About licensing of export regenerated paper and cardboard (waste paper and waste)

Based on articles 29 and 47 of the Agreement on the Eurasian Economic Union of May 29, 2014 and subitem 1.5 of Item 1 of the Presidential decree of the Republic of Belarus of April 5, 2016 "About state regulation of foreign trade activity" the Council of Ministers of the Republic of Belarus DECIDES: No. 124
1. Determine that under the one-time licenses granted by the Ministry of anti-monopoly regulation and trade (further respectively – licenses, MARCH) in coordination with the Belarusian production and trade concern forest, woodworking and pulp and paper industry (further – Bellesbumprom concern) according to the procedure, similar established by Rules of issue of the licenses and import permits and (or) commodity import included in the single inventory to which measures of non-tariff regulation in trade with the third countries approved by the Decision of Council of the Eurasian economic commission of November 24, 2023 No. 125, are applied export out of limits of the Republic of Belarus is performed:
in state members of the Eurasian Economic Union (further – EEU) regenerated paper or cardboard (waste paper and waste) (code 4707 of the single Commodity nomenclature of foreign economic activity of EEU) * regardless of their origin (further – goods);
to the states which are not state members of EEU, goods in case of their room under customs procedures of export, temporary export, outward processing and re-export.

2. Action of Item 1 of this resolution does not extend to the goods moved through the territory of the Republic of Belarus within the international transit carriages which are beginning and coming to an end outside the territory of the Republic of Belarus.
3. The legal entity, the individual entrepreneur for receipt of approval of licensing for commodity exportation address in MARCH with submission of the following documents:
the application for licensing for commodity exportation issued according to appendix No. 1 to Rules of issue of the licenses and import permits and (or) commodity import included in the single inventory to which measures of non-tariff regulation in trade with the third countries are applied;
other documents and (or) data according to the legislation on ministerial procedures.
4. The documents specified in Item 3 of this resolution (further if other is not provided, – documents), are represented in MARCH during acceptance of the interested person, or by means of mail service, or the courier (courier).
5. Documents within five working days from the date of their receipt go MARCH (with use of the protected systems of electronic communication or by means of interdepartmental information systems) to Bellesbumprom concern for review of licensing for commodity exportation.
6. The Bellesbumprom concern within five working days from the date of receipt of documents makes the decision on approval or on refusal in approval of licensing for commodity exportation of representation of motivated refusal.
Approval of licensing for commodity exportation is performed by putting down on the statement for licensing for commodity exportation of the signature of person authorized on approval and impress of a seal of Bellesbumprom concern.
The basis for refusal in approval of licensing for commodity exportation is need of satisfaction (providing) of requirement of the organizations in the domestic market of the Republic of Belarus in the goods declared to export.
7. MARCH refuses licensing for commodity exportation in cases:
the terminations or suspensions of action of one or several documents forming the basis for licensing for commodity exportation;
violations of the international obligations of state members of EEU which can come owing to agreement performance for which realization the license for commodity exportation is requested;
provided in article 25 of the Law of the Republic of Belarus of October 28, 2008 No. 433-Z "About bases of ministerial procedures";
receipts of refusal of Bellesbumprom concern in approval of licensing for commodity exportation.
8. To the Ministry of Foreign Affairs to notify the Eurasian economic commission on introduction of the measure of non-tariff regulation specified in Item 1 of this resolution.
9. To the State Customs Committee:
provide control of commodity exportation according to the paragraph to third Item 1 of this resolution;
monthly to the 25th following reporting to provide data on the amounts of commodity exportation, in electronic form in Bellesbumprom concern and MARCH, placed under customs procedures of export, temporary export, outward processing and re-export, and also exported to other state members of EEU concerning which customs authorities register statistical declarations, for the purpose of carrying out the analysis of observance of paragraph two of Item 1 of this resolution.
10. Make changes to resolutions of Council of Ministers of the Republic of Belarus according to appendix.
11. This resolution becomes effective in the following procedure:
Item 2 appendices – from the date of adoption of this resolution;
other provisions of this resolution – after its official publication.
Items 1-9 of this resolution are effective within six months after its official publication.
