About approval of the Procedure for maintaining the Register of consideration of claims of job seekers of licenses, licensees on decisions, actions (failure to act) of bodies of licensing concerning violation of the law in the field of licensing

According to Item "About licensing of types of economic activity" the Cabinet of Ministers of Ukraine decides 13 parts one of article 4 of the Law of Ukraine:

1. Approve the Procedure for maintaining the Register of consideration of claims of job seekers of licenses, licensees on decisions, actions (failure to act) of bodies of licensing concerning violation of the law in the field of licensing which is applied.

2. This resolution becomes effective since January 1, 2021.

Procedure for maintaining the Register of consideration of claims of job seekers of licenses, licensees on decisions, actions (failure to act) of bodies of licensing concerning violation of the law in the field of licensing

1. This Procedure determines the mechanism of maintaining the Register of consideration of claims of job seekers of licenses, licensees on decisions, actions (failure to act) of bodies of licensing concerning violation of the law in the field of licensing and the list of the data containing in it.

2. In this Procedure terms are used in such value:

The register of consideration of claims of job seekers of licenses, licensees on decisions, actions (failure to act) of bodies of licensing concerning violation of the law in the field of licensing (further - the Register) - information and communication system which provides collection, accumulating, protection, accounting, reflection, processing of data and provision of register information on the license applicant, the licensee making the complaint to the decision, actions (failure to act) of body of licensing concerning violation of the law in the field of licensing (further - the claim) in Expert and appeal council on questions of licensing; contents of the claim; consideration of the claim;

technical mistake - the printing, grammatical, arithmetic mistake made when entering data into the Register.

Other terms are used in the value given in the Laws of Ukraine "About licensing of types of economic activity", "About information security in information and communication systems" and "About public electronic registers".

3. Holder Reestra is GRS.

Holder Reestra:

keeps the Register electronically, in particular provides timely entering into the Register of data on the made complaints and results of their consideration by Expert and appeal council on questions of licensing;

determines the list of the officials having the right to enter data in the Register.

4. Administrator Reestra is GRS.

Subjects of the Register are claims.

Maintaining the Register is performed with use of Single state electronic system of allowing documents in the way:

introduction of data on subjects of the Register;

accounting, processing and systematization of data on subjects of the Register;

modification of data on subjects of the Register;

display of the corresponding urgent data in the Register according to the procedure of its electronic information exchange with other state registers and the state electronic information resources;

exception of the Register of data on subjects of the Register.

Public registrar is the official of GRS to which powers entering into the Register of data on subjects of the Register and other actions connected with maintaining the Register belongs.

Creator of register information of the Register is the license applicant, the licensee which makes the complaint in Expert and appeal council on questions of licensing.

5. Information transfer in the Register from other state electronic information resources or systems of public authorities is performed according to Procedure electronic (technical and information) the interaction approved by the resolution of the Cabinet of Ministers of Ukraine of September 8, 2016 No. 606 "Some questions of electronic interaction of electronic information resources" (The Official Bulletin of Ukraine, 2016, No. 73, Art. 2455; 2023, No. 11, Art. 721). The procedure of identification of the user is performed by use of the integrated system of electronic identification according to the Regulations on the integrated system of electronic identification approved by the resolution of the Cabinet of Ministers of Ukraine of November 3, 2023 No. 1150 (The Official Bulletin of Ukraine, 2023, No. 101, the Art. 6026).

6. Information exchange of the Register with other state electronic information resources is performed through system of electronic interaction of the state electronic information resources according to Procedure electronic (technical and information) the interaction approved by the resolution of the Cabinet of Ministers of Ukraine of September 8, 2016 No. 606.

7. GRS provides open, round-the-clock and free entry to data with the depersonalization of personal data containing in the Register on the official website taking into account requirements of the Law of Ukraine "About personal data protection".

8. In case of detection of technical mistakes in the Register of GRS within one working day corrects them what informs on person whom corrected information concerns.

9. The register is kept in state language.

10. The register contains the following data:

1) about the license applicant, the licensee making the complaint:

for the legal entity - full name, the location, identification code of the legal entity in the Unified state register of the companies and organizations of Ukraine;

for physical person entrepreneur - surname, own name, middle name (in the presence), the address of the declared/registered residence (stay), registration number of accounting card of the taxpayer or series (in the presence) and passport number of the citizen of Ukraine (for physical person entrepreneur who because of the religious beliefs refuses adoption of registration number of accounting card of the taxpayer and officially notified on it the relevant monitoring body and has mark in the passport of the citizen of Ukraine);

2) about the claim:

the name of body of licensing which made the decision; made action (failure to act) which is appealed;

content the decision, action (failure to act) of body of licensing which is appealed, date, number of the decision of body of licensing, date of its introduction in force (in the presence);

3) about consideration of the claim:
