Regulations of the Federal Service on control of the alcoholic and tobacco markets

I. General provisions

1. The regulations of the Federal Service on control of the alcoholic and tobacco markets (further respectively - the Regulations, Service) establish general rules of the organization of activities of Service for realization of the powers in the established field of activity, including rules of the internal organization of activities of Service and the rule of interaction of Service with its territorial authorities, the subordinated organizations, other federal executive bodies.

2. The service is the federal executive body performing functions on control of production and turnover of ethyl alcohol, alcoholic (except for the questions of production and turnover of wine-making products provided by the Federal Law of December 27, 2019 No. 468-FZ "About wine growing and winemaking in the Russian Federation") and alcohol-containing products, on supervision and rendering services in this sphere, and also function in control (supervision) in the field of production and turnover of tobacco products, tobacco products, nikotinsoderzhashchy products and raw materials for their production <1>.

The structure and the staff list of central office of Service affirm the head of Service (further - the Head) within the salary fund and number (without personnel on protection and servicing of buildings) established by the Government of the Russian Federation taking into account the register of positions of Federal public civil service and acts determining the normative number of structural divisions of Service <5>.

The structure of central office of Service includes management (The head and his deputies) of Service, assistants (advisers) to the Head and structural divisions on the main activities - managements in central office of Service, and also the departments which are not part of managements, operating as independent structural division of Service (further - structural divisions of Service). 9. The staff list of structural divisions of Service joins positions of Federal public civil service, stipulated by the legislation the Russian Federation, and also the positions which are not positions of Federal public civil service <7> can join.

10. Fields of activity and competence of structural division of Service are determined in regulations on the structural division approved by the Head.

Deputy managers represent Service on single questions of spheres of its activities, will organize and coordinate implementation of functions of Service according to the Regulations, distribution of obligations between the Head and deputy managers (further - distribution of obligations) and other acts of Service, and also orders of the Head.

According to distribution of obligations deputy managers in case of provision of powers by it can sign orders of Service or other types of acts established by the legislation of the Russian Federation on single questions of the organization of activities of Service, and also based on the powers of attorney issued by the Head to sign agreements and other civil documents on behalf of Service.

17. In the order on distribution of obligations are specified:

a) powers of each deputy manager;

b) special powers of the Head;

c) structural divisions of central office, territorial authorities of Service and the subordinated organizations which coordination and control of activities are exercised by the deputy manager;

d) the scheme of temporary fulfillment of duties of the Head (deputy managers) for the period of absence in connection with disease, leave or business trip.

18. The deputy manager according to the decision of the Head according to distribution of obligations:

a) interacts (including corresponds) with public authorities and local government bodies, citizens and the organizations, and also divisions of the Russian Government Office and Administration of the President of the Russian Federation;

b) coordinates and controls work of structural divisions of Service, gives instructions to their heads;
