About modification of the order of the Government of the Kyrgyz Republic "About approval of standards of the state services rendered to physical persons and legal entities by state bodies, their structural divisions and subordinated organizations" of June 3, 2014 No. 303
For the purpose of improvement of quality and availability of the state services rendered to citizens and legal entities according to the Law of the Kyrgyz Republic "About the state and municipal services", articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:
1. Bring in the order of the Government of the Kyrgyz Republic "About approval of standards of the state services rendered to physical persons and legal entities by state bodies, their structural divisions and subordinated organizations" of June 3, 2014 No. 303 the following changes:
in Standards of the state services rendered to physical persons and legal entities by state bodies, their structural divisions and subordinated organizations approved by the specified resolution:
in the Section II "In the social sphere":
- state Chapters 17 and 18 in edition according to appendix 1 to this resolution;
- state Chapter 22 in edition according to appendix 2 to this resolution.
2. This resolution becomes effective after fifteen days from the date of official publication.

Conditions of provision of the state service |
Provision of service is performed: - indoors, answering to the established sanitary standards; - in the presence of easy access of citizens to the building and sanitary and hygienic rooms (toilets, washing rooms), including for persons with limited opportunities of health on sight and hearing and faces with limited opportunities of health with violations of the musculoskeletal device, equipped (buildings, rooms) ramps, hand-rail; - by the principle of queque. Rooms have places for expectation, toilets (in regions, in case of impossibility of connection to the central plumbing and sanitary - outdoor), heating, water supply system, phone. Expectant mothers with limited opportunities of health are serviced out of turn. If they cannot rise to the room, the employee goes down to them for reception of an application. For convenience of visitors in territorial subdivisions stands with the list of the documents and application forms necessary for receipt of service are placed |

Terms of provision of the state service |
Expectation on the first-come, first-served basis. Documents acceptance at citizens, execution of the statement - up to 30 minutes. Consultation provision term to citizens by phone and in personal meeting constitutes more than 10 minutes. The statement for purpose of maternity allowance, including the electronic statement through the State portal of electronic services, is considered by territorial subdivision after provision of all necessary documents, within 3 working days, to the 20th of month under report. Allowance payment on pregnancy and childbirth is performed monthly, with 25 on 30 number, on transit accounts of consumers in bank |

Informing on service is performed also at meetings with the population, public and non-governmental organizations in regions of the republic, by means of answers to written addresses, by phone, by "telephone hotline" and the oral personal address to specialists in the form of references and consultations. Communication with visitors |
In authorized state body, its subordinated and territorial subdivisions information plates on doors of offices of the employees responsible for rendering service are placed. All staff of territorial subdivisions working with the population shall have the personified plates (badges) with indication of surname, name, middle name and position. In case of communication with visitors employees shall observe the following basic principles of ethics: be polite, benevolent, correct, patient, basic, aim to understand deeply being of question, be able to listen to the interlocutor and understand its line item, and also reason for the made decisions. Employees shall observe job descriptions (functional obligations) and the professional ethical standards which are not allowing the violations of the current legislation providing the respect for ethical standards, objectivities in relation to citizens excluding conflict of interest. Quality of provision of the state service is determined by the following criteria: - reliability and timeliness, in accordance with the terms and the service provision terms declared in the standard of the rendered service; - non-admission of discrimination on the basis of floor, race, language, disability, ethnic origin, religion, age, political and other convictions, educations, origins, property or other status, and also other circumstances; - availability, reclamation at citizens only of those documents for receipt of service which are specified in this standard; - compliance of conditions of provision of service to the requirements established by this standard: access to the building, availability of household conveniences, the schedule of acceptance convenient for citizens, availability and availability of information support (in printing and electronic formats); - correctness and politeness of employees when rendering the state service, consultation during all procedure of rendering service; - compliance of resulting effect (the received service) to expectations of the applicant; - availability of the complaint book of citizens in the available place |

Provision of the state service in electronic format |
The service is provided in electronic format to individual entrepreneurs, members of peasant farms without formation of legal entity and the official unemployed with entitlement to benefit on unemployment (except for the applications submitted by the members of peasant farm living in settlements in which the sizes of coefficients of surcharges to the salary and other social payments are established) regarding acceptance of request (statement) for receipt of the state service by means of the State portal of electronic services: portal.tunduk.kg, according to the Instructions for use the State portal of electronic services approved by the order of the Government of the Kyrgyz Republic of October 7, 2019 No. 525. Note: for departure of the electronic request for receipt of service individual entrepreneurs, members of peasant farm, the official unemployed with entitlement to benefit on unemployment need to be registered on the portal: portal.tunduk.kg. Refusal in provision of the state service |
In provision of the state service refuses if: - it is determined that the applicant is already granted maternity allowance in other territorial subdivision; - it is revealed that the submitted documents were dummy; - the applicant provides not the complete list of the necessary documents specified in Item 12 of this standard; - effective period of the submitted documents expired; - the damaged documents were submitted (pages, the illegible text, seal are pulled out); - the applicant does not conform to requirements of Item 3 of this standard |

Procedure for appeal |
In case of matters of argument on rendering service, the consumer has the right to address in accordance with the established procedure with the written (electronic) address: - in territorial subdivision; - in authorized state body. The written (electronic) address moves in a free form and shall contain full name of the consumer of service, residence address, phone number, and also claim essence, the signature of the consumer of service and date. Consideration of addresses is performed according to the procedure, established by the legislation of the Kyrgyz Republic in the field of administrative activities and ministerial procedures. The term of consideration of the written (electronic) address and receipt of the answer by the applicant shall not exceed 14 working days from the date of its registration. In case of disagreement with the made decision according to the address, the applicant has the right to appeal the decision of authorized state body judicially |

The allowance is granted in case of death of the following categories of citizens: - the worker or the family member consisting in its dependence; - the individual entrepreneur or the family member consisting in its dependence; - the member of the peasant economy or the family member consisting in its dependence; - the official unemployed or the family member consisting in its dependence; - person receiving social benefit, or the family member consisting in its dependence; - the jobless person or the family member consisting in its dependence |

In case of purpose of ESP by means of system of interdepartmental electronic interaction Tunduk by territorial subdivision the following data from information systems of state bodies are requested: - data/certificate(s) on child(children) birth; - the data of medico-social commission of experts confirming disability; - data of Social fund of the Kyrgyz Republic under the Cabinet of Ministers of the Kyrgyz Republic about lack of the right to provision of pensions; - the certificate or the statement from assembly record about the death of parents/parent; - data on registration in the place of residence/stay (only for living in settlements in which coefficients of surcharges to the salary and other social payments are established).
