1. Approve the enclosed Rules of provision of dwellings to the citizens who were left without dwelling as a result of emergency situation.

2. To provide to committee on cases of construction and housing and communal services of the Industry ministry and construction of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Industry ministry and construction of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Industry and construction of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of provision of dwellings to the citizens who were left without dwelling as a result of emergency situation

Chapter 1. General provisions

1. These rules of provision of dwellings to the citizens who were left without dwelling as a result of emergency situation (further - Rules) are developed according to the Law of the Republic of Kazakhstan "About civil protection" and determine procedure for provision of dwellings to the citizens who were left without dwelling as a result of emergency situations of natural and technogenic nature.

2. Action of these rules does not extend to the temporary structures, economic and household and other constructions which are not relating according to the Law of the Republic of Kazakhstan of July 16, 2001 "About architectural, town-planning and construction activities in the Republic of Kazakhstan" to real estate objects, and also objects illegally constructed.

3. In these rules the following basic concepts are used:

1) emergency situation - the situation in certain territory which developed as a result of accident, the fire, harmful effects of dangerous production factors, natural hazard, catastrophic crash, natural or other disaster which can entail or was entailed by the human victims, harm to human health or the environment, significant material damage and violation of conditions of life activity of people;

2) emergency situations of natural nature - the emergency situations which developed as a result of natural hazards (the geophysical, geological, meteorological, agrometeorological, hydrogeological dangerous phenomenon), the natural fires, epidemics, defeat of agricultural plants and woods diseases and wreckers;

3) emergency situations of technogenic nature - the emergency situations caused by harmful effects of dangerous production factors, transport and other accidents, the fires (explosions), accidents with emissions (emission threat) of strong poisonous, radioactive and biologically dangerous substances, sudden building collapse and constructions, breaks of dikes, accidents on electrical power and communication life support systems, treatment facilities;

4) the dwelling - the separate residential unit (the individual apartment house, the apartment, the room in the hostel, the modular (mobile) apartment house) intended and used for permanent residence, answering to the established construction, sanitary, environmental, fire protection and other obligatory standards and rules;

5) the standard project - the design estimates for further repeated application when designing developed within the budget program of authorized body for architecture, town planning and construction;

6) local executive body (akimat) - the collegiate executive body headed by the akim of area, city of republican value and the capital, area (city of regional value), exercising within the competence local public administration and self-government in the corresponding territory;

7) mitigation of consequences of emergency situations - the events held on recovery of engineering infrastructure, housing, environment, rendering the social and rehabilitation help to the population, indemnification (damage) caused to physical persons and legal entities owing to emergency situations.

Chapter 2. Procedure for provision of the dwellings to citizens which were left without dwelling as a result of emergency situation

4. The citizens who were left without dwelling as a result of emergency situation after emergence of emergency situation address to local executive body in the territory of which there was emergency situation and provide the following documents:

1) copy of the identity document of the injured citizen;

2) the statement from the owner of real estate (or from his representative by proxy) in form according to appendix 1 to these rules;

3) cadastral passport of real estate object (dwelling);

4) the identification document on the parcel of land (the act on the right of private property to the parcel of land);

5) the certificate of lack (availability) of real estate issued by The Government for Citizens State corporation.

6) in case of absence at injured citizens of documents of title on the dwelling confirmation of ownership of the specified dwelling are data from joint-stock company "The Kazakstan Garysh Sapara national company, and also one of data: social security authorities; internal affairs, Government for Citizens State corporation; healthcare institutions and education; about payment of utility bills.
