About modification of some legal acts of Ukraine concerning ensuring realization of the right to inheritance
The Verkhovna Rada of Ukraine decides:
I. Make changes to the following legal acts of Ukraine:
1. Article 1221 of the Civil code of Ukraine (2003, Art. No. No. 40-44, 356) to add sheets of the Verkhovna Rada of Ukraine with part three of the following content:
"3. In particular cases the place of opening of inheritance is established by the law".
2. "About providing the rights and freedoms of citizens and legal regime in temporarily occupied territory of Ukraine" (Sheets of the Verkhovna Rada of Ukraine, 2014, No. 26, of Art. 892 with subsequent changes) to add the law of Ukraine with Article 11-1 of the following content:
"Article 11-1. Ensuring realization of the right to inheritance
1. If the last residence of the testator is temporarily occupied territory, the place of opening of inheritance is the place of submission of the first statement that confirms declaration of will of rather heritable property, the heirs, testamentary executors, persons interested in protection of heritable property, or the requirement of creditors.
2. If the residence of the testator is unknown, and real estate or its main part, in case of lack of real estate - the main part of personal estate is in the territory provided by part one of this Article, the place of opening of inheritance is the place of submission of the first statement that confirms declaration of will of rather heritable property, the heirs, testamentary executors, persons interested in protection of heritable property, or the requirement of creditors.
3. Heritable case is subject to registration in the Heritable register according to the procedure approved by the Cabinet of Ministers of Ukraine".
3. The law of Ukraine "About temporary measures for conducting anti-terrorist operation" (2014, No. 44, the Art. 2040) to add sheets of the Verkhovna Rada of Ukraine with Article 9-1 of the following content:
