About provision of information on incidents and violations of safety in the sphere of information security

Based on paragraphs of the second or fourth, sixth of part one of Item 2 of the Presidential decree of the Republic of Belarus of August 29, 2023 No. 269 "About measures for counteraction to unauthorized payment transactions", subitem 3.11 of Item 3 of article 4 of the Law of the Republic of Belarus of April 19, 2022 "About payment systems and payment services" and parts one of article 39 of the Bank code of the Republic of Belarus the Board of National Bank of the Republic of Belarus DECIDES: No. 164-Z

1. Determine that:

1.1. collection, obtaining, systematization, accumulating, storage, change, depersonalization, blocking, use, transfer, provision, distribution, removal, other information processing about unauthorized payment transactions and attempts of their making (further - incidents) including the data which are bank secrecy, and personal data are performed by means of the automated system of processing of incidents of National Bank (further - ASOI) with observance of requirements of the legislation on information, informatization and information security, including about personal data;

1.2. types of incidents and the list of information on them are specified in the information technology developed by National Bank containing structure, form and formats of information interaction (further - information technology) posted in ASOI in the section "Reference information";

1.3. the payment service providers rendering the payment services specified in paragraphs the second or ninth article 9 of the Law of the Republic of Belarus "About payment systems and payment services" provide in electronic form in National Bank by means of ASOI information on incidents within one hour from the moment of their identification in the mode 24/7 according to information technology to one of the following methods:

private office;

open interfaces of programming of appendices;

1.4. payment service providers provide information on result of consideration of incident obtained by means of ASOI from law enforcement agencies or other payment service providers within one hour from the moment of obtaining in the mode 24/7 with further provision of information on them in ASOI;

1.5. The National Bank provides information on incidents from ASOI four times a day according to information technology to the payment service providers rendering settlement services, payment initiation services, payment services in transactions with electronic money, processing services for counteraction to unauthorized payment transactions;

1.6. the payment service providers rendering the payment services specified in article 9 of the Law of the Republic of Belarus "About payment systems and payment services" provide in electronic form in National Bank by means of ASOI information on violations of safety in the sphere of information security within one hour from the moment of their identification in the mode 24/7.

Types of violations of safety in the sphere of information security and the list of information on them are specified in information technology;

1.7. for provision of access to ASOI payment service providers submit to National Bank the request for connection to ASOI in form according to appendix directed by the letter on paper or in the form of the electronic document through system of interdepartmental electronic document management of state bodies.

In case of need changes or removals of the data provided by the payment service provider in case of connection to ASOI payment service providers report in National Bank about such changes by the letter.

2. Declare invalid the resolution of Board of National Bank of the Republic of Belarus of August 26, 2022 No. 316 "About submission of information on incidents".

3. This resolution becomes effective since March 1, 2024.
