legal regime in spheres of tax and customs administration, regulation of employment relationships, personal data protection and intellectual property, provision of the state services, dispute resolutions, and also in other areas determined by acts of the legislation and decisions of Management board.

III. Special legal regime in the territory of the Center

5. In the territory of the Center implementation of the following types of activity is allowed:

(a) development of software products, rendering consulting and autstaffingovy services in the field of digital technologies;

(b) provision of remote services on outsourcing basis with use of digital technologies, including business process outsourcing (BPO);

(c) carrying out research and development (R&D) in the field of digital technologies;

(d) creation of video games (GameDev), development of digital content for them, including graphical design, video and audiocontent, their editing (including visualization and digital media);

(e) creation, placement and promotion of digital content (including the e-books training rates, media content) or software solutions through online platforms;

(g) development and development of technologies of artificial intelligence;

(h) creation and management of the centers of processing and data storage, cloudy computing systems, and also rendering the accompanying services;

(i) implementation of educational activities in the field of the digital technologies and other types of activity determined by Management board.

6. Establish procedure according to which special rules of provision of financial services to residents of the Center are determined by the Central bank (regarding banking services and currency control) and the National agency of perspective projects (regarding services in the field of insurance and securities).

7. Determine that:

(a) activities of residents of the Center within special legal regime are performed in the territory of the Center, approved according to appendix No. 2 * to this Decree, and (or) within its jurisdiction;

(b) for the purpose of rendering services to residents of the Center the specialized tax authorities operating in the territory of Center for the principle "single window", including providing services in English are created.

8. Agree with the offers of the Ministry of digital technologies, the Ministries of investments, the industry and trade, the Ministry of Justice and the international experts providing:

(a) recognition of the Center as the separate territory (jurisdiction) having the special legal regime based on regulations, common law principles of England and Wales or standards of the leading international financial centers;

(b) creation within special legal regime of the Center of possibility of consideration of disputes of residents of the Center, and also - in case of mutual consent of the parties - disputes of other subjects of entrepreneurship in the independent specialized court which is not entering judicial system of the Republic of Uzbekistan;

(c) permission to render to the companies which are not residents of the Center on the territories of the Center financial, consulting, investment and legal services without distribution on them the tax, customs and other benefits provided for residents of the Center.

9. To the Cabinet of Ministers to introduce to three-months time in accordance with the established procedure the draft of the Constitutional law of the Republic of Uzbekistan "About the International center of digital technologies".

10. Recognize invalid the paragraph third Item 2, Items 3, of 5, 6 Presidential decrees of the Republic of Uzbekistan of February 1, 2024 as No. UP-25 "About First-priority Measures for Creation of the International Center of Digital Technologies", and also appendix to it.
