1. Approve Quality requirements and to trade in seeds of fodder plants (are applied).
2. This Resolution becomes effective after 6 months from the date of publication in the Official monitor of the Republic of Moldova.
3. To impose control of execution of this Resolution on the National agency on safety of foodstuff.

Quality requirements and trade in seeds of fodder plants create necessary base for application of the Directive of Council No. 401 of June 14, 1966 about the trade in seeds of fodder plants published in the Official magazine of the European Community (IO, 125, on July 11, 1966, page 2298-2308), with the last changes made by the Directive 2009/74/SE of the Commission of June 26, 2009 about modification of Directives 66/401/CEE, 66/402/CEE, 2002/55/CE and 2002/57/SE of Council on botanical names of plants, scientific names of other organisms, and also rather some appendices to directives 66/401/CEE, 66/402/CEE and 2002/57/CE as a result of scientific and technical progress published in the Official Magazine European Community (IO, L, 166, on June 27, 2009, page 40-70), and also applications of the Directive 2002/54/SE of Council of June 13, 2002 about trade in seeds of the beet published in the Official magazine of the European Community (IO L, 193, on July 20, 2002, page 12-32), with the last changes made by the Directive 2004/117/SE of Council of December 22, 2004 about modification of Directives 66/401/CEE, 66/402/CEE, 2002/54/CE, 2002/55/CE and 2002/57/CE on the researches conducted under official supervision and the equivalence of the seeds made in the third countries, published in the Official magazine of the European Community (IO L, 14, on January 18, 2005, page 18-33).
1. Quality requirements and trade in seeds of fodder plants (further - Requirements) are applied to the seeds of fodder plants specified in appendix No. 1 to these Requirements (further - seeds) which shall be observed in case of production and/or trade in seeds of fodder plants.
2. The ordered mandatory requirements do not belong to the seeds made in not authorized individual farms and also to the seeds which are in transit or temporarily stored as transit if do not constitute health hazard of the person and the environment.
3. In these Requirements the used terms have the following values:
1) fodder plants - group of the one-year and perennial plants of high nutritional value which are grown up on forage by animal, listed in appendix No. 1;
2) seeds of elite are:
a) seeds of selection grades:
which were made under responsibility of sokhranitel according to production regulations from the point of view of grade;
which are intended for production of seeds from category "The Certified Seeds";
which correspond to the conditions for elite seeds provided in appendices No. 2 and 3 to these Requirements;
for which it was determined owing to examination that correspond to above-mentioned conditions;
b) seeds from local grades:
which were made under official control, since the materials allowed as local grades at one or several companies which are in accurately divided region of origin;
which are intended for production of seeds from category "The Certified Seeds";
which observe, on condition of requirements of Item 19, the conditions for elite seeds established in appendices No. 3 and 4 to these Requirements;
for which it was established owing to examination in case of the conditions determined in appendix No. 3, that they correspond to the conditions provided in this subitem;
3) the Certified seeds:
a) these are seeds of all grades listed in appendix No. 1 to these Requirements except Lupinus spp., Pisum sativum, Vicia spp., and also Medicago sativa:
which are intended for production of seeds Beta vulgaris L;
which directly come from seeds of elite or at the request of the selector of the seeds belonging to the previous generation of seeds of elite which owing to official research satisfy the conditions established in appendices No. 1 and 2 to these Requirements for elite seeds;
which are intended for other purposes, than production of seeds;
which observe, on condition of requirements of the subitem 2) of Item 16, the conditions established in appendices No. 2 and 3, - for the certified seeds;
for which it was determined owing to official research that they correspond to the conditions established in this subitem;
b) seeds from the first generation (Lupinus spp., Pisum sativum, Vicia spp., and also Medicago sativa):
which come directly from seeds of elite or at the request of the selector of the seeds belonging to the previous generation of seeds of elite which can satisfy and satisfied the conditions established in appendices No. 2 and 3 to these Requirements for elite seeds owing to official research;
which are intended for production of seeds from category "the certified seeds from the second generation" or for other purposes, than production of seeds of fodder plants;
which observe, on condition of requirements of the subitem 2) of Item 16, the conditions established in appendices No. 2 and 3 to these Requirements - for the certified seeds;
for which it was determined owing to official research that correspond to the conditions established in this subitem;
c) seeds from the second generation (Lupinus spp., Pisum sativum, Vicia spp., and also Medicago sativa):
which come directly from elite seeds, from the certified seeds of the first generation or, at the request of the selector, from the seeds belonging to the previous generation of seeds of elite which can satisfy and satisfied owing to official research the conditions established in appendices No. 2 and 3 to these Requirements - for elite seeds;
which are intended for other purposes, than production of seeds of fodder plants;
which satisfy the conditions established in appendices No. 2 and 3 to these Requirements - for the certified seeds;
for which it was determined owing to official research that correspond to the conditions established in this subitem.
4) Commercial seeds - seeds:
a) which keep identity of type;
b) which satisfy the conditions for commercial seeds established in appendix No. 2 to these Requirements;
c) for which it was determined owing to official research that correspond to the conditions established in this subitem;
5) odnorostkovy seeds - seeds odnorostkovy Beta vulgaris L., which from the genetic point of view make only one sprout and conform to requirements of Item 32 of appendix No. 3 to these Requirements;
6) exact seeds - seeds of Beta vulgaris L., which from the genetic point of view make only one sprout and 33 appendices No. 3, and also to the subitem 15 of Item 1 of appendix No. 5 to these Requirements conform to requirements of table 1 and Item;
a) the packagings containing mix of seeds which are not held for use as fodder plants, with net weight to 2 kg except for, if necessary, of the granulated pesticides, substances for covering or other solid additives;
b) packagings, acinaceous elite, the certified seeds, or in that degree when this is not about the packaging containing mix of seeds with net weight to 10 kg, except for, if necessary, the granulated pesticides, substances for covering or other solid additives;
c) packagings with the odnorostkovy seeds containing in total 100 000 clusters or seeds, or with kg 2,5 net weight, the pesticides except for granulated, substances for covering or other solid additives.
d) the packagings containing other seeds, than odnorostkovy seeds with net weight of 10 kg except for of the granulated pesticides, substances for covering or other solid additives.
4. For determination of biological purity of grades and hybrids of fodder plants inspection in the field is performed.
5. Inspection to the field or approval of seed sites it is obligatory and it is carried out aprobatorami / the inspectors appointed by annually central public body in the field of agricultural industry. Further the appointed inspectors will sign the declaration on own responsibility, or the commitment letter on responsibility, impartiality and objectivity of observance of the regulations regulating official researches.
6. Persons appointed to position of inspectors shall meet the following requirements:
1) to have necessary technical qualification (the document confirming participation of specialists in training in the specialty);
2) not to receive any personal benefits by conducting inspections;
3) to perform inspections according to the existing rules applied by inspections.
7. Inspections are in the field carried out in the following conditions:
1) inspection in the field is performed, at least, in case the condition and stage of cultural development allow to conduct satisfactory research;
2) the size, quantity and distribution of the main checkpoints which shall be checked for research of procedure for observance of the requirements established in appendix No. 2 to these Requirements are determined according to seed schemes of Organization for Economic Cooperation and Development (further - OECD);
3) it is performed in case of observance of isolation in space from other cultures, and also crop rotation.
8. Depending on results of the researches performed in the field on this culture the decision is passed:
1) "Is approved" - if the seed culture answers the conditions established in these Requirements with issue of the document on the inspection which is carried out to the field;
2) "Is rejected" - if the seed culture does not answer one or several conditions provided in these Requirements with the written notice of the economic agent.
9. For check of grades the research of certified and commercial seeds is obligatory and is performed by specialists when sampling seeds which were resolved by the central public body in the field of agricultural industry.
10. Specialists when sampling shall correspond to the following conditions:
1) to have necessary technical qualification;
2) to be impartial physical persons;
3) to be persons hired by physical persons or legal entities which activities provide or is not connected with production, cultivation, testing or trade of seeds;
11. The specialist in selection of seeds whose activities provide production, cultivation, testing or trade in seeds can carry out sampling only from batches of the seeds made on behalf of the employer excepting case when other is provided by agreement with the employer, the applicant about certification and the central public body in the field of agricultural industry.
12. Activities of specialists in selection of seeds are subject to control from the central public body in the field of agricultural industry.
In case of automatic sampling it is necessary to apply the corresponding procedures which are subject of official supervision.
13. The percent of tests from batches of the seeds collected from crops is selected for post-control and, if necessary, for laboratory testing of identity and purity of grade of seeds.
14. Testing of seeds is performed by the authorized/accredited laboratories of the center of testing which activities are subject to official supervision based on the Law on seeds No. 68 of April 5, 2013.
