About approval of the Procedure for provision of the guarantee to subjects of national economy

According to part 1 of Article 63-1 of the Budget code of the Kyrgyz Republic, Articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Approve the Procedure for provision of the guarantee to subjects of national economy according to appendix.

2. Bring in the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About questions of the Ministry of Finance of the Kyrgyz Republic" of November 15, 2021 No. 253 the following change:

in Regulations on the Ministry of Finance of the Kyrgyz Republic approved by the above-stated resolution:

- the eleventh the subitem 5 of Item 12 to state the paragraph in the following edition:

"-provides in accordance with the established procedure realization of the mechanism of execution of the guarantee;".

3. Recommend to financial credit institutions to be guided by the Procedure specified in Item 1 of this resolution.

4. Recognize invalid:

1) the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About approval of the Procedure for provision of the guarantee to subjects of national economy" of June 20, 2022 No. 326;

2) the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About introduction of amendments to the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About approval of the Procedure for provision of the guarantee to subjects of national economy" of June 20, 2022 No. 326" of September 9, 2022 No. 509;

3) the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About introduction of amendments to the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About approval of the Procedure for provision of the guarantee to subjects of national economy" of June 20, 2022 No. 326" of January 31, 2023 No. 42;

4) the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About introduction of amendments to the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About approval of the Procedure for provision of the guarantee to subjects of national economy" of June 20, 2022 No. 326" of April 4, 2023 No. 182;

5) the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About introduction of amendments to the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About approval of the Procedure for provision of the guarantee to subjects of national economy" of June 20, 2022 No. 326" of September 13, 2023 No. 462;

6) the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About modification of some decisions of the Cabinet of Ministers of the Kyrgyz Republic concerning the Ministry of Finance of the Kyrgyz Republic" of May 6, 2024 No. 217.

5. This resolution becomes effective after seven days from the date of official publication.

Procedure for provision of the guarantee to subjects of national economy

Chapter 1. General provisions

1. The procedure for provision of the guarantee to subjects of national economy (further - the Procedure) regulates the procedure of provision of the guarantee to subjects of national economy the authorized Cabinet of Ministers of the Kyrgyz Republic (further - the Cabinet of Ministers) person.

2. The guarantee is provided to legal entities - residents of the Kyrgyz Republic according to the decision of the Cabinet of Ministers in coordination with special-purpose committee of Jogorku Kenesh of the Kyrgyz Republic for the purpose of rendering the state support for ensuring obligation fulfillment of subjects of national economy (further - subjects) on the credit, leasing or the bank guarantee.

The guarantee cannot be provided for ensuring obligation fulfillment of subjects under investment agreements, except as specified, when participation of the investor in financing of the project constitutes at least 30 (thirty) percent from the total cost of the project supported by the relevant documents.

3. The guarantee purpose - rendering the state support for ensuring economic, homeland and food security of the Kyrgyz Republic, and also maintenance of stability and development of industries of economy.

4. The guarantee is provided for providing obligations completely or in the part which is not becoming covered by mortgage providing on the credit, leasing or the bank guarantee.

5. The guarantee is provided on the duration of the agreement, concluded between the creditor and the subject if other is not established by the decision of the Cabinet of Ministers.

6. In this Procedure the following determinations are used:

1) homeland security - the guaranteed condition of security of the vital interests of the personality, society and state from internal and external threats;

2) authorized state body on forecasting and budget implementation - the central executive body authorized by the Cabinet of Ministers for development of state policy, coordination regulation and accomplishment of executive functions in the budget and financial spheres;

3) authorized state body on economic forecasting - the central executive body authorized by the Cabinet of Ministers for development and realization of single state policy in the field of economic development and the tax sphere;

4) the guarantee - the mechanism of ensuring obligation fulfillment of the subject of national economy before the financial and credit, international and foreign organizations provided from person authorized by the Cabinet of Ministers on provision of the guarantee;

5) food security - state of the economy of the Kyrgyz Republic in case of which food independence of the republic is provided and is guaranteed physical and economic availability of food to the population according to the established minimum consumption rates of food;

6) economic safety is condition of security of national economy from external and internal threats, long-term condition of stability of economic system, and also capability to economic development which provides possibility of satisfaction and expansion of needs of subjects of economic activity, capability to support worthy level of living;

7) means of the guarantee - the set of money created at the expense of the funds of the republican budget allocated for increase in the authorized capital of the guarantor for obligation fulfillment according to the guarantee.
