Based on part (7) article 9 of the Law No. 68/2013 on seeds (The official monitor of the Republic of Moldova, 2013, Art. No. 130-134, 417), with subsequent changes, DECIDES: the Government

1. Approve:

1.1. Requirements to production, conversion and realization of seeds of fodder plants according to appendix No. 1;

1.2. Requirements to production, conversion and realization of seeds of fodder beet and sugar beet according to appendix No. 2.

2. To impose control over the implementation of this resolution on the National agency on safety of foodstuff.

3. Declare invalid the Order of the Government No. 836/2011 about approval of Quality requirements and trade in seeds of fodder plants (The official monitor of the Republic of Moldova, 2011, Art. No. 197-202, 917), with subsequent changes.

4. This resolution becomes effective after 6 months from the date of publication in the Official monitor of the Republic of Moldova.

Appendix No. 1

Requirements to production, conversion and realization of seeds of fodder plants

These Requirements:

- partially shift the Directive 66/401/EEC of Council of June 14, 1966 about business volume of seeds of fodder plants (CELEX: 31966L0401), published in the Official magazine of the European Union by L 125 of July 11, 1966, last time changed by the Implementation directive (EU) to 2021/971 Commission of June 16, 2021;

- shift the Directive 2008/124/EU of the Commission of December 18, 2008 limiting sale of seeds of some types of fodder plants, and also oil and textile plants with the seeds officially certified as basic seeds or the certified seeds (CELEX: 32008L0124), published in the Official magazine of the European Union by L 340 of December 19, 2008;

- 2004/371/EU Commissions of April 20, 2004 about conditions of entry into the market of seed mixtures, held for use as fodder plants shift the Decision (CELEX: 32004D0371), published in the Official magazine of the European Union by L 116 of April 22, 2004.

Chapter I. General provisions

1. Requirements to production, conversion and realization of seeds of fodder plants (further - Requirements) are applied to the seeds of fodder plants specified in appendix No. 1 (further - seeds), and shall be observed in case of production and/or realization of seeds of fodder plants.

2. In the context of these Requirements "realization" means sale, storage with sales objective, the offer for sale and any kind of concession, delivery or transfer for the purpose of commercial use of seeds for a fee or gratuitously.

3. The exchange of seeds which is not aiming at commercial use of grades is not considered realization, such transactions include:

3.1. delivery of seeds to the official organs performing testing and inspections;

3.2. delivery under certain conditions seeds to service providers for the purpose of their transformation or packaging if the service provider has no right to the seeds delivered thus.

4. Delivery on special conditions of seeds to service providers for production of agricultural raw materials in the industrial purposes or for reproduction of seeds for the purposes of conversion is not considered realization if the service provider has no right to the seeds delivered thus or to the received harvest. The supplier of seeds provides to competent authority the copy of the corresponding parts of the agreement signed with the service provider who contains urgent regulations and conditions to which there shall correspond deliverable seeds.

5. Mandatory requirements are not applied to the seeds made in the unregistered individual farms, and also to seeds in transit or temporarily stored in quality of transit products if they do not constitute health hazard of the person and the environment.

6. In the context of these Requirements the following concepts are applied:

6.1. fodder plants - group of the annual and perennial plants with high nutritional value used for feeding of the animals specified in appendix No. 1;

6.2. basic seeds - it is used in the value provided in the Law No. 68/2013 on seeds and also means:

6.2.1. seeds of the selected grades - seeds, which:

6.2.1.1. were made under the direction of sokhranitel according to rules of conservative selection of grades;

6.2.1.2. are intended for production of seeds of category "the certified seeds";

6.2.1.3. with accounting of provisions of Item 29, conform to requirements to the basic seeds provided in appendices No. 2 and 3;

6.2.1.4. conform by results of check to the requirements specified in appendix No. 3;

6.2.2. seeds of local grades - seeds, which:

6.2.2.1. were made under official supervision from the materials officially recognized as local grades in one or several farms which are in accurately designated region of origin;

6.2.2.2. are intended for production of seeds of category "the certified seeds";

6.2.2.3. with accounting of provisions of Item 29, conform to requirements to the basic seeds provided in appendices No. 2 and 3;
