About Regulations on procedure for passing of military service

1. Approve Regulations on procedure for passing of military service it (is applied).

2. To the Ministry of Defence of the Republic of Tajikistan and other ministries and departments in which the legislation provides passing of military service to provide execution of requirements of this provision.

3. Declare invalid the order of the Government of the Republic of Tajikistan of June 11, 2001 No. 257 "About approval of the Regulations on procedure for passing of military service".

Regulations on procedure for passing of military service

1. General provisions

1. The regulations on procedure for passing of military service (further - the Provision) regulate questions of procedure for service, receipt, appointment, transfer, release and dismissal from military service, and also the list of the military personnel and military ranks, procedure for assignment of military ranks, terms of military service in military rank, deprivations, equivalence, recovery and decrease in military ranks, carrying out certifications, leave types, exceptions of lists of staff, structure of inventory, features of passing of military service to wartime, accounting treatment for working hours and provision of additional day of rest.

2. The citizens of the Republic of Tajikistan (further - citizens) passing military service in Armed Forces of the Republic of Tajikistan, troops and other military forming are military personnel. Passing of military service is change of certain legal relationship for the period from the beginning of military service and before its termination, regulated by the legislation of the Republic of Tajikistan, the Provision and army regulations.

3. Military personnel passes military service according to the legislation of the Republic of Tajikistan and the Provision in military units and connections of the Ministry to defense of the Republic of Tajikistan, Armed Forces of the Republic of Tajikistan, Committee of homeland security of the Republic of Tajikistan, Committee on emergency situations and civil defense under the Government of the Republic of Tajikistan, Internal Troops of the Ministry of Internal Affairs of the Republic of Tajikistan, Border troops of Committee of homeland security of the Republic of Tajikistan, National guard of the Republic of Tajikistan, Main Directorate of the Penitentiary of the Ministry of Justice of the Republic of Tajikistan, Agency on providing with special property under the Government of the Republic of Tajikistan, public vessels, bodies of military prosecutor's office and other military structures created according to the Law of the Republic of Tajikistan "About defense" (further - other state bodies, in which the legislation provides military service).

1) soldiers, sergeants;

2) ensigns, officers;

3) female military personnel;

4) cadets of the public military educational institutions of higher education.

5. The rights, obligations and responsibility of the military personnel, and also concept of execution of military service are determined by the laws of the Republic of Tajikistan "About conscription and military service", "About the status of the military personnel", "About veterans", army regulations, the Provision and other regulatory legal acts of the Republic of Tajikistan.

6. Content of passing of military service is constituted by the following legal relationship:

1) appointment to military position, transition on service and transfer in other structures for continuation of military service;

2) assignment, lowering, recovery and deprivation of military rank;

3) training and professional training;

4) fulfillment of duties of military service and determination of time of rest;

5) carrying out certification;

6) appeal, receipt, dismissal and recovery on military service;

7) passing of military service in inventory;

8) passing of military service in case of mobilization and in wartime.

7. The military personnel of the State committee of homeland security of the Republic of Tajikistan, judges and the staff of military courts, Military board of the Supreme Court of the Republic of Tajikistan and bodies of military prosecutor's office pass military service according to the legislation of the Republic of Tajikistan regulating activities of these bodies and the Provision.

2. Terms, duration, beginning and termination of military service

8. According to article 43 of the Law of the Republic of Tajikistan "About conscription and military service" terms of military service are established in the following procedure:

1) conscription military obligatory service on positions of soldiers and sergeants - 24 months and having higher education – 12 months;

2) soldiers with higher education and the ended military departments under public institutions of professional education according to the program of training of reserve officers and the passings of military service having desire on officer positions, – after 3 months of obligatory conscription model military service, in case of voluntary position assignment with assignment of officer military rank "second lieutenant" – 24 months;

3) the soldiers with higher education having desire of passing of military service on the ensign's positions – after 3 months of obligatory conscription model military service, in case of voluntary position assignment with assignment of military rank "ensign" – 3 years;

7) the officers who graduated from the state military educational institutions of higher education - 10 years;

8) the officers who graduated from the state military educational institutions of secondary professional education according to the program of three years' education - 7 years;

9) the officers who graduated from educational institutions of bodies of homeland security of the Republic of Tajikistan or based on the direction of this body the ended educational institutions of safety or special services of foreign states, - at least 15 years;

10) the military personnel passing military service in voluntary procedure in bodies of homeland security of the Republic of Tajikistan on positions of sergeant structure - 3 years;

11) the officers who enlisted from structure of inventory in voluntary procedure - at least 5 years.

9. Terms of military service the serviceman passing military service in voluntary procedure at their own desire can be extended over the provided terms by this Item with observance of requirements of Item 26 of the Provision according to the procedure, established by heads of other state bodies in whom the legislation provides military service.

10. For the military personnel passing in voluntary procedure military service in mountain conditions and areas with adverse climatic and ecological conditions the following reduced terms of passing of military service are established:

1) in mountain areas at the height over 1500 up to 2500 meters above sea level - 4 years;

2) in areas with adverse climatic and ecological conditions - 3 years;

3) in mountain areas at the height over 2500 meters above sea level - 2 years.

11. Tasks in the conditions of emergency state and in case of armed conflicts in mountain areas and areas with adverse climatic and ecological conditions are determined by the Minister of Defence of the Republic of Tajikistan, heads of other state bodies in whom the legislation provides military service.

12. The military personnel at will and according to the written official report can continue military service over the established term duration in this area in specified the Item 11 Provision by the order of the Minister of Defence of the Republic of Tajikistan, heads of other state bodies in whom the legislation provides military service.

13. And diplomatic representatives abroad duration of term of stay is established by the serviceman passing military service outside the Republic of Tajikistan as representatives of the Ministry of Defence of the Republic of Tajikistan to the international organizations once no more than 3 years. Terms of passing of military service for other military personnel outside the Republic of Tajikistan are established by the legislation of the Republic of Tajikistan.

15. The term of military service is estimated from the date of the beginning of military service. The term of passing of military charges is set off from the date of transfer about day of exception of lists of staff of military unit in the general duration of military service of the citizen.

16. The general duration of military service of the serviceman includes military service and in voluntary procedure, stay on military charges, and also in cases of repeated revenues to military service. Determination of general duration of military service is made in calendar calculation.

17. The general duration of military service in preferential calculation is determined according to the procedure, established by the laws and other regulatory legal acts of the Republic of Tajikistan.

18. By the serviceman undergoing military service, one day of participation in fighting, accomplishment of tasks in the conditions of armed conflicts, or stay with respect thereto in medical institutions owing to wound, contusion, mutilations or diseases it is set off to equal two days of military service.

19. The male cadets deducted from the public military educational institutions of higher education of the ministries and departments in which the military service is provided and also from organizations of professional education of the Ministry of Internal Affairs of the Republic of Tajikistan for indiscipline or poor progress if by the time of assignment they reached age of 18 years, did not serve fixed term of obligatory compulsory military service and have no right to dismissal, to release or draft deferment to military service, go for passing of obligatory compulsory military service. 20. The beginning of military service is set off as follows:

1) for the citizens who are called up for obligatory compulsory military service – in day of arrival in military commissariat for sending to the place of passing of military service;

2) for the citizens who enlisted in voluntary procedure - from the date of their transfer in lists of staff of military unit;

3) for the citizens who are in inventory, arrived on military service - from the date of their transfer in lists of staff of military unit;

4) for the citizens who arrived in the state military educational institutions professionally and secondary education - from the date of transfer in lists of cadets of the state military educational institution of professional education;

5) for the citizens who enlisted in structure of draft mobilization resources - from the date of transfer in lists of staff of military unit.

21. Day of the termination of military service day of exception of the serviceman of lists of staff according to the procedure, established by the Provision is considered.

22. The term of military service of the serviceman who served fixed term of military service can be extended by the order of the commander of military unit up to 2 months in the next exceptional cases:

1) natural disaster response, fires and accidents;

2) participations in combat operations, doctrines, marches, emergency situations and the armed or special transactions;

3) at the request of the serviceman about day of sending the vehicles performing individual or organized transportation of the military personnel transferred to the reserve;

4) delays of arrival of young replenishment for replacement of the specialists military personnel providing combat readiness of military unit.

23. In time military service of the military personnel following provisions are not set off:

1) stay in disciplinary military unit;

2) serving of authority punishment in the form of guardroom;

3) unauthorized leaving of military unit and place of military service or escape;

4) non-arrival to the place of military service at the scheduled time of the instruction;

5) during stay under arrest measure of restraint.

3. Completing, age limit of stay on military service, passings of military service and professional training of the military personnel

24. The citizens who elected military service the profession in voluntary procedure are considered as personnel structure of Armed Forces of the Republic of Tajikistan, other troops and military forming.

25. Other state bodies in which the legislation provides military service in peace time are completed with the following military personnel (citizens):

1) ended highest (average) the state military educational institutions of professional education;

2) called up and arriving for military service according to articles 29 and 38 of the Law of the Republic of Tajikistan "About conscription and military service";

3) the officers and ensigns of inventory having desire to pass military service in voluntary procedure;
