About procedure and delivery conditions of fruit and vegetable products from stabilization funds of goods for republican state needs

Based on Article 495 of the Civil code of the Republic of Belarus, subitem 1.7 of Item 1 of article 6 of the Law of the Republic of Belarus of January 8, 2014 No. 128-Z "About state regulation of trade and public catering", paragraph two of Item 2 of the Presidential decree of the Republic of Belarus of June 13, 2023 "About taking measures in the field of pricing" and item 4 of the Presidential decree of the Republic of Belarus of June 11, 2025 No. 232 "About features of delivery of fruit and vegetable products for republican state needs" and for the purpose of ensuring food security of the republic the Council of Ministers of the Republic of Belarus DECIDES: No. 171

1. Determine that:

1.1. means of the loans granted according to Item 1 of the Presidential decree of the Republic of Belarus of June 11, 2025 to No. 232 (further – the credits), are enlisted on supplier accounts *, have purpose and go for accomplishment of obligations of the supplier under the delivery agreement of fruit and vegetable products from stabilization funds of goods for republican state needs (further – the delivery agreement);

1.2. regional executive committees and the Minsk Gorispolkom annually in off-season * provide forming in the territory of the corresponding administrative and territorial units of stabilization funds of goods for the purpose of delivery to suppliers ** fruit and vegetable products * for republican state needs (further – the state order) also control accomplishment of the state order;

1.3. The ministry of anti-monopoly regulation and trade (further – MART), regional executive committees and the Minsk Gorispolkom are the state customers of the state order;

1.4. retail prices on the fruit and vegetable products sold by retail chain stores, which arrived to suppliers as accomplishment of the state order are regulated by MART;

1.5. selling prices on the fruit and vegetable products sold by producers to legal entities for the purpose of accomplishment of the state order by them are regulated by the Ministry of Agriculture and Food (further – Ministry of Agriculture and Food Production) in coordination with MART.

2. Establish amounts of the fruit and vegetable products delivered from stabilization funds of goods for republican state needs on off-season of 2025/2026 on areas and Minsk according to appendix.

3. The fruit and vegetable products delivered within the state order shall conform to requirements:

Item 1.1 of Section 1 state standard specification 1722-85 "The fresh table beet made and delivered. Specifications";

Items 1.2 and 1.3 of Section 1 state standard specification 1724-85 "The fresh white cabbage made and delivered. Specifications";

Items 5.2 and 5.3 of Section 5 state standard specification 32284-2013 (UNECE STANDARD FFV-10:2010) "Carrots the dining room fresh, implementable in retail retail chain stores. Specifications";

Items 5.2 and 5.4 of Section 5 state standard specification 34306-2017 "Onion fresh. Specifications";

Items 4.2 and 4.4 of Section 4 state standard specification 7176-2017 "Food potato. Specifications";

Items 5.2 and 5.3 of Section 5 state standard specification 34314-2017 "Apples fresh, implementable in retail trade. Specifications".

4. MARCH:

4.1. annually till February 15 to send to Ministry of Agriculture and Food Production, regional executive committees and the Minsk Gorispolkom information on the required amounts of the state order (including on areas and Minsk) calculated:

for the state-financed organizations performing acquisition of fruit and vegetable products for catering services, other organizations performing power supply of patients and pupils in healthcare institutions and educations respectively based on this about the average amounts of the fruit and vegetable products acquired by them for the previous three years provided by regional executive committees and the Minsk Gorispolkom;

for retail chain stores, based on this about the average sales amounts for the last three years provided by regional executive committees and the Minsk Gorispolkom;

4.2. annually till October 1 to establish retail prices on the fruit and vegetable products sold by retail chain stores, which arrived to suppliers as accomplishment of the state order.

Ministry of Agriculture and Food Production in coordination with MART performs price regulation on the fruit and vegetable products delivered to suppliers as accomplishment of the state order, and selling prices on the fruit and vegetable products sold by producers to legal entities for the purpose of accomplishment of the state order till September 30, 2025 and further annually till March 20.

Annually till September 20 the price adjustment, specified in part two of this subitem, taking into account the created conditions of receipt of harvest of fruit and vegetable products is allowed.

In case of change in value of the fruit and vegetable products specified in the delivery agreement in view of price adjustment according to part three of this subitem the amount of originally granted loan is not subject to adjustment. Compensation of the losses to banks connected with loan granting is performed based on data on the amounts of the added interest for using the credits and subjects of compensation of the losses expected based on the cost of the fruit and vegetable products specified in the delivery agreement date of its conclusion according to part one of subitem 5.5 of Item 5 of this resolution.

The means of the credits provided for advance payment (advance payments) under delivery agreements on fruit and vegetable products according to part three of this subitem are recognized used for purpose price adjustment cases.

5. To regional executive committees and Minsk Gorispolkom:

5.1. annually till February 5 to represent to MART data on the need for fruit and vegetable products according to subitem 4.1 of item 4 of this resolution;
