About approval of the Procedure for maintaining the register of the existing, blocked and cancelled certificates of public keys which are created by the central certifying body

According to part one of article 7-1 of the Law of Ukraine "About electronic identification and electronic confidential services", Items 4, 8, 10 Regulations on the Ministry of digital transformation of Ukraine, the Cabinet of Ministers of Ukraine approved by the resolution of September 18, 2019 No. 856, and for the purpose of establishment of the organizational, methodological principles of maintaining the register operating, blocked and the cancelled certificates of public keys and ensuring its functioning of PRIKAZYVAYU:

1. Approve the Procedure for maintaining the register of the existing, blocked and cancelled certificates of public keys which are created by the central certifying body which is applied.

2. - state to the DEYSTVIYE company to provide to the administrator of information communications system of the central certifying body implementation, support in current state and the publication on the official website of the central certifying body of the register of the existing, blocked and cancelled certificates of public keys which are created by the central certifying body, with adding electronic seal of the central certifying body in the type suitable for the automated processing.

3. Declare invalid the order of the Ministry of digital transformation of Ukraine of July 29, 2020 No. 112 "About approval of the Procedure for maintaining the register of the existing, blocked and cancelled certificates of public keys", registered in the Ministry of Justice of Ukraine on August 18, 2020 at No. 798/35081.

4. To provide to management of development of digitalization (Haleev A. P.) in the procedure established by the legislation submission of this order on state registration in the Ministry of Justice of Ukraine.

5. This order becomes effective at the same time with entry into force of the Law of Ukraine of December 1, 2022 No. 2801-IX "About modification of some legal acts of Ukraine concerning ensuring agreement signature between Ukraine and the European Union about mutual recognition of qualified electronic confidential services and implementation of the European Union law in the field of electronic identification", but not earlier than day of its official publication.

Procedure for maintaining the register of the existing, blocked and cancelled certificates of public keys which are created by the central certifying body

I. General provisions

1. This Procedure determines the procedure of maintaining the Register of the existing, blocked and cancelled certificates of public keys which are created by the central certifying body (further - the Register) which are created by the central certifying body (further - TsZO), entering into the Register of data on the status of certificates of public keys (further - certificates), about certificate revocation lists of public keys (further - SVS) and providing in the Register of the round-the-clock access through communication networks public.

Action of this procedure does not extend to provision of electronic confidential services according to provisions of paragraph two of part one of article 2 of the Law of Ukraine "About electronic identification and electronic confidential services" (further - the Law).

2. In this Procedure terms are used in the following values:

The administrator the Register-state company "DEYSTVIYE" which is determined by the administrator of information communications system of TsZO (further - the ZUO ICKX administrator), entering data in the Register, ensures safety and data protection, containing in the Register, the round-the-clock access for subjects of the relations in the field of electronic confidential services to the Register through communication networks public;

The holder Reestra-TSZO establishing the organizational, methodological principles of maintaining Reestra-TSZO and providing its functioning;

The register-electronic database which contains data on the self-signed certificates of electronic seal of TsZO, certificates of TsZO for adding electronic seal in the confidential list and to data in the protocol of determination of the status of the certificate in real time, the certificates of skilled suppliers of electronic confidential services (further - suppliers) created with use of the self-signed certificate of electronic seal of TsZO, the status and restrictions in use of such certificates, and also SVS.

Other terms are used in the values specified in the Law and other regulations in the field of electronic identification and electronic confidential services.

II. Procedure for representation and entering of data into Register

1. The basis for entering of data into the Register is:

the decision (order) of the Ministry of digital transformation of Ukraine, the written notice of the structural division determined by the Ministry of digital transformation of Ukraine by the actionee of the TsZO function (further - structural division), about generation of couple of keys of TsZO, creation or canceling of the self-signed certificate of electronic seal or the relevant decision about canceling of the status of the skilled supplier of electronic confidential services;
