About approval of the Procedure for provision by the State Tax Administration of Ukraine of information from the State register of physical persons - taxpayers about the income of physical persons on requests of Bureau of economic safety of Ukraine

According to Article part three 7, to Item 2 parts two of Article 9, to Item 20 parts one of Article 17, to Item 11 of the Section VI "Final and transitional provisions" of the Law of Ukraine "About Bureau of economic safety of Ukraine", to the Law of Ukraine "About personal data protection", to the subitem 5 of item 4 of the Regulations on the Ministry of Finance of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of August 20, 2014 No. 375, and for the purpose of realization of procedure for granting by the State Tax Administration of Ukraine of information on the income of physical persons of PRIKAZYVAYEM:

1. Approve the Procedure for provision by the State Tax Administration of Ukraine for information from the State register of physical persons - taxpayers about the income of physical persons on requests of Bureau of economic safety of Ukraine which is applied.

2. To provide to legal Bureau of economic security department of Ukraine submission of this order on state registration in the Ministry of Justice of Ukraine in the procedure established by the legislation.

3. This order becomes effective from the date of its official publication.

4. To impose control of execution of this order on the Director of Bureau of economic safety of Ukraine and the Chairman of the State Tax Administration of Ukraine.

Procedure for provision by the State Tax Administration of Ukraine for information from the State register of physical persons - taxpayers about the income of physical persons on requests of Bureau of economic safety of Ukraine

I. General provisions

1. This Procedure is developed for the purpose of realization of procedure for granting by the State Tax Administration of Ukraine of information from the State register of physical persons - taxpayers (further - the State register) about the income of physical persons on requests of Bureau of economic safety of Ukraine (further - BEB) according to part three of article 7 of the Law of Ukraine "About Bureau of economic safety of Ukraine", to the Law of Ukraine "About personal data protection", to the Law of Ukraine "About information security in information and communication systems", to the subitem of 61 Items 4, to Item 8 of the Regulations on the State Tax Administration of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of March 6, 2019 No. 227, to the Procedure for processing of personal data in base of personal data in the State register of physical persons - taxpayers, to No. approved by the order of the Ministry of Finance of Ukraine of February 24, 2015 210, registered in the Ministry of Justice of Ukraine on March 12, 2015 for No. 278/26723.

2. Subjects of information relations according to this Procedure are GNS and BEB.

3. In this Procedure terms are used in the values given in the Tax code of Ukraine, the Law of Ukraine "About electronic confidential services".

4. This Procedure regulates exchange of information between GNS and BEB, rules of creation and representation of BEB in GNS of requests for obtaining from the State register of information necessary for prevention, identification, suppression, disclosure and investigation of the crimes carried to competence BEB and also forming and provision of GNS of replies to the requests.

5. In case of implementation of information exchange of BEB and GNS with use of system of electronic interaction of the state electronic information resources the structure and format of the electronic message are determined by the agreements on information exchange prepared according to the Procedure for the organization of electronic information exchange of the state electronic information resources approved by the resolution of the Cabinet of Ministers of Ukraine of May 10, 2018 No. 357.

In case of implementation of information exchange with use of the systems determined by the paragraph the second Item 1 of the Section II of this Procedure the format, structure of requests and answers, form of register of requests and answers, regulations of exchange of information, the requirement of information security, terms of implementation of the software for exchange of information are determined by the relevant joint decisions of GNS and BEB which are drawn up by separate protocols.

6. Action of this Procedure does not extend to cases when BEB have no technical capability for giving in GNS of requests electronically according to Item 1 of the Section II of this Procedure.
