The parliament adopts this organic law.
This law partially (Article 4) shifts the Decision of Council 2005/834/EC of November 8, 2005 about equivalence of checks of conservative selection of the grades implemented in some third countries and about modification of the Decision 2003/17/EC published in the Official magazine of the European Union by L 312 of November 29, 2005 with the last changes made by the Decision (EU) 2021/537 European parliament and Council of March 24, 2021.
(1) This law determines the legal basis of production, processing, control and certification of quality, and also realization of seeds of plants and planting stock.
(2) This law does not extend to production of seeds in individual farms for the purpose of use for private consumption provided that they will not intend for realization.
(3) For the purpose of this law the concept "seeds" joins also planting stock.
(4) In the part which is not settled by this law, procedure for request, provision, suspension and withdrawal of allowing documents concerning production, processings, certifications of quality and realization of seeds of the plants and planting stock provided by this law for business entities it is determined by the Law on regulation of business activity by permission No. 160/2011.
(1) For the purpose of this law the following basic concepts are determined:
originator – the legal entity or physical person which created or revealed and enhanced grade;
the certificate on the analysis – the document issued by the authorized/accredited laboratory, confirming quality of the seeds tested by means of the standardized methods;
high-quality qualities of seeds – set of the biological characters characterizing belonging of seeds to certain grade;
sowing qualities of seeds – set of the qualitative indexes characterizing suitability of seeds;
The catalog of plant varieties – the catalog in which the plant varieties permitted for production and realization in the Republic of Moldova are brought;
the quality certificate – the document confirming quality of seeds, issued by the National agency on safety of foodstuff;
the quality certificate for import – the document confirming compliance of quality of the imported seeds to the existing requirements and regulations for quality, issued by the National agency on safety of foodstuff;
realization – sale, storage with sales objective, the offer on sale and any kind of concession, delivery or transfer of seeds to the third party for the purpose of commercial use;
conditioning of seeds – transaction by means of which seeds are led up to certain regulations concerning humidity, purity and quality;
the agreement on reproduction – the production agreement of seeds signed according to the law between originator of grade or its representative and business entity;
seed control – set of the measures and actions connected with monitoring and control of production process of seeds, and also with their processing, certification and realization;
the declaration on reproduction – the declaration of the business entity registered for implementation of production of seeds, addressed to the National agency on safety of foodstuff for the purpose of assumption of the culture intended for reproduction to field inspection;
batch of seeds – certain quantity of seeds of one grade, homogeneous by origin which qualities are certified by the quality certificate;
planting stock – the material received as a result of generative or vegetative propagation, including the seeds, stones and bulbs used as biological material for reproduction of plants, and also parts of plants or the whole plants with roots used as planting stock;
sokhranitel – the physical person or legal entity specified in the Catalogue of plant varieties as grade, responsible for preserving, with the signs characteristic of this grade at the time of its inclusion in this Catalogue. The originator of grade or person to whom the originator granted grade right of retention by means of making of legal transaction can be Sokhranitel;
plant – crops (grain, leguminous, oily, technical and fodder) and gardening cultures (vegetable, fruit, grapes, decorative, essential oil-bearing and medicinal);
processing of seeds – the activities covering at least one of the following transactions: conditioning, including pre-treatment, drying, cleaning, sorting, packing, if necessary etchback, forming of batches, packaging, labeling, and also additional transactions, such as warehousing, storage and transportation of seeds;
