1. Approve the enclosed Rules of issue of the conclusion about object compliance to requirements of fire safety.

2. To provide to committee of fire service of the Ministry of Emergency Situations of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Emergency Situations of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Emergency Situations of the Republic of Kazakhstan.

4. This order becomes effective since February 1, 2026 and is subject to official publication.

Rules of issue of the conclusion about object compliance to requirements of fire safety

Chapter 1. General provisions

1. These rules of rendering the state service "Issue of the Conclusion about Object Compliance to Requirements of Fire Safety" (further – Rules) are developed according to the subitem 90) of Item 1 of article 12 of the Law of the Republic of Kazakhstan "About civil protection" and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" and determine procedure for issue of the conclusion about object compliance to requirements of fire safety.

2. Issue of the conclusion about object compliance to requirements of fire safety is performed by Departments on emergency situations of areas, cities of republican value, the capital of the Ministry of Emergency Situations of the Republic of Kazakhstan (further – the service provider).

Chapter 2. Procedure for rendering the state service

3. For receipt of the conclusion about object compliance to requirements of fire safety (further – the Conclusion) the customer (further – uslugopoluchatel) submits to the service provider the application for issue of the conclusion about object compliance to requirements of fire safety in electronic form, according to appendix 1 to these rules through the web portal of "the electronic government" in information system "The state E-licensing database (further – the Portal).

The list of the main requirements to rendering the state service including characteristics of process, form, content and result of rendering, and also other data taking into account features of provision of the state service are stated in annex 2 to these rules.

In "personal account" to uslugopoluchatel information on the status of consideration of the application goes for rendering the state service, and also the notification with indication of date and time of receipt of result of the state service.

After filing of application on rendering the state service the employee of office of the service provider performs registration of a statement in the Portal, the uslugopoluchatel receives the notification on documents acceptance, the head of the service provider determines the contractor of the statement. In case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the labor law, reception of applications and issue of results of rendering the state service is performed the next working afternoon.

4. The contractor of the service provider within two working days from the moment of receipt of documents checks completeness of the submitted documents.

In case of representation uslugopoluchately incomplete document package and (or) documents with the expired effective period the contractor of the service provider in the specified terms prepares motivated refusal in further review of the application in electronic form signed by the digital signature (further – the EDS) the head of the service provider, and sends to uslugopoluchatel to personal account.

In case of provision by uslugopoluchatel of complete document package for receipt of the Conclusion the contractor of the service provider performs fire and technical inspection of the constructed object.

In case of the positive decision on issue of the Conclusion the service provider creates the electronic form of the Conclusion approved by the order of the acting minister on emergency situations of the Republic of Kazakhstan of August 6, 2025 No. 309 (it is registered in the Register of state registration of regulatory legal acts No. 36593).

In case of decision about refusal in rendering the state service, the service provider within one working day notifies uslugopoluchatel on the provisional solution about refusal for provision of opportunity to express to uslugopoluchatel line item according to the provisional solution in rendering the state service, and also time and the place (method) of carrying out hearing.

The notification on hearing goes at least in three working days prior to completion of term of rendering the state service. Hearing is carried out no later than two working days from the date of the notification.

By results of hearing the service provider issues permission or the motivated answer about refusal in rendering the state service.

The head of the service provider within one working day signs electronic result and performs its issue by means of the Portal.
