About production and turnover of ethyl alcohol and alcoholic products
The parliament adopts this organic law.
For the purposes of this law the following concepts are used:
ethyl alcohol - the alcohol received by spirit fermentation of agricultural raw materials of phytogenesis with distillation and the subsequent rectification, and alcohol synthetic, received by catalytic hydration of ethylene.
Ethyl alcohol are alcohol the ethyl rectified agricultural origin, ethyl technical alcohol and ethyl alcohol denatured;
alcohol ethyl rectified agricultural origin – the ethyl alcohol received by rectification of alcohol raw and/or ferment after spirit fermentation, from agricultural raw materials of phytogenesis, with volume fraction of alcohol at least 96%;
ethyl technical alcohol – ethyl alcohol, on the structure not suitable for use in the food purposes;
the ethyl alcohol denatured – the ethyl alcohol containing additives of special substances (denaturant substances) determined in part (1) Article 18-1, availability of which excludes its use in case of production of food alcoholic products;
pre-trial detention – the document asked for import, certifying that the amount of ethyl alcohol requested according to the production program is approved with the National agency on safety of foodstuff;
alcoholic products – the food products intended for consumption by the person with volume fraction of alcohol of more 1,2 of % of amount;
alcoholic beverages – the alcoholic products intended for consumption by the person, with special organoleptic characteristics and content of ethyl alcohol at least 15% of amount, made or from distillate of agricultural origin or alcohol of the ethyl rectified agricultural origin or their blending, with addition or without addition of juice, tinctures, fruit drinks, extracts, sacchariferous products, natural fragrances or aromatic substances, the prepared water and other ingredients, or only from natural ingredients;
hard alcoholic drinks – alcoholic products with volume fraction of alcohol at least 25%;
low alcohol drink – alcoholic products with volume fraction of alcohol from 1,2 to 7%;
alcoholic drink with low content of alcohol – alcoholic products with volume fraction of alcohol from 7 to 15%;
producers are the business entities having the necessary equipment, having the corresponding license and meeting the requirements provided by this law for production of ethyl alcohol, alcoholic products;
production capacities – the processing equipment necessary according to the requirements established in the regulations approved by the Government for the providing production cycle of production of ethyl alcohol and alcoholic products declared in the forecast of the production program;
turnover of alcoholic products – purchase (including import), delivery (including export), use, storage (warehousing) and realization (wholesale and retail) alcoholic products;
the accounting counter with fiscal memory – the metering device and control of alcohol ethyl and hard alcoholic drinks;
mernik of amount for realization of liquids – the metering device and control of ethyl alcohol and distillates of agricultural origin;
standard warehouse for storage of ethyl alcohol – the warehouse equipped with technological reservoirs, the equipment and mernik of various capacity for acceptance, storage and leave of ethyl alcohol according to requirements of the specifications and technical documentation;
specialized warehouse – the warehouse which is specially equipped for storage and wholesale of the packed alcoholic products;
the regulating documentation – the standards, codes of positive practice and other documents determining rules, the main directions or characteristics of different types of activities or their results;
distillate of agricultural origin – the product received by distillation after spirit fermentation of agricultural raw materials of phytogenesis which has neither properties of the alcohol ethyl rectified, nor properties of alcoholic drink, but keeps aroma and taste of the used raw materials;
counterfeited (counterfeit) products – products which on the structure and method of production do not correspond to the existing regulating documentation and are represented as authentic, misleading the consumer, or the false duplicate reproducing authentic sample;
stopper with the lens – the device for one-time packing of bottle excluding possibility of penetration into liquid bottle from the outside without destruction of the device;
Excise stamp – the brand representing print on special paper of certain size with special texts and distinctive marks, issued by the state, containing information on alcoholic products and used for marking of separate categories of excisable alcoholic products. Takes place on the finished goods made in the Republic of Moldova and intended for domestic sale and also on the imported alcoholic products;
alcoholic energy drinks – the alcoholic products intended for consumption by the person, containing various combinations of carbohydrates with one or several substances: vitamins, minerals, caffeine, taurine, carnitine, guarany, glyukuronolaktony and other connections having the stimulating effect on the central nervous system.
(1) This law establishes legal and administrative basis and bases of control and quality assurance in the field of production and turnover of ethyl alcohol and alcoholic products, except for wine, products received on the basis of mash, and the flavored grape and wine-making products in value of the Law on grapes and wine No. 57/2006.
