About approval of Changes in some regulatory legal acts of State commission on regulation of the markets of financial services of Ukraine and the National commission performing state regulation in the field of the markets of financial services concerning use of seals

According to Item of 1 part one of article 28 of the Law of Ukraine "About financial services and state regulation of the markets of financial services", to the Law of Ukraine "About modification of some legal acts of Ukraine concerning use of seals by legal entities and physical persons - entrepreneurs", to Item 13 of the Regulations on the National commission performing state regulation in the field of the markets of financial services, No. approved by the Presidential decree of Ukraine of November 23, 2011 1070, the National commission performing state regulation in the field of the markets of financial services DECIDED:

1. Approve Changes in some regulatory legal acts of State commission on regulation of the markets of financial services of Ukraine and the National commission performing state regulation in the field of the markets of financial services on use of seals which are applied.

2. In the markets of financial services together with department of legal providing to provide to department of state regulation and methodology of supervision submission of this order to the Ministry of Justice of Ukraine for state registration.

3. And members of the commission to provide to management of ensuring activities of the Chairman publication of this order after its state registration.

4. This order becomes effective from the date of its official publication.

5. Control over the implementation of this order to assign to the member Natskomfinuslug Zaletov E. M.

Changes in some regulatory legal acts of State commission on regulation of the markets of financial services of Ukraine and the National commission performing state regulation in the field of the markets of financial services concerning use of seals

1. In Item 3.2 of the Section III of the Procedure for conducting checks concerning prevention and counteraction of legalization (washing) of income gained in the criminal way, or to financing of the terrorism approved by the order of State commission on regulation of the markets of financial services of Ukraine of August 5, 2003 No. 26, registered in the Ministry of Justice of Ukraine on August 15, 2003 for No. 716/8037 (in edition of the order of State commission on regulation of the markets of financial services of Ukraine from April 07, 2011 No. 185), to exclude the words "and under seal organizations".

2. In Regulations on the State register of financial institutions approved by the order of State commission on regulation of the markets of financial services of Ukraine of August 28, 2003 No. 41, registered in the Ministry of Justice of Ukraine on September 11, 2003 for No. 797/8118 (in edition of the order of the National commission performing state regulation in the field of the markets of financial services of November 28, 2013 No. 4368):

1) in the Section VI:

to state the subitem 2 of Item 1 in the following edition:

"2) documents shall be certified by the signature of the head of the applicant, move with the internal inventory with indication of the number of sheets of each document.

Documents on two and more sheets shall be numbered, stitched and bear text "All in this document is numbered, stitched, ratified _______ sheets", the name of position of the head, surname, initials and the signature of the head of the applicant. On copies of documents the mark about assurance of the copy of the document bearing text "According to the original", names of position of the head, the signature of the head, its surname, initials, date of assurance of the copy becomes;";

the fourth Item 2 to state the paragraph in the following edition:

4. In Regulations on training, retraining, advanced training and examination by persons performing activities in the markets of financial services, No. approved by the order of State commission on regulation of the markets of financial services of Ukraine of December 25, 2003 183, registered in the Ministry of Justice of Ukraine on January 28, 2004 for No. 122/8721:

1) in Section 2:

in the paragraph the second the subitem 5 of Item 2.2 of the word "also are sealed educational institution" to exclude;

in Item 2.4 of the word "also it is sealed" to exclude;

in the subitem 8 of Item 2.5 of the word "and impress of a seal" to exclude;

8. In Item 7.3 of Chapter 7 of the Method of forming of reserves of life insurance approved by the order of State commission on regulation of the markets of financial services of Ukraine of January 27, 2004 No. 24, registered in the Ministry of Justice of Ukraine on February 16, 2004 for No. 198/8797, of the word "and seal" to exclude.

9. 10. 11.
