About establishment of some measures for the prevention of import of harmful organisms to the territory of the Republic of Moldova

Based on part (2) article 41 of the Law No. 422/2023 on protective measures against organisms, harmful to plants (The official monitor of the Republic of Moldova, 2024, Art. No. 98-100, 147) DECIDES: the Government

1. Approve:

1.1. Regulations on establishment of some measures concerning the certain fruits coming from Argentina, Brazil, South Africa, Uruguay and Zimbabwe for the prevention of import and distribution in the Republic of Moldova of harmful organism of Phyllosticta citricarpa (Mc Alpine) of Van der Aa, according to appendix No. 1;

1.2. Regulations on measures for the prevention of import and distribution in the Republic of Moldova Aromia bungii (Faldermann), according to appendix No. 2;

1.3. Regulations on temporary approval of some urgent measures against distribution of Ralstonia solanacearum (Smith) of Yabuuchi et al., coming from Egypt, according to appendix No. 3.

2. When importing on the territory of the Republic of Moldova of the fruits listed in Regulations on establishment of some measures concerning the certain fruits coming from Argentina, Brazil, South Africa, Uruguay and Zimbabwe for the prevention of import and distribution in the Republic of Moldova of harmful organism of Phyllosticta citricarpa (Mc Alpine) of Van der Aa to comply with the conditions specified in Sections 1-5 of appendix No. 1.

3. To impose control over the implementation of this resolution on the National agency on safety of foodstuff.

4. To declare appendix No. 1 to this resolution invalid from the date of accession of the Republic of Moldova to the European Union.

This Provision shifts Implementation regulations (EU) 2022/632 of the Commission of April 13, 2022 establishing some temporary measures concerning the certain fruits coming from Argentina, Brazil, South Africa, Uruguay and Zimbabwe for the prevention of import and distribution in the Union of harmful organism of Phyllosticta citricarpa (Mc Alpine) of Van der Aa (CELEX: 32022R0632), published in the Official magazine of the European Union by L 117 of April 19, 2022.

Chapter I. General provisions

1. This Provision establishes measures concerning the certain fruits coming from Argentina, Brazil, South Africa, Uruguay and Zimbabwe for the prevention of import and distribution in the Republic of Moldova of harmful organism of Phyllosticta citricarpa (McAlpine) of Van der Aa.

2. In value of this provision the following concepts are determined:

2.1. certain harmful organism - harmful organism of Phyllosticta citricarpa (McAlpine) of Van der Aa;

2.2. certain fruits - fruits of types of Citrus L., Fortunella Swingle, Poncirus Raf., and their hybrids, except fruits of types of Citrus aurantium L. and Citrus latifolia Tanaka.

Chapter II. Import of certain fruits to the territory of the Republic of Moldova, except the fruits intended only for industrial conversion

3. According to the procedure of departure from the subitem 3) of Item 75 and the subitem 4) of Item 75 of appendix No. 5 to the Regulations on application of protective measures against organisms, harmful to plants, approved by the Order of the Government No. 679/2024 about approval, the certain fruits coming from Argentina, Brazil, South Africa, Uruguay and Zimbabwe except the fruits intended only for industrial conversion can be imported on the territory of the Republic of Moldova only according to Items 4-7 and in case of observance of all conditions provided in Sections 1-5, concerning the respective country.

4. Import to the country of certain fruits is performed according to Item 16 of the Regulations on procedure for the crossing of frontier the goods which are subject to control by the National agency on safety of foodstuff approved by the Order of the Government No. 938/2018, with codes of traceability of the production sites included in the updated lists specified in Items 26, of 36, of 47, 56 and 66.

5. The competent authority provides that under its official supervision and by means of the updated lists specified in Items 26, of 36, of 47, 56 and 66, professional operators showed for import only the consignments coming from the production sites specified in Items 28, of 29, of 38, of 49, 58 and 68.

6. Physical controls are carried out on the samples consisting at least of 200 fruits of each type of certain fruits, of 30-ton batches or their part which is selected on the basis of establishment of any symptom, perhaps caused by certain harmful organism.

7. In case of identification of the symptoms caused by certain harmful organism during the physical controls specified in Item 6, presence of the corresponding harmful organism it proves to be true or confuted by testing of the specified fruits at which symptoms are observed.

Chapter III. Import and movement in the Republic of Moldova of the certain fruits intended only for industrial conversion

8. According to the procedure of departure from the subitem 5) of Item 75 of the appendix No. 5 to the Regulations on application of protective measures against organisms, harmful to plants, approved by the Order of the Government No. 679/2024, the certain fruits coming from Argentina, Brazil, South Africa, Uruguay or Zimbabwe, intended only for industrial conversion are imported, move, processed and are stored in the territory of the Republic of Moldova only according to Items 8-17 and in case of cumulative accomplishment of the following requirements:

8.1. certain fruits were made in one of the respective countries in the approved production site in which protective processings and effective measures of fight against certain harmful organism at a well-chosen moment after the beginning of the last vegetative cycle were carried out, and their application was checked under official supervision of the National organization for protection of plants (further - NOZR) this country;
