Based on part (7) article 18 of the Law No. 1100/2000 on production and turnover of ethyl alcohol and alcoholic products (repeated publication: The official monitor of the Republic of Moldova, 2023, No. 126, the Art. 197), with subsequent changes, DECIDES: the Government

1. Approve Regulations on registration, sealing and rasplombirovka of the capital processing equipment used in case of production of ethyl alcohol and alcoholic drinks with volume fraction of alcohol at least 25% it (is applied).

2. To impose control over the implementation of this resolution on the National agency on safety of foodstuff.

Regulations on registration, sealing and rasplombirovka of the capital processing equipment used in case of production of ethyl alcohol and alcoholic drinks with volume fraction of alcohol at least 25%

Chapter I. General provisions

1. This Provision establishes order of registration, sealings and rasplombirovka of the capital processing equipment used in case of production of ethyl alcohol and alcoholic drinks with volume fraction of alcohol at least 25%.

2. For the purpose of this provision the concepts determined in article 1 of the Law No. 1100/2000 on production and turnover of ethyl alcohol and alcoholic products and in article 3 of the Law No. 19/2016 on metrology and also concept are used:

the capital processing equipment - set of the devices, devices, machines and other means necessary for production of ethyl alcohol and pouring of alcoholic drinks with volume fraction of alcohol at least 25%.

3. The following capital processing equipment is subject to registration:

3.1. installations for production of ethyl alcohol, survey and accounting meters;

3.2. the processing equipment used for pouring of alcoholic drinks with volume fraction of alcohol at least 25%.

4. Seals which fasten on the capital processing equipment shall provide integrity of the equipment, accounting of amount of the made products by means of system of measurement, registration and control with fiscal memory, and also to exclude possibility of unaccounted plunder of ethyl alcohol and alcoholic drinks with volume fraction of alcohol at least 25%.

5. Installation, operation, technical and metrological servicing of systems of measurement, registration and control with fiscal memory and checking at business entities, producers of ethyl alcohol and alcoholic drinks with volume fraction of alcohol is at least

25%, are performed according to the provision approved by the Ministry of Finance.

Chapter II. Registration of the capital processing equipment

Section 1 Statement for registration

6. The application form for registration of the capital processing equipment is filled in according to the form established in appendix No. 1, and online by means of the Integrated information system "e-ANSA" moves.

7. The following documents are enclosed to the application for registration of the capital processing equipment:

7.1. copy of the technical document of processing equipment;

7.2. the documents confirming compliance to metrological requirements to technological reservoirs, gages of amount and to systems of dynamic measurement of amounts of liquids, and also to the accounting counter with fiscal memory;

7.3. the scheme of arrangement of processing equipment which is subject to sealing. In the scheme of arrangement of processing equipment described by business entity flanges on all extent of the pipeline, pipeline junction with the line of pouring, the place of access to nodes and elements of adjustment, blocking, registration and data transmission, and also other installations which can affect indicators of measurements shall be specified.

8. The application for registration of the capital processing equipment considered by the National agency on safety of foodstuff (further - NABPP), can be rejected if:

8.1. the device (assembly) of the capital processing equipment does not allow to perform sealing on all technological flow;

8.2. in time, the submitted representatives of the monitoring bodies mentioned in Item 9, business entity does not update the scheme of arrangement of the capital processing equipment according to actual state.

Section 2 Sealing and registration of the capital processing equipment

9. Sealing of the capital processing equipment is performed by representatives of NABPP, State Tax Administration (further - GNS) and the State inspectorate for supervision of non-food products and consumer protection by means of conducting joint check.

10. Sealing of the capital processing equipment is performed on all technological flow, including at the accounting counter with fiscal memory. In case of production of alcoholic drinks with volume fraction of alcohol at least 25% sealing is performed to the line of the device of pouring.

11. Seals with marking of SFS fasten the representative of GNS and are specified in the scheme of arrangement of processing equipment.

12. The protocol of sealing of the capital processing equipment is constituted in four copies according to the form established in appendix No. 2, and signed by representatives of the monitoring bodies mentioned in Item 9, and also the representative of business entity with delivery to everyone in one copy. The scheme of arrangement of processing equipment in which the place and number of the attached seals is specified is attached to the protocol.

13. In case of discrepancy of the scheme of arrangement of processing equipment to actual state marks are brought in the provided scheme with creation of the protocol of control and specifying of recommendations. Seals fasten only after accomplishment by business entity of the recommendations established in the protocol of control.

14. If the representatives of monitoring bodies mentioned in Item 9, established failure to carry out of the recommendations specified in Item 13, or the device (assembly) of the capital processing equipment does not allow to perform sealing on all technological flow, the protocol on impossibility of sealing of the capital processing equipment is constituted.
