About modification and amendments, and also recognition voided some acts of the President of the Republic of Uzbekistan in connection with enhancement of the sphere of management of state-owned property

For the purpose of ensuring execution of the Law of the Republic of Uzbekistan "About management of state-owned property", resolutions of the President of the Republic of Uzbekistan of March 24, 2023 No. PP-101 "About measures for the effective organization of activities of the Agency on management of the state assets" and No. PP-102 "About additional measures for reducing the state participation in economy", and also simplifications of procedure for privatization and lease of the state assets, including parcels of land, and further increase in share of private property in economy:

1. Make changes and additions to some acts of the President of the Republic of Uzbekistan according to appendix No. 1, providing:

determination of powers of the Chairman of the board of Ministers of the Republic of Karakalpakstan, hokim of areas and the city of Tashkent selling municipal property;

the direction of the parcels of land which arrived from sale in the territories of free economic zones, small industrial, youth industrial and entrepreneurial zones of means in funds of development of infrastructure of entrepreneurship under Council of Ministers of the Republic of Karakalpakstan and khokimiyats of areas and in fund of development of the city of Tashkent;

decrease in the starting price of the state assets, including parcels of land, and provision to investors of additional conveniences when implementing payments;

realization of state-owned property to physical and non-state legal entities, and also implementation of its transfer to lease and trust management by means of the public biddings;

renaming of State commission on holding tenders in case of sale of state-owned property in State commission on privatization of the state assets and coordination of processes of privatization.

2. Recognize invalid some acts of the President of the Republic of Uzbekistan according to appendix No. 2.

3. To impose control of execution of this Decree on the Prime Minister of the Republic of Uzbekistan A. N. Aripov.

Changes and additions made to some acts of the President of the Republic of Uzbekistan

1. In Item 1 of the Presidential decree of the Republic of Uzbekistan of January 17, 2017 No. UP-4933 "About Measures for Further Simplification of Procedures and Acceleration of Realization of Objects of State-owned Property for Use in the Entrepreneurial Purposes":

a) state paragraph two in the following edition:

"To the chairman of the board of Ministers of the Republic of Karakalpakstan, hokima of areas and the city of Tashkent are granted the right to make decisions on sale of municipal property according to the procedure, established in legal acts";

b) the third and fourth to exclude paragraphs;

c) to consider paragraphs of the fifth and sixth respectively paragraphs the third and fourth;

d) in paragraph four of the word "on the organization of effective use of the empty objects" shall be replaced with words "on effective use of objects of state-owned property".

2. In Item 5 of the Presidential decree of the Republic of Uzbekistan of August 1, 2018 No. UP-5495 "About Measures for Cardinal Improvement of the Investment Climate in the Republic of Uzbekistan":

a) state Item 3 in the following edition:

"3. Determine the main objectives of the Agency on management of the state assets:

conducting single state policy as authorized state body on management of the state assets and privatization;

digitalization of processes of accounting, management and privatization of state-owned property and insolvency;

implementation of function of the shareholder (participant) concerning the state share, except as specified, in case of which functions of the shareholder (participant) according to the Law of the Republic of Uzbekistan "About management of state-owned property" are performed by specially authorized state bodies and executive bodies on places;

implementation of modern forms and corporate management methods at the companies with the state participation on the basis of the best foreign practices, cardinal increase in role of the supervisory boards and shareholders in their management;

participation in reforming of economic societies from shares of the state more than 50 percent and the state unitary enterprises, coordination of maintaining in them effective dividend policy, increase in operating efficiency at the companies, increase in efficiency of purchases and investment projects;

coordination of development and approval of the development strategies aimed at providing efficiency and transparency of activities of the companies with the state participation, optimization of management structure, increase in level of high yield and capitalization, conclusion non-core and idle assets;

the organization of transfer of the state blocks of shares (shares) relating to republican property in trust management with providing state interests;

providing the open and transparent mechanism of transfer to lease of the state assets;

attraction of direct foreign investments, and also portfolio investments due to release and implementation of bonds and shares of the companies with the state participation, including placements of issues on IPO/SPO on the domestic and foreign stock exchanges;

consecutive reducing share of the state assets in economy by open and their transparent privatization, simplification of procedures of privatization, conducting monitoring of accomplishment by investors of the assumed investment and social obligations, and also participation in development of offers on public-private partnership;
