1. Approve the enclosed standard conditions of the service provision contracts on carrying out construction supervision signed in accordance with the legislation of the Russian Federation about contractual system in the sphere of purchases of goods, works, services for ensuring the state and municipal needs.

2. This resolution is applied to the relations connected with implementation of purchases of services in carrying out construction supervision, notices on which implementation are placed in unified information system in the sphere of purchases or invitations to take part in determination of the contractor on which are sent after day of entry into force of this resolution, and also in case of the conclusion of contracts with the single contractor after day of entry into force of this resolution.

3. Determine that the standard conditions of service provision contracts on carrying out construction supervision approved by this resolution are applied when implementing purchases of services in carrying out construction supervision in the course of construction, reconstruction, capital repairs of capital construction projects, including linear objects and objects of transport infrastructure.

Standard conditions of the service provision contracts on carrying out construction supervision signed in accordance with the legislation of the Russian Federation about contractual system in the sphere of purchases of goods, works, services for ensuring the state and municipal needs

I. Conditions about obligations of the contractor

1. Render services in carrying out construction supervision in the course of construction <1>, reconstruction <2>, capital repairs <3> (further - services) capital construction project <4> (further - object) on the conditions provided by the contract and according to the procedure for carrying out construction supervision established by the Government of the Russian Federation according to part 8 of article 53 of the Town-planning code of the Russian Federation (further - procedure).

2. Inform the customer:

about the revealed shortcomings of works, designs, sites of the networks of engineering facilities allowed by person performing construction <1>, reconstruction <2>, capital repairs> object in case of performance of works;

about the revealed cases of discrepancy of works to requirements of technical regulations, and also about cases in case of which results of the performed works and (or) further works create threat of life and to human health, property of legal entities and physical persons, the environment, emergence of the accidents allowed by person performing construction <1>, reconstruction <2>, capital repairs> object, and the works which are the basis for suspension on object;

about each case of emergence of emergencies on the object which became known to the contractor during rendering services to them.

3. Fix results of holding control action by creation and the direction to the customer of the act, including in cases:

detection of circumstances which pose threat to results of works;

identifications of the facts of violation by person performing construction <1>, reconstruction <2>, capital repairs> object, the organization and methods of conducting works, their discrepancy to technical regulations, and also use by person performing construction <1>, reconstruction <2>, capital repairs> object, materials and (or) the equipment or performance of works which quality does not answer terms of the contract performance of works on construction <1>, reconstruction <2>, capital repairs <3> object;

identifications of violations of completeness and observance of fixed terms of accomplishment by person performing construction <1>, reconstruction <2>, capital repairs> object, the sequence and structure of technological transactions on implementation of construction <1>, reconstruction <2>, capital repairs <3> object and reliability of documentation of its results;

identifications of violations of maintaining by person performing construction <1>, reconstruction <2>, capital repairs> object, general registers of performance of works;

identifications of violations of maintaining by person performing construction <1>, reconstruction <2>, capital repairs> object, executive documentation;

identifications of violations of completeness and observance of fixed terms of accomplishment by person performing construction <1>, reconstruction <2>, capital repairs> object, quality check of the construction materials, products, designs and the equipment delivered for asset construction, and reliability of documentation of results of such check, and also the facts of violation of accomplishment by the specified person of control actions for observance of warehousing rules and storage of the applied materials, products, designs and the equipment delivered for asset construction, and reliability of documentation of their results;

identifications of violations by person performing construction <1>, reconstruction <2>, capital repairs <3> object, in case of survey by it together with the contractor, hidden by the subsequent works, intermediate acceptance of the built building constructions influencing safety of object, sites of networks of engineering facilities.

4. Hold according to procedure control events together with person performing construction <1>, reconstruction <2>, capital repairs> object, based on the this document of the notification received from the customer according to Item 15.
