About wine growing and winemaking in the Russian Federation

1. This Federal Law establishes:
1) legal, organizational, technology and economic basis in the field of production and turnover of products of wine growing and wine-making products (further - the field of wine growing and winemaking) if other is not stipulated by the legislation about state regulation of production and turnover of ethyl alcohol, alcoholic and alcohol-containing products and about restriction of consumption (drinking) of alcoholic products;
2) the principles, the purposes of realization of state policy in the field of wine growing and winemaking and measure for its realization;
3) forms, conditions and procedure of the state support in the field of wine growing and winemaking;
4) powers of public authorities and local self-government in the field of wine growing and winemaking;
5) legal status of subjects of wine growing and winemaking when implementing activities in the field of wine growing and winemaking.
2. This Federal Law governs the relations arising between the organizations, agricultural consumer cooperatives, peasant farms, physical persons, public authorities of the Russian Federation, public authorities of subjects of the Russian Federation and local government bodies in the field of wine growing and winemaking.
3. Operation of this Federal Law does not extend to activities of the citizens conducting personal subsidiary farm according to the Federal Law of July 7, 2003 No. 112-FZ "About personal subsidiary farm" for the purpose of, who are not connected with realization of the made products of wine growing and products of winemaking and also to activities of the citizens conducting gardening and truck farming according to the Federal Law of July 29, 2017 No. 217-FZ "About conducting by citizens gardening and truck farming for own needs and about modification of separate legal acts of the Russian Federation".
1. Legal regulation of the relations in the field of wine growing and winemaking is based on the Constitution of the Russian Federation and consists of this Federal Law, other Federal Laws accepted according to it, other regulatory legal acts of the Russian Federation, the laws and other regulatory legal acts of subjects of the Russian Federation (further - the legislation on wine growing and winemaking).
2. The regulations about wine growing and winemaking containing in other Federal Laws, other regulatory legal acts of the Russian Federation, the laws and other regulatory legal acts of subjects of the Russian Federation shall not contradict regulations of this Federal Law.
3. In case of discrepancy of regulations about the wine growing and winemaking containing in other Federal Laws, other regulatory legal acts of the Russian Federation, the laws and other regulatory legal acts of subjects of the Russian Federation, to regulations of this Federal Law regulations of this Federal Law are applied.
4. Local government bodies within the competence have the right to publish the municipal legal acts containing regulations about wine growing and winemaking according to this Federal Law, other Federal Laws, other regulatory legal acts of the Russian Federation, the laws and other regulatory legal acts of subjects of the Russian Federation.

For the purposes of this Federal Law the following basic concepts are used:
1) autochthonic winemaking - activities for production of wine-making products from autochthonic grades of grapes using exclusively processing methods and means described in open sources no later than 1903 in relation to autochthonic grades of grapes;
1. 1) autochthonic (native) grade of grapes - the grade of grapes of type of Vitis Vinifera described in open sources no later than 1903 under the existing name with characteristic organoleptic characteristics and the certain territory of growth located in borders of vinogrado-wine-making zones;
1. 2) the flavored vinogradosoderzhashchy drinks from grape raw materials - food alcoholic wine-making products which are made for 75 percent at least from wine of fortified wine or grape must with use of sucrose, rectified ethyl alcohol from food raw material, infusions of separate parts of different plants on special compounding and volume fraction of ethyl alcohol in which are in the range from 14,5 to 20 percent;
2) nonalcoholic wine - the foodstuff received from wine and containing in result of its processing by the established method volume fraction of ethyl alcohol of no more 0,5 of percent;
3) the soft drinks and products received from grapes, grape must and wine - the agricultural products received as a result of conversion of grapes, grape must or wine, the volume fraction of content of ethyl alcohol in which does not exceed percent 0,5, including grape juice, the concentrated grape juice, nonalcoholic wine, wine vinegar, glucose, raisin-seed oil, tartaric acid, antotsianovy dye;
3. 1) brandy - wine-making products with volume fraction of ethyl alcohol is at least percent 37,5 made of cognac distillate and (or) wine distillate with addition or without addition of wine spirit in the quantity which is not exceeding 50 percent from amount of anhydrous ethyl alcohol in end product sustained in contact with oak wood at least six months;
4) fermentative mix - the mix of cuvee, reservoir liqueur and distributing of pure culture yeast intended for carrying out afterfermentation by tank method;
4. 1) wine distillate - the wine-making products with volume fraction of ethyl alcohol less than 86 percent made by distillation (distillation) of wine;
4. 2) wine spirit - the wine-making products with volume fraction of ethyl alcohol at least 86 percent made by distillation (distillation) of wine or wine distillate;
5) wine vinegar - vinegar which is received only as a result of acetic fermentation of wine and has the total acidity at least 60 grams on liter given to acetic acid;
6) wine - the food alcoholic agricultural wine-making products made only as a result of complete or incomplete fermentation of the whole or crushed fresh grapes or fresh grape must and resolved to retail sale in the territory of the Russian Federation in case of volume fraction of content of ethyl alcohol from 7,5 up to 18 percent;
7) wine in bulk, fortified wine in bulk (wine material) - wine, fortified wine before pouring in interior package for retail sale;
8) wine of Russia - wine, fortified wine, sparkling wine, completely (for 100 percent) made from the grapes which are grown up in the territory of the Russian Federation;
8. 1) the grapes which are grown up in the territory of the Russian Federation - fruits of the grape plantings located in borders of the territory of the Russian Federation on the date of entry into force of this Federal Law;
9) vinogradarsky farms - the organizations irrespective of form of business, including experienced and production farms of the scientific organizations, agricultural consumer cooperatives and peasant farms created as the legal entity, and also peasant farms created without formation of legal entity, the individual entrepreneurs and citizens conducting personal subsidiary farm, performing wine growing who in property, lease or on other legal cause have vinogradarsky company or its part;
10) the vinogradarsko-wine-making company - the property complex including completely vinogradarsky and wine-making companies or their parts;
11) the vinogradarsky company - the property complex irrespective of pattern of ownership used for bookmark and operation of grape plantings, cultivation of planting stock of grape plants, conversion and storage of products of wine growing, including including the vinogradoprigodny lands, grape plantings, vineyards, machines, the equipment and stock used for bookmark and operation of grape plantings, conversions and storages of products of wine growing, the building and construction intended for placement of machines and the equipment, the building and construction, acting as the place of stay (or the containing rooms being the place of stay) the physical persons performing activities based on employment contracts and (or) agreements of civil nature, and also the right to the designations individualizing the company, its products, works and services;
12) wine growing - the crop production industry which is engaged in cultivation of grapes;
12. 1) grape vodka - wine-making products with volume fraction of ethyl alcohol is at least percent 37,5 made of wine or grape distillate with addition or without addition of wine or grape spirit and having taste and aroma of the used raw materials;
13) vineyard - the difficult thing consisting of lands or the parcels of land (parts of the parcels of land) of agricultural purpose or being as a part of zones of agricultural use in settlements with the grape plantings located on them;
14) grape must - the agricultural wine-making products received only from fresh grapes spontaneously or with use of physical acceptances of crushing, destalking, running off, pressing, intended owing to content in it potential volume fraction of ethyl alcohol for production of winemaking and not permitted to retail sale in the territory of the Russian Federation, the volume fraction of content of ethyl alcohol in which does not exceed one percent (grape must types: is fresher, the concentrated, preserved and concentrated rectified);
15) grape plantings - the artificial (cultural) plantings of plants of the sort Vitis, including the grades received by crossing of grades of Vitis Vinifera with grades of other types of the sort Vitis cultivated for the purpose of receipt of grape berries, planting stock of grape plants or scientific studying;
15. 1) grape distillate - the wine-making products with volume fraction of ethyl alcohol less than 86 percent made by distillation (distillation) of the fermented grape pomace, yeast and gushchevy deposits, diffusion juice;
16) grape juice - the product which is received from fresh grapes or fresh grape must is subject to the processing allowing to use it as foodstuff, and the admissible volume fraction of ethyl alcohol in which shall not exceed percent 0,5;
16. 1) grape spirit - the wine-making products with volume fraction of ethyl alcohol at least 86 percent made by distillation (distillation) of the fermented grape pomace, yeast and gushchevy deposits, diffusion juice or grape distillate;
17) vinogrado-wine-making zone - the part of the territory of the Russian Federation having rather identical geophysical, climatic and soil characteristics causing similarity of high-quality structure of grape plantings and processing methods of wine growing and winemaking;
18) vinogrado-wine producing region - the territory as a part of vinogrado-wine-making zone having the special geophysical, climatic and soil characteristics causing product receipt of wine growing and (or) products of winemaking of certain quality;
19) vinogrado-wine-making terroir - the limited territory as a part of vinogrado-wine producing region which covers the grape plantings of certain grades which are in certain geophysical, climatic and soil conditions and in which borders application of certain processing methods of wine growing and winemaking determines special organoleptic characteristics of wine-making products;
20) vinogradoprigodny lands - lands or the parcels of land which geographical and edaphic-climatic characteristics give opportunity for their use for the purpose of cultivation of grape plantings, including lands or the parcels of land which were used for the specified purpose at least five years within the last fifty years;
21) vinogradosoderzhashchy drinks from grape raw materials - food alcoholic wine-making products which are made for 50 percent at least from wine, fortified wine, grape must with use of sucrose, color and flavoring additives, other food supplements and products, including water, the natural volume fraction of ethyl alcohol in which is in the range from 1,5 to percent 14,5;
22) vinogradosoderzhashchy drink - carbonated vinogradosoderzhashchy drinks, vinogradosoderzhashchy drinks from grape raw materials and the flavored vinogradosoderzhashchy drinks from grape raw materials;
23) winemaking - type of activity on production of winemaking;
24) wine-making products - wine, fortified wine, sparkling wine, grape must, vinogradosoderzhashchy drinks, cognac distillate, wine and grape distillates and alcohols and alcoholic drinks made from them;
25) wine-making farms - the organizations of any form of business, including the scientific organizations performing the experienced productive activity, agricultural consumer cooperatives and peasant farms created as the legal entity, performing winemaking or wine growing and winemaking which in property, lease or on other legal cause have wine-making company and the vinogradarsky company or only the wine-making company, and also the peasant farms created without formation of legal entity and the individual entrepreneurs performing production of wine-making products in the procedure established by the legislation of the Russian Federation from the grapes which are grown up on the vineyards belonging to them on the property right, leases or on other legal cause;
26) the wine-making company - the property complex (both registered, and not registered in general as real estate object in the Unified State Register of Rights on real estate) irrespective of pattern of ownership, used for production processes and conversion of products of winemaking, one or several of the specified processes and (or) their parts, including including the machines, the equipment and stock used for the specified purposes, the buildings and constructions intended for placement of such machines and the equipment and exclusive rights at the expense of individualization of the company, its products, works and services;
27) ceased to be valid

29) secondary products of winemaking - by-products of production of wine-making products, including pressing grape, grain stillage wine, grain stillage barmy, diffusion juice, picket, wine stone, must pectineal, yeast deposits, wine gushchevy rainfall;
30) secondary winemaking - implementation of technology transactions of production of wine-making products at stages of stabilization, endurance, preparation for pouring and pouring;
