About modification and amendments in the order of the Minister of Education and Science of the Republic of Kazakhstan of April 13, 2015 No. 198 "About approval of standards of the state services rendered in the field of family and children"
According to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" I ORDER:
1. Bring in the order of the Minister of Education and Science of the Republic of Kazakhstan of April 13, 2015 No. 198 "About approval of standards of the state services rendered in the field of family and children" (it is registered in the Register of state registration of regulatory legal acts of the Republic of Kazakhstan at No. 11184, it is published on June 18, 2015 in information system of law of Ad_let) the following changes and amendment:
to state Item 1 of the specified order in the following edition:
"1. Approve:
1) the Standard of the state services "Issue of References on Guardianship and Custody" according to appendix 1 to this order;
2) the Standard of the state services "Establishment of Guardianship Or Custody over the Orphan Child (Orphan Children) and Child(children), Without Parental Support" according to appendix 2 to this order;
3) the Standard of the state services "Issue of References for the Order Property of Minor Children and Registrations of Inheritance to Minor Children" according to appendix 3 to this order;
4) the Standard of the state services "Issue of References of the Bodies Performing Functions on Guardianship Or Custody for Execution of Transactions with the Property Belonging on the Property Right to Minor Children" according to appendix 4 to this order;
5) the Standard of the state services "Provision of Free Transportation to the General Education Organizations and Back Home to the Children Living in the Remote Rural Items" according to appendix 5 to this order;
6) the Standard of the state services "Provision of Free and Preferential Food to Separate Categories of Students and Pupils at Comprehensive Schools" according to appendix 6 to this order;
7) the Standard of the state services "Purpose of Allowance Payment to Guardians or Custodians to Content of the Orphan Child (Orphan Children) and Child(children), Without Parental Support" according to appendix 7 to this order;
8) The standard of the state services "Broadcast of Child(children) on Foster Education" according to appendix 8 to this order;
9) the Standard of the state services "Purpose of Payment of Money to Content of Child(children) Transferred to Foster Tutors" according to appendix 9 to this order;
10) the Standard of the state services "Registration of Persons Wishing to Adopt Children" according to appendix 10 to this order;
11) the Standard of the state services "Accreditation of the Agency on Adoption" according to appendix 11 to this order;
12) the Standard of the state services "Prolongation of Term of Accreditation of the Agency on Adoption" according to appendix 12 to this order;
13) the Standard of the state services "Purpose of Lump Money Payment in connection with Adoption of the Orphan Child and (or) Child, Without Parental Support" according to appendix 13 to this order;
14) the Standard of the state services "Documents Acceptance and Issue of the Directions on Representation of Rest in Country and School Camps to Separate Categories of Students and Pupils of Public Institutions of Education" according to appendix 14 to this order;
15) the Standard of the state services "Issue of Permission to the Appointments to the Child to the Parents Deprived of the Parent Rights, Which Are Not Exerting Negative Impact on the Child" according to appendix 15 to this order;
16) the Standard of the state services "Broadcast of Child(children) on Education in Foster Home and Purpose of Payment of Money to Their Content" according to appendix 16 to this order.";

2. To committee on protection of the rights of children of the Ministry of Education and Science of the Republic of Kazakhstan (Orshubekov N. A.) in the procedure established by the legislation of the Republic of Kazakhstan to provide:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days from the date of state registration of this order the direction it the copy in printing and electronic type in the state and Russian languages in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;
3) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;
4) placement of this order on Internet resource of the Ministry of Education and Science of the Republic of Kazakhstan after its official publication;
5) within ten working days after state registration of this order in the Ministry of Justice submission to Department of legal service and international cooperation of the Ministry of Education and Science of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2), 3) and 4) of this Item.
3. To impose control of execution of this order on the vice-Minister of Education and Science of the Republic of Kazakhstan Asylova B. A.
4. This order becomes effective after ten calendar days after day of its first official publication.

1. The state service "Issue of References on Guardianship and Custody" (further - the state service).
2. The standard of the state service is developed by the Ministry of Education and Science of the Republic of Kazakhstan (further - the Ministry).
3. The state service appears local executive bodies of the cities of Astana and Almaty, areas and cities of regional value (further - the service provider).
Reception of an application and issue of result of rendering the state service are performed through:
1) non-commercial joint-stock company "The Government for Citizens state corporation (further - the State corporation);
2) the web portal of "the electronic government" www.egov.kz (further - the portal).
4. Terms of rendering the state service:
1) from the moment of delivery of documents in the State corporation, and also in case of the address on the portal - 5 (five) minutes.
2) in case of lack of data on establishment of guardianship or custody over the orphan child (orphan children), child(children), without parental support, in information systems the term of rendering the state service - 3 working days;
In case of the appeal to the State corporation day of acceptance does not enter rendering the state service in time. The service provider provides delivery of result of the state service in the State corporation, not later than days before the expiration of rendering the state service;
3) the most allowed time of expectation for delivery of documents uslugopoluchatel in the State corporation - 15 minutes;
4) the most allowed time of servicing of uslugopoluchatel in the State corporation - 15 minutes.
5. Form of rendering the state service - electronic (completely automated) and (or) paper.
6. Result of rendering the state service - the certificate of guardianship and custody in form according to appendix 1 to this standard of the state service or the motivated answer about refusal in rendering the state service in cases and on the bases provided in Item 11 of this standard of the state service.
Form of provision of result of rendering the state service - electronic and (or) paper.
In case of the request of uslugopoluchatel for result of rendering the state service on paper the result of rendering the state service is drawn up electronically, unpacked, certified by seal and the authorized signature of the service provider.
On the portal the result of rendering the state service goes to "personal account" of the uslugopoluchatel in electronic form signed by the digital signature (further - the EDS) the authorized person of the service provider.
7. The state service is rendered to free of charge physical persons (further - uslugopoluchatel).
8. Working schedule:
1) State corporation: Monday through Saturday inclusive according to the established working schedule from 9:00 till 20:00 o'clock without interruption for lunch, except for Sundays and holidays, according to the labor law.
Acceptance is performed according to the procedure of "electronic" queue, at the choice of uslugopoluchatel, without the accelerated servicing, "booking" of electronic queue by means of the portal is possible;
2) portal: round the clock, except for technical breaks in connection with carrying out repair work (in case of the address of uslugopoluchatel after the termination of working hours, in days off and holidays according to the labor law of the Republic of Kazakhstan, reception of an application and issue of result of rendering the state service is performed the next working afternoon).
9. List of the documents necessary for rendering the state service in case of the address of uslugopoluchatel:
in the State corporation:
1) the statement in form according to appendix 2 to this standard of the state service;
2) the identity document of uslugopoluchatel (it is required for identification of the personality);
3) the certificate of birth of the child, in case of the child's birth till August 13, 2007 or outside the Republic of Kazakhstan (it is required for identification of the personality);
on the portal:
1) the application in electronic form signed by the EDS of uslugopoluchatel or certified by the one-time password in case of registration and connection of subscriber number of the uslugopoluchatel provided by mobile operator to accounting record of the portal.
On the portal acceptance of electronic request is performed in "personal account" of uslugopoluchatel.
Data on identity documents of uslugopoluchatel, the child's birth (in case of the child's birth after August 13, 2007) the employee of the State corporation receives from the corresponding state information systems through lock of "the electronic government".
The employee of the State corporation receives the consent of uslugopoluchatel to use of the data which are the secret protected by the law, containing in information systems when rendering the state services if other is not provided by the laws of the Republic of Kazakhstan.
In case of documents acceptance through the State corporation the receipt on acceptance of the relevant documents is issued to uslugopoluchatel.
In the State corporation issue of ready documents is performed based on the receipt on documents acceptance in case of presentation of the identity certificate (or his representative under the notarized power of attorney).
The state corporation provides storage of result within one month then transfers him to the service provider for further storage. In case of the address of uslugopoluchatel after one month at the request of the State corporation the service provider within one working day sends ready documents to the State corporation for issue to uslugopoluchatel.
10. In case of provision by uslugopoluchatel of incomplete document package according to Item 9 of this standard of the state service the employee of the State corporation refuses reception of an application and issues the receipt on refusal in documents acceptance in form according to appendix 3 to this standard of the state service.
11. The bases for refusal in rendering the state service are:
1) establishment of unauthenticity of the documents submitted by uslugopoluchatel for receipt of the state service, and (or) these (data) containing in them;
2) discrepancy of uslugopoluchatel and (or) the provided materials, objects, supplied and the information necessary for rendering the state service, to the requirements established by the order of the Government of the Republic of Kazakhstan of March 30, 2012 No. 382 "About approval of Rules of implementation of functions of the state on guardianship and custody";
3) concerning uslugopoluchatel there is judgment which took legal effect based on which the uslugopoluchatel is deprived of the special right connected with receipt of the state service.
12. Appeal of decisions, actions (failure to act) of the service provider and (or) his officials concerning rendering the state services: the claim is submitted addressed to the head of the service provider to the addresses specified in Item 15 of this standard of the state service.
The claim is submitted in writing by mail or purposely through office of the service provider, and also by means of the portal.
In the claim of physical person its surname, name, middle name (is entered in case of its availability), the postal address, contact telephone number.
Confirmation of adoption of the claim is its registration (stamp, the entering number and date) in office of the service provider with indication of surname and initials of person which accepted the claim, term and the place of receipt of the answer to the made complaint.
The claim to actions (failure to act) of the employee of the State corporation is sent to the head of the State corporation to the addresses and phones specified in Item 15 of this standard of the state service.
Confirmation of adoption of the claim in the State corporation which arrived as if on purpose, and by mail, its registration is (stamp, the entering number and registration date are put down on the second copy of the claim or the cover letter to the claim).
In case of the address through the portal information on procedure for appeal can be obtained by phone Single contact center 1414, 8 800 080 7777.
When sending the claim through the portal information on the address which is updated during processing of the address by the service provider is available to uslugopoluchatel from "personal account" (mark about delivery, registration, execution, the answer about consideration or refusal in consideration).
The claim of uslugopoluchatel which arrived to the service provider or the State corporation is subject to consideration within five working days from the date of its registration. The motivated answer about results of consideration of the claim goes to uslogopoluchatel by mail or is issued purposely in office of the service provider or the State corporation.
In case of disagreement with results of the rendered state service the uslugopoluchatel can address with the claim to authorized body by assessment and control of quality of rendering the state services.
The claim of uslugopoluchatel which arrived to authorized body by assessment and control of quality of rendering the state services is subject to consideration within fifteen working days from the date of its registration.
13. In disagreement cases with results of the rendered state service the uslugopoluchatel has the right to take a legal action in the procedure established by the legislation of the Republic of Kazakhstan.
14. Uslugopoluchatelyam, the having established legislation procedure complete or partial loss of capability or opportunity to perform self-service, to move, be guided independently documents acceptance, for rendering the state service, to be made by the employee of the State corporation with departure at the place of residence by means of the address through Single contact center 1414, 8 800 080 7777.
15. Addresses of places of rendering the state service are placed on:
1) the Internet - resource of the Ministry: www.edu.gov.kz;
2) the Internet - resource of the State corporation: www.gov4c.kz;
3) portal: www.egov.kz.
16. Uslugopoluchatel has possibility of receipt of the state service electronically through the portal on condition of EDS availability.
17. Uslugopoluchatel has possibility of receipt of information on procedure and the status of rendering the state service in the mode of remote access by means of portal "personal account", and also Single contact center 1414, 8 800 080 7777.
18. Contact telephone numbers of service desks of the service provider concerning rendering the state service are placed on Internet resources of the Ministry www.edu.gov.kz, the service provider of www.bala-kkk.kz.
