About approval of the Procedure for electronic submission of information from the register of insured persons of the State register of obligatory national social insurance on requests of bodies of the State bureau of investigations

According to article 8 of the Law of Ukraine "About operational search activities", Item 10 parts one of Article 6, parts three of article 22 of the Law of Ukraine "About the State bureau of investigations", the list of information systems of public authorities, access to which as the user has the State bureau of investigations, the Cabinet of Ministers of Ukraine approved by the resolution of September 15, 2023 No. 1004, for the purpose of ensuring obtaining electronically by the State bureau of investigations of information from the register of insured persons of the State register of obligatory national social insurance of PRIKAZYVAYU:

1. Approve the Procedure for electronic submission of information from the Register of insured persons of the State register of obligatory national social insurance on requests of bodies of the State bureau of investigations which is attached.

2. This order becomes effective from the date of its official publication.

3. I reserve control over the implementation of this order.

Procedure for electronic submission of information from the register of insured persons of the State register of obligatory national social insurance on requests of bodies of the State bureau of investigations

I. General provisions

1. This Procedure determines the procedure of provision by the Pension fund of Ukraine on requests of the State bureau of investigations and its authorized officers of information from the register of insured persons of the State register of obligatory national social insurance (further - the Register of insured persons), necessary for the State bureau of investigations for realization of the powers provided by the Law of Ukraine "About the State bureau of investigations" (further - information exchange).

2. In this Procedure terms are used in the values given in the Laws of Ukraine "About collection and accounting of single fee on obligatory national social insurance", "About the State bureau of investigations".

3. Subjects of information exchange according to this Procedure are the Pension fund of Ukraine and the State bureau of investigations.

4. Participants of information exchange are:

Pension fund of Ukraine;

Authorized officers of the State bureau of investigations.

5. The electronic information exchange provided by this Procedure is performed by means of system of electronic interaction of the state electronic information Trembita resources according to requirements of the Procedure electronic (technical and information) the interaction approved by the resolution of the Cabinet of Ministers of Ukraine of September 08, 2016 No. 606.

In case of lack of technical capability of data transmission electronic information exchange of subjects of electronic interaction is performed by means of system of electronic interaction of the state electronic information Trembita resources with use of other information and communication systems with observance of requirements for information security according to article 8 of the Law of Ukraine "About information security in information and communication systems".

6. According to this Procedure the Pension fund of Ukraine provides information on the requests of authorized officers of the State bureau of investigations sent which is available in the register of insured persons:

within operational search activities and pre-judicial investigation of the criminal offenses carried to competence of the State bureau of investigations - about source of information about insured persons and the period for which the insurer performed the reporting;

on cases on identification of unreasonable assets and collection of proofs of their groundlessness within competence of the State bureau of investigations - about source and the size of the income of insured persons.

7. The term of processing of requests of authorized officers of the State bureau of investigations shall not exceed 3 working days from the date of, the receipt of request following behind day.

8. Electronic information exchange between subjects of information exchange is performed with observance of requirements of the Laws of Ukraine "About information security in information and communication systems", "About electronic identification and electronic confidential services".

9. The amount and structure of data which subjects of information exchange via program interfaces of electronic information resources exchange (services) are determined by the agreements on information exchange signed according to Procedure electronic (technical and information) the interaction approved by the resolution of the Cabinet of Ministers of Ukraine of September 08, 2016 No. 606, or joint decisions which are drawn up by separate protocols.

Subjects of information exchange provide timeliness and completeness of provision of reliable information.

II. Requirements for the organization of information exchange

1. Subjects of information exchange exercise control relatively:

correctnesses of information containing in requests and answers, its compliance to format and the structure of information exchange established by separate protocols and/or agreements on information exchange;

completeness of information containing in requests and answers on components of its provision.
