About establishment of temporary disability and issue of leaf about medical leave

Based on part (2) article 22 of the Law No. 411/1995 on health protection (The official monitor of the Republic of Moldova, 1995, No. 34, the Art. 373), with subsequent changes, and article 8 of the Law No. 289/2004 on temporary disability benefits and other benefits of social insurance (The official monitor of the Republic of Moldova, 2004, Art. No. 168-170, 773), with subsequent changes, DECIDES: the Government

1. Approve the Instruction about establishment of temporary disability, conditions and procedure for issue of leaf about medical leave it (is applied).

2. Provide to public organization "Agency of Electronic Control" development of the Portal of leaves about medical leave and provide the developed decision to the Ministry of Health according to regulations of the Order of the Government No. 901/2015 on approval of the Regulations on procedure for transfer of objects of public property.

3. To the Ministry of Health before the date of entry into force of this resolution to submit the regulatory base concerning functioning of the Portal of leaves about medical leave for approval.

4. To impose control over the implementation of this resolution on the Ministry of Health.

5. Declare invalid the Order of the Government 469/2005 about approval of the Instruction about procedure for issue of leaf about medical leave (The official monitor of the Republic of Moldova, 2005, Art. No. 77-79, 529), with subsequent changes.

6. This resolution becomes effective since March 1, 2026.

Chapter I. General provisions

1. The instruction about establishment of temporary disability, conditions and procedure for issue of leaf about medical leave (further - the Instruction) regulates conditions and procedure for establishment of temporary disability, issue of leaf about medical leave in electronic form for persons insured in system of the national social insurance and the unemployed (further - insured persons).

2. Establishment of temporary disability represents the process documented in digital form by means of which the family doctor or the profile specialist doctor (further - the attending physician) establishes temporary inability of person for health reasons to perform labor activity in all subjects in which it works, according to the corresponding regulatory base.

3. The leaf about medical leave (further - the Leaf) is the document of statistical, financial, social and legal property which confirms temporary disability of insured person due to illness, because of injury, intoxication or other consequences of external impacts, and also for the purpose of the prevention of diseases (quarantine), working capacity recoveries, including sanatorium treatment, on pregnancy and childbirth or the state of health of the child who is in dependence.

4. The corresponding records about the Leaf on the Portal of leaves about medical leave (further - the Portal) are confirmed by the digital signature of the attending physician.

5. Unique number of the Leaf is automatically generated by the Portal and allows to identify and check the document.

6. The state and private suppliers of primary and specialized out-patient medical care working under contracts with National medical insurance company, departmental medical institutions and suppliers of medical services of stationary type have the right to issue of the Leaf.

7. Establishment of temporary disability without fail is registered on the Portal in day of the request for medical care. The leaf issued to the employee, the personality and which status fall under conditions of the Law No. 245/2008 on the state secret is not registered on the Portal. The procedure for issue and accounting of leaf for this employee category is established by the departmental act of the subject, taking into account the principles established by this Instruction.

8. Heads / administrators of suppliers of medical services with the right of issue of the Leaf shall provide necessary conditions for establishment of temporary disability and data recording on the Portal, with observance of provisions of this Instruction, and also to inform insured person on procedure and conditions of issue of the Leaf.

9. In cases when need of continuation of out-patient treatment at other doctor is established or in the conditions of hospital and vice versa, the attending physician issues leaf with the mark "prelungeste tratamentul" ("continues treatment"). Based on it the attending physician responsible for further observation of insured person registers temporary disability in accordance with the established procedure, and the Portal automatically generates the new Leaf containing the reference to the previous Leaf.

10. The periods of temporary disability which arose outside the country during annual issue / business trip / distant work and also in case of the treatment which is carried out abroad are registered the family doctor on the Portal backdating, in day of the address of insured person, but no later than six months after return to the country, in case of cumulative observance of the following conditions:

10.1. the supporting medical documents issued by the medical institutions specializing in treatment of the diagnosed pathologies with recommendations of attending physicians from abroad are provided;

10.2. medical documentation is submitted to the family doctor in whose list insured person who need of the translation into Romanian by specialized translation bureaus identifies is registered;

10.3. at the request of the family doctor advisory medical board of medical and sanitary organization approves establishment of temporary disability and introduction of data backdating on the Portal with indication of the period and the reason of temporary disability supported by the medical documents attached to primary medical documentation.
