About modification and amendments in the resolution of Board of National Bank of the Republic of Kazakhstan of April 30, 2015 No. 71 "About approval of standards of the state services of National Bank of the Republic of Kazakhstan"
For the purpose of enhancement of regulatory legal acts of the Republic of Kazakhstan the Board of National Bank of the Republic of Kazakhstan DECIDES:
1. Bring in the resolution of Board of National Bank of the Republic of Kazakhstan of April 30, 2015 No. 71 "About approval of standards of the state services of National Bank of the Republic of Kazakhstan" (registered in the Register of state registration of regulatory legal acts at No. 11534, published on July 15, 2015 in information system of law of Ad_let) the following changes and amendments:
in Item 1:
4) and 5) to exclude subitems;
6) to state the subitem in the following edition:
"6) standard of the state service "Issue of Consent to Appointment (Election) of Leading Employees of the Financial Organizations, Bank, Insurance Holdings, "Fund of Guaranteeing Insurance Payments" Joint-stock Company according to Appendix 6 to This Resolution;";

If currency transaction does not fall under the notification mode according to the Law of the Republic of Kazakhstan of June 13, 2005 "About currency control and currency exchange control" and to the resolution of Board of National Bank of the Republic of Kazakhstan of April 28, 2012 No. 154 "About approval of Rules of implementation of currency transactions in the Republic of Kazakhstan", the letter of explanatory nature is sent the uslugopoluchatel registered in the Register of state registration of regulatory legal acts at No. 7701,.
Form of provision of result of rendering the state service: paper.
The withdrawal of the documents submitted for receipt of the state service is allowed before the expiration established by the subitem 1) of item 4 of this standard of the state service by giving by uslugopoluchatel of the written application in any form with indication of the reason of recall of documents.
Execution of several certificates on the notification on one statement of uslugopoluchatel is allowed.";
7, 8 and 9 to state Items in the following edition:

9. For rendering the state service in case of the address to the service provider the uslugopoluchatel represents the notification on currency transaction or on opening of the bank account in foreign bank according to appendix to this standard of the state service.
The documents constituted in foreign language are represented with transfer on state or Russian.
It is allowed to demand for the purpose of refining of circumstances of making of currency transactions to the service provider from uslugopoluchatel the currency agreement based on which the uslugopoluchatel performs currency transactions.";

3) the copy of the identity document (for the physical persons performing currency transaction);
4) copies of the documents confirming origin, execution and discharge of the currency agreement.
The documents constituted in foreign language are represented with transfer on state or Russian.
It is allowed to request to the service provider in addition documents on which references in the submitted documents are had.";

2) the financial reporting as of the end of month under report or on end date of share placing;
3) the report on share placing results in 2 (two) copies in the Kazakh and Russian languages on paper and in 1 (one) copy in the Kazakh and Russian languages in electronic form in the PDF format, constituted and drawn up according to Requirements to the report on share placing results according to appendix to this standard of the state service.
In case of submission of documents on paper for approval of the report on share placing results:
the application of society is signed by the head of executive body of society (or person, it replacing) or person authorized by founders of society for signing and certified by impress of a seal of society (in the presence);
if each submitted document consists of one leaf, it is signed by the head of executive body of society, the chief accountant of society (or persons, them replacing) and certified by impress of a seal of society (in the presence);
in case of plurality of sheets each submitted document is stitched and fastened with the paper seal pasted on node of insertion and partially on leaf. Signatures of the head of executive body, the chief accountant (or persons, them replacing) and impress of a seal of society are (in the presence) applied partially on paper seal, partially on document sheet;
in documents the stipulated corrections, deletions, erasures, blots, dopisk (dopechatka) are allowed. In case of correction the crossed-out word shall be read clearly. Each correction (amendment) shall be stipulated, for example: "to corrected... trust", "to added... trust", "crossed out... not read", it is certified by persons which signed the document and impress of a seal of society (in the presence).";

1) the statement for consideration of the report on results of placement of bonds constituted in any form;
2) the financial reporting as of the end of month under report or on end date of placement of bonds;
3) the report on results of placement of bonds is constituted in 2 (two) copies in the Kazakh and Russian languages on paper, stitched with the copy of the register of bondholders issued by the registrar for the day following behind day of the end of the period of placement of bonds, and in 1 (one) copy in the Kazakh and Russian languages in electronic form in the PDF format, constituted and drawn up according to Requirements to creation and report layout about results of placement of bonds according to appendix to this standard of the state service;
4) copies of the documents confirming availability of the agreement of the pledge registered according to requirements of the legislation of the Republic of Kazakhstan about the security market and about registration of pledge of personal estate in case of release of the mortgage and other bonds provided with pledge of property of uslugopoluchatel.
In case of submission of documents on paper:
the application of uslugopoluchatel is signed by the head of executive body (sole executive body) of uslugopoluchatel (or person, it replacing) and certified by impress of a seal of uslugopoluchatel (in the presence);
if each submitted document consists of one leaf, it is signed by the head of executive body (sole executive body), the chief accountant of uslugopoluchatel (or persons, them replacing) and certified by impress of a seal of uslugopoluchatel (in the presence);
in case of plurality of sheets each submitted document is stitched and fastened with the paper seal pasted on node of insertion and partially on leaf. Signatures of the head of executive body (sole executive body), the chief accountant of uslugopoluchatel (or persons, them replacing) and impress of a seal of uslugopoluchatel are (in the presence) applied partially on paper seal, partially on document sheet;

to state the standard of the state service "Issue of the Act of Input of Management System of the Database of Credit Stories in Operation of Credit Bureau" approved according to appendix 18 to the specified resolution in edition according to appendix 14 to this resolution;
in the standard of the state service "Approval of the Report on Results of Placement of Shares of Mutual Investment Fund" approved according to appendix 19 to the specified resolution:
to state part one of Item 3 in the following edition:

9. List of the documents necessary for rendering the state service in case of the address of uslugopoluchatel to the service provider:
1) the statement for consideration of the report on results of placement of shares of mutual investment fund constituted in any form;
2) the report on results of placement of shares of mutual investment fund in 2 (two) copies in the Kazakh and Russian languages on paper with application of a copy of the statement of the registrar from personal account of the managing company for accounting of the placed shares of mutual investment fund constituted for the date following end date of the accounting period, and in 1 (one) copy in the Kazakh and Russian languages in electronic form in the PDF format (without the information about owners of shares of mutual investment fund), constituted and drawn up according to Requirements to creation and report layout about results of placement of shares of mutual investment fund according to appendix to this standard of the state service.
In case of submission of documents on paper for approval of the report on results of placement of shares of mutual investment fund:
the application of managing company of mutual investment fund is signed by the head of executive body of managing company of mutual investment fund (or person, it replacing) and certified by impress of a seal of managing company of mutual investment fund (in the presence);
if each submitted document consists of one leaf, it is signed by the head of the structural unit of managing company, the mutual investment fund exercising asset management, the chief accountant of managing company (or persons, them replacing) and certified by impress of a seal of managing company of mutual investment fund (in the presence);
in case of plurality of sheets each submitted document is stitched and fastened with the paper seal pasted on node of insertion and partially on leaf. Signatures of the head of the structural unit of managing company exercising asset management of mutual investment fund, the chief accountant of managing company (or persons, them replacing) and impress of a seal of managing company are (in the presence) applied partially on paper seal, partially on document sheet;
in documents the stipulated corrections, deletions, erasures, blots, dopisk (dopechatka) are allowed. In case of correction the crossed-out word shall be read clearly. Each correction (amendment) shall be stipulated, for example: "to corrected... trust", "to added... trust", "crossed out... not read", it is certified by persons which signed the document and impress of a seal of society (in the presence).";

The report of auditing organization is recognized valid on condition of submission of documents, confirmatory that it:
it is independent of founders of the checked banks and their officials;
it is authorized on implementation of auditor activities according to the license and qualification requirements for carrying out statutory audit of the financial organizations of the authorized state body performing state regulation in the field of auditor activities and control of activities of auditing and professional auditing organizations or according to the license for implementation of auditor activities of competent authority of the state which resident is.
Information about founders contains:
for founders - physical persons - the information about the founder - physical person in form according to appendix 2 to this standard of the state service, and also information on fulfillment of requirements of the paragraph of the third subitem 5) Item 10 of this standard of the state service with appendix of the document confirming lack of the outstanding or not removed criminal record, issued by authorized state body of the Republic of Kazakhstan on forming of legal statistics and conducting special accounting (date of issue of the specified document constitutes no more than three months preceding date of submission of the petition).
