1. Approve:

1) Rules of representation by the member of the International financial center "Astana" having license for activities on management of loan crowdfunding platform in body of state revenues of data on the signed agreements on crowdfunding platforms, and also the paid remunerations to residents and nonresidents, according to appendix 1 to this order;

2) form of data on the signed agreements on crowdfunding platforms, and also the paid remunerations to residents and nonresidents, according to appendix 2 to this order.

2. To provide to committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan after official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. This order becomes effective after ten calendar days after day of its first official publication and is effective till December 31, 2025 inclusive.

Chapter 1. General provisions

1. These rules of representation by the member of the International financial center "Astana" having license for activities on management of loan crowdfunding platform in body of state revenues of data on the signed agreements on crowdfunding platforms, and also the paid remunerations to residents and nonresidents (further - Rules), are developed according to Item 29 of article 26 of the Code of the Republic of Kazakhstan "About taxes and other obligatory payments in the budget" (Tax code) and the subitem 2) of Item 3 of article 16 of the Law of the Republic of Kazakhstan "About the state statistics" and determine procedure for representation by the member of the International financial center "Astana" having license for activities on management of loan crowdfunding platform, data on the signed agreements on crowdfunding platforms and also the paid remunerations to residents and nonresidents (further - data) in body of state revenues.

Chapter 2. Procedure for representation by the member of the International financial center "Astana" having license for activities on management of loan crowdfunding platform in body of state revenues of data on the signed agreements on crowdfunding platforms, and also the paid remunerations to residents and nonresidents

2. Data are represented to bodies of state revenues by the member of the International financial center "Astana" having license for activities on management of loan crowdfunding platform annually no later than the November 25 following after accounting year in form according to appendix 2 to this order.

In case of cancellation of the license the member of the International financial center "Astana", having license for activities on management of loan crowdfunding platform shall provide within 10 calendar days final data for the incomplete accounting period. In case of liquidation of the participant or transfer of portfolio of loans to other operator of the data are represented by the legal successor according to the procedure, established by these rules.

3. Data are represented to body of state revenues by the member of the International financial center "Astana" having license for activities on management of loan crowdfunding platform from the automated information system of the International financial center "Astana" in the information system "Smart Data Finance" of Committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan.

4. In case of violation of terms of representation or provision of false information the responsibility measures established by the Code of the Republic of Kazakhstan "About taxes and other obligatory payments in the budget" (Tax code) and also are applied by other regulatory legal acts of the Republic of Kazakhstan.

5. Processing of personal data is performed according to the Law of the Republic of Kazakhstan "About personal data and their protection".
