About creation of the special economic zone "Korkyt Ata" and modification of some decisions of the Government of the Republic of Kazakhstan

According to the subitem 2) of article 10 of the Law of the Republic of Kazakhstan "About special economic and industrial zones" the Government of the Republic of Kazakhstan DECIDES:

1. Create the special economic zone "Korkyt Ata" (further – SEZ "Korkyt Ata") for the period till December 31, 2049.

2. Approve enclosed:

1) Regulations on SEZ "Korkyt Ata";

2) SEZ "Korkyt Ata" target indicators;

3) changes which are made to some decisions of the Government of the Republic of Kazakhstan.

3. This resolution becomes effective from the date of its signing.

Regulations on the special economic zone "Korkyt Ata"

Chapter 1. General provisions

1. The special economic zone "Korkyt Ata" (further – SEZ) is located in the territory of the Kyzylorda area, in southeast part of the city of Kyzylorda, near the international transport corridor "Western Europe – the Western China" and the bypass road of the international airport "Korkyt Ata" in borders according to appendix to this Provision.

SEZ is port special economic zone.

The territory of SEZ constitutes 550 hectares and is integral part of the territory of the Republic of Kazakhstan.

2. SEZ is created for the purpose of:

1) the accelerated development of modern high-productive, competitive productions, forming of qualitatively new level of provision of services, investment attraction, implementation of new technologies in industry of economy and the region, and also population employment increase;

2) increases in tourist capacity of the region and development of the highly effective, competitive tourist infrastructure capable to provide and satisfy needs of the arriving Kazakhstan and foreign tourists;

3) uses of advantageous geographical location for development of multimodal hubs, transport and logistics, effective establishing production and trade and logistic processes, including proximity of long and automobile distance railways which connect it with the largest economic centers of Kazakhstan for economic delivery of components and nodes, and also access to the international transport corridor "Western Europe – the Western China" that will allow to sell effectively products in the markets of Kazakhstan, Central Asia and the Russian Federation.

3. Activities of SEZ are regulated by the Constitution of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan "About special economic and industrial zones" (further – the Law) and other legislation of the Republic of Kazakhstan.

If the international treaty ratified by the Republic of Kazakhstan establishes other rules, than those which contain in the legislation on special economic zones are applied rules of the international treaty.

4. In the territory of SEZ the special legal regime is set.

For construction of facilities, installation of power lines and placement of other constructions which are obstacles in aerodrome environs and the area within airways; for work owing to which in airspace are made radio wave, visible, acoustic and other types of radiation; for placement of the objects creating conditions for mass accumulation of birds or worsening flight visibility, and also any other activities which are not connected directly with use of airspace, but influencing safety of flights, the equipment of aircrafts and the people who are on them in the territory of SEZ need receipt of the corresponding permission provided by the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft".

Chapter 2. Management of the special economic zone "Korkyt Ata"

6. Control of SEZ is exercised according to the Law.

Chapter 3. The taxation in the territory of the special economic zone "Korkyt Ata"

7. The taxation in the territory of SEZ is regulated by the tax legislation of the Republic of Kazakhstan.

Chapter 4. Customs regulation

8. In the territory of SEZ or its part customs procedure of free customs zone is effective.

9. The territory of SEZ in which customs procedure of free customs zone is applied is the customs control zone. The territory of SEZ shall be equipped for the purpose of carrying out customs control. Requirements to arrangement of the territory of SEZ, including requirements for barrier and equipment of perimeter of such territory system of video surveillance, are established by authorized body in the field of customs affairs.

Chapter 5. Procedure for stay of foreign citizens in the territory of the special economic zone "Korkyt Ata"

10. In the territory of SEZ the procedure for entrance, departure, transit and stay of foreign citizens and stateless persons, and also their vehicles established by the legislation of the Republic of Kazakhstan and international agreements ratified by the Republic of Kazakhstan is effective.

Chapter 6. Final provisions

11. The conditions established in this Provision can change the order of the Government of the Republic of Kazakhstan.

12. SEZ is abolished on the bases provided by the Law.

13. In case of abolition of SEZ "Korkyt Ata" in connection with the expiration on which it was created, akimat of Kyzylorda area:

1) not later than three months before the expiration of the specified term is published in mass media by the announcement of the forthcoming abolition SEZ, procedure and terms of reception of applications and claims connected with its abolition;

2) is provided by explanation to the legal entities and physical persons performing activities in the territory of SEZ, procedure for renewal of the goods which are in its territory under other customs procedure;

3) after abolition of SEZ is represented in a month to the President and to the Government of the Republic of Kazakhstan by the report on results of activities of SEZ.

14. In case of early abolition of SEZ the order of the Government of the Republic of Kazakhstan the procedure shall be complete not later than in six-months time with observance of procedures, stipulated in Item the 13th this provision.
