This Law determines legal and organizational basis of activities in the field of physical culture and sport, is directed to creation of conditions for development of sports and improving and sports and mass work, and also for holding sporting events and participation of athletes in them (teams of athletes).

 Chapter 1. General provisions

Article 1. The main terms applied in this Law and their determinations

1. In this Law the following main terms and their determinations are applied:

the fan – the physical person who is interested in achievement by athletes (teams of athletes) and other physical persons playing physical culture and sport, sports results and also the physical person who in case of stay in the venue of sports and mass action, the venue of sports competition is not their participant also otherwise is not involved in their carrying out, including in protection of public order and ensuring public safety, covering of sports and mass action, sports competition in mass media;

sport – the part of sport which is representing the isolated sphere of the public relations, having specific features, rules of sports competitions, venues of sports and mass, sporting events, sports equipment and the equipment;

the volunteer performing activities in the field of physical culture and sport (further – the volunteer), – the physical person which is voluntarily giving information and (or) organizational help to fans and other persons when holding sports and mass action, sports competition based on the non-paid civil agreement signed with the organizer of sports and mass action, the organizer of sports competition;

the top management of preparation – the organizations of physical culture and sport, schools of the Olympic reserve performing sports training of the athletes applying for inclusion in structures of national and national teams of the Republic of Belarus on sports (national and technical, aviation, military and applied and office and applied sports national teams);

club on physical culture and sport – the voluntary merging of physical persons without formation of legal entity created in the organizations for preparation for sports and improving, sports and mass actions, sports competitions and participation in them;

persons performing activities in the field of physical culture and sport – legal entities (their associations) which are not the organizations of physical culture and sport which activities are directed to material, medical, personnel, educational and methodical, information, financial and other support in the field of physical culture and sport, and also the physical persons who are not athletes, trainers, other specialists in the field of physical culture and sport, giving help in the organization and (or) holding sports and mass actions, sports competitions, assistance to development of physical culture and sport;

the venue of sports and mass action (the venue of sporting event, the venue of sports competition) – the territory of sports construction, and also the territories which are specially prepared for holding sports and mass action (sporting event, sports competition) including sections of highways, the areas, streets, water objects;

national and sports national teams of the Republic of Belarus (national and technical, aviation, military and applied and office and applied sports national teams) – the groups of athletes, trainers and other specialists created for preparation for the international sports competitions and participation in them under the state symbols of the Republic of Belarus;

consolidation of fans – public association which members are fans, realizing as its main objectives support of the organizations of physical culture and sport, athletes (teams of athletes), other physical persons playing physical culture and sport and also forming of right obedient behavior of his members;

the organizer of sports and mass action (the organizer of sporting event, the organizer of sports competition) – the physical and (or) legal entity who initiated holding sports and mass action (sporting event, sports competition) and (or) performs organizational, financial and (or) other support of its preparation and carrying out;

sport – the field of activity representing set of sports, which developed in the form of sporting events;

elite sport – the part of sport directed to achievement of high sports results by athletes at official republican sports competitions and official international sports competitions;

sports delegation – the group of physical persons (physical person) directed for participation in the international sports and mass, sporting events which are not official;

sports delegation of the Republic of Belarus – the group of physical persons (physical person) directed for representation of the Republic of Belarus on official international sports and mass, sporting events and participations in these actions;

sports disqualification – deprivation for a certain period of time or for life, on certain number of games (matches) of the right of participation in sporting events of athletes, trainers, judges on sport, the sports agents, health workers, other physical persons participating in sports preparation, the animals participating in sporting events for dope in sport and also athletes, trainers, judges on sport, the sports agents, health workers, other physical persons participating in sports preparation for abuse of regulations of sports competitions by the form sport, regulations on holding (regulations of carrying out) sports competitions, decisions of federations (the unions, associations) by the form (types) of sport, the international sports organizations;

sports preparation – the complex, planned process of training of athletes (teams of athletes) directed to enhancement of their sports skill and achievement of sports results including physical training of athletes, participation in sporting events, and also material, medical, scientific and methodical and (or) other support;

sports competition – the competition among athletes (teams of athletes) by the form (types) of sport for the purpose of determination of winners, sports results held according to rules of sports competitions by the form of sport and regulations on holding (regulations of carrying out) sports competition;

sports and mass work – preparation and holding sports and mass actions;

sports and mass action – the organized mass action of competitive nature aimed at the physical development of the person, enhancement of its physical activity, forming of need for systematic occupations by physical culture and sport, strengthening of health and rational carrying out leisure;

sporting events – sports competitions and actions for sports preparation for them;

the sports agent – the physical person registered as the individual entrepreneur, who had the corresponding training and performing based on the civil agreements signed with subjects of professional sport, representation of interests of subjects of professional sport in their relations with other subjects of physical culture and sport;

the sports mode – procedure for behavior of the athlete during sporting events and the daily routine of the athlete including the mode of training and (or) competitive work, the periods of rest, food, recovery, participation in medical examinations;

sports reserve – the physical persons having sports training on the chosen sport and applying for inclusion in structures of national and national teams of the Republic of Belarus on sports (national and technical, aviation, military and applied and office and applied sports national teams);

sports result – certain result of participation of the athlete (team of athletes), other physical persons playing physical culture and sport, in sports and improving, sports and mass, sporting events (sports competitions), expressed in certain quantitative and (or) qualitative indexes;

the athlete – the physical person having sports training on the chosen sport;

the high-class athlete – the athlete having sports rank and competing at sports competitions for the purpose of achievement of high sports results;

student's sport – the part of physical culture and sport directed to physical training of students in organizations of secondary vocational and higher education including athletes, their preparation for participation and participation in sports and improving, sports and mass, sporting events;

the steward performing activities in the field of physical culture and sport (further – the steward), – the physical person who had the corresponding training concerning the organization and holding sports and mass action, sports competition and involved by the organizer of sports and mass action, the organizer of sports competition based on the civil agreement in assistance in the organization and (or) holding sports and mass action, sports competition;

the judge on sport – the physical person who had training of judges on sport and having judicial category, and also the physical person having the international judicial category authorized by the organizer of sports and mass action or the organizer of sports competition on ensuring compliance with regulations on holding sports and mass action or rules of sports competitions by the form of sport, regulations on holding (regulations of carrying out) sports competition respectively, determination of winners, sports results and their fixing;

technical, aviation, military and applied and office and applied sports – sports which basis are special actions, including acceptances connected with execution of service duties by the military personnel, faces of the commanding and ordinary structure of the Investigative Committee, the State committee of judicial examinations, law-enforcement bodies, financial investigations of the State Control Committee, bodies and divisions on emergency situations, public prosecutor's employees, officials of customs authorities;

the trainer – the physical person having education in the field of physical culture and sport or who got the admission to occupation pedagogical activities in the field of physical culture and sport, performing physical training of athletes in the course of their sports preparation, other physical persons in the course of carrying out sports and improving, sports and mass work, holding other actions necessary for sports preparation, and also management of training and (or) competitive work of athletes (teams of athletes);

participants of sports and mass actions – the physical persons participating in sports and mass actions, coaches, judges on sport, health workers, other physical persons participating in holding sports and mass actions, including included in structures of sports delegations (sports delegations of the Republic of Belarus);

participants of sporting events (participants of sports competitions) are athletes, trainers, judges on sport, the sports agents, health workers, other physical persons participating in holding sporting events (sports competitions), including included in structures of sports delegations (sports delegations of the Republic of Belarus);

educational and training process – method of implementation of sports preparation by means of educational and training occupations, educational training camps, recovery, preventive, improving actions, testing, judicial practice, participation in sports competitions;

physical culture – the culture component, the field of activity representing set of the types of activity based on the cultural and material values created and used by society for the purpose of physical development of the person, enhancement of its physical activity, directed to strengthening of his health and promoting harmonious development of the personality;

physical training – the complex process of use of means, methods, forms and conditions of occupations physical exercises allowing to influence directionally physical development of the person;

physical training – the complex process aimed at the physical development of the person, acquisition by it of abilities, skills and knowledge in the field of physical culture and sport for the purpose of forming of comprehensively developed and physically healthy person, including physical training, sports and improving and sports and mass work;

sports and improving work – preparation and holding sports and improving actions;

sports and improving action – the action of improving nature aimed at the physical development of the person, enhancement of its physical activity, forming of need for systematic occupations by physical culture and sport, strengthening of health and rational carrying out leisure;

sports constructions – the objects intended for occupation by physical culture and sport;

school sport – the part of physical culture and sport directed to physical training of students in organizations of general secondary education including athletes, their preparation for participation and participation in sports and improving, sports and mass, sporting events.

2. Other terms are determined in individual clauses of this Law.

Article 2. Legal regulation of the relations in the field of physical culture and sport

1. The relations in the field of physical culture and sport are governed by the legislation in the field of physical culture and sport, including the legislation on dope in sport, and also the international treaties of the Republic of Belarus and other international legal acts containing obligations of the Republic of Belarus.

2. The legislation in the field of physical culture and sport is based on the Constitution of the Republic of Belarus and consists of this Law and other acts of the legislation.

3. If the international treaty of the Republic of Belarus establishes other rules, than those which contain in this Law then are applied rules of the international treaty.

Article 3. Responsibility for violation of the legislation in the field of physical culture and sport

Persons guilty of violation of the law in the field of physical culture and sport, bear responsibility according to legal acts.

Article 4. Right to occupation physical culture and sport

1. Each citizen of the Republic of Belarus has the right to occupation physical culture and sport.

2. The right of citizens of the Republic of Belarus to occupation physical culture and sport is provided with the state by means of creation of necessary conditions for its realization, carrying out state policy in the field of physical culture and sport.

3. Foreign citizens and stateless persons in the territory of the Republic of Belarus have the rights in the field of physical culture and sport on an equal basis with citizens of the Republic of Belarus if other is not determined by the Constitution of the Republic of Belarus, this Law, other legal acts and international treaties of the Republic of Belarus.

Article 5. Safety of training by physical culture and sport

1. When training safety rules of holding such occupations shall be followed by physical culture and sport.

2. Safety rules of training by physical culture and sport affirm the Ministry of Sport and tourism.

3. Physical culture and sport are established by safety rules of training:

the requirements to safety of training by physical culture and sport directed to creation of conditions on health protection, injury prevention, the organization of safety of occupations by physical culture and sport;

procedure, conditions of creation and approval of the act of readiness of sports construction for training by physical culture and sport, and also form of such act;

accounting treatment for sports injuries and investigation of the accidents which happened to athletes during sports preparation and also with other physical persons playing physical culture and sport during such occupations.

4. The organizations and the individual entrepreneurs giving classes physical culture and sport taking into account the direction to activities for development of physical culture and sport and sports develop them and adopt the local legal acts regulating questions of safe training by physical culture and sport and also questions of carrying out with the physical persons playing physical culture and sport, instructing in training safety issues physical culture and sport, prevention and injury prevention, first-aid treatment in case of accidents.

Article 6. Olympic Movement of Belarus

The Olympic Movement of Belarus - part of the international Olympic Movement which purposes are promotion and implementation of the principles of the Olympic Movement, assistance to development of physical culture and sport, strengthening international cooperation in the field of physical culture and sport, representation of the Republic of Belarus at the Olympic Games, other international sporting events held under the auspices of the International Olympic Committee, the European Olympic committees and Association of National Olympic Committees.

Article 7. Paralympic movement of Belarus, deflimpiysky movement of Belarus, special Olympic Movement of Belarus

1. For the purpose of assistance to development of physical culture and sport of disabled people in the Republic of Belarus Paralympic movement of Belarus, deflimpiysky movement of Belarus, the special Olympic Movement of Belarus are effective.

2. Paralympic movement of Belarus - part of the international Paralympic movement which purposes are assistance to development of physical culture and sport of disabled people with violations of the musculoskeletal device, sight, strengthening international cooperation in the field of physical culture and sport, representation of the Republic of Belarus at the Paralympic Games, other international sporting events held with participation of specified persons.

3. Deflimpiysky movement of Belarus - part of the international deflimpiysky movement which purposes are assistance to development of physical culture and sport of disabled people with hearing disorder, strengthening international cooperation in the field of physical culture and sport, representation of the Republic of Belarus at the Deflimpiysky games, other international sporting events held with participation of specified persons.

4. The special Olympic Movement of Belarus – part of the international special Olympic Movement which purposes are assistance to development of physical culture and sport of disabled people with intellectual violations, strengthening international cooperation in the field of physical culture and sport, representation of the Republic of Belarus at the Special Olympic Games, other international sporting events held with participation of specified persons.

Article 8. System of physical culture and sport in the Republic of Belarus

1. The system of physical culture and sport in the Republic of Belarus includes set of the interacting subjects of physical culture and sport.

2. Treat subjects of physical culture and sport:

The Ministry of Sport and tourism, other republican state bodies, local authorities and self-government, and also other state bodies (organizations) performing according to the competence activities in the field of physical culture and sport;

organizations of physical culture and sport;

the athletes, other physical persons playing physical culture and sport, their associations, including clubs on physical culture and sport;

judges on sport, sports agents, trainers and other specialists in the field of physical culture and sport, their associations;

the volunteers, stewards, sponsors, advertisers performing activities in the field of physical culture and sport;

fans, associations of fans;

organizations of education, the scientific organizations, the organizations of health care performing activities in the field of physical culture and sport;

the other persons performing activities in the field of physical culture and sport.

Article 8-1. Promotion of physical culture and sport

1. For the purpose of promoting of physical culture and sport, forming at the population of need for systematic occupation and sense of responsibility for the health the state provides with physical culture and sport carrying out promotion of physical culture and sport by means of:

informing the population on the social importance of physical culture and sport, their role in improvement of the nation, forming of healthy lifestyle;

lighting in mass media, including by placement of social advertizing, questions of usefulness and need of occupation physical culture and sport;

the organizations and holding other actions directed to promotion of physical culture and sport.

2. Promotion of physical culture and sport is carried out:

The Ministry of Sport and tourism, other republican state bodies, local authorities and self-government, and also other state bodies (organizations) performing according to the competence activities in the field of physical culture and sport;

organizations of physical culture and sport;

organizations of education;

organizations of health care;

legal entities to which functions of editorial offices of the state media are assigned;

other legal entities.

Chapter 2. State policy in the field of physical culture and sport

Article 9. State policy in the field of physical culture and sport

1. The purposes of state policy in the field of physical culture and sport are development and support of physical culture and sport.

2. State policy in the field of physical culture and sport is based on the principles:

humanity, democratism, exception of discrimination and violence in the field of physical culture and sport;

general availability, voluntariness, continuity and succession of occupations physical culture and sport;

interactions of subjects of physical culture and sport;

combinations of the state and public regulation and management in the field of physical culture and sport;

respect and observance of the international obligations in the field of physical culture and sport.

3. The main directions of state policy in the field of physical culture and sport are:

creation of conditions to all categories and national groups for occupation physical culture and sport, including material and technical resources for occupation physical culture and sport;

involvement of the population in occupations physical culture and sport;

assistance to forming at athletes and other physical persons playing physical culture and sport, patriotism and national consciousness;

safety when holding sports and improving, sports and mass and sporting events;

physical training of younger generation, assistance to development of school, student's sport;

ensuring preparation of sports reserve, high-class athletes;

ensuring participation of athletes in the international sporting events, forming of national and national teams of the Republic of Belarus on sports (national and technical, aviation, military and applied and office and applied sports national teams), their material, medical, scientific and methodical and (or) other support;

support of the Olympic Movement of Belarus, Paralympic movement of Belarus, deflimpiysky movement of Belarus, special Olympic Movement of Belarus;

counteraction to dope in sport and fight against it;

development of the sports recognized in the Republic of Belarus;

promotion of physical culture and sport;

providing conditions for creation and functioning of the organizations of physical culture and sport, other legal entities (their associations) performing activities in the field of physical culture and sport;

providing conditions for functioning of the physical persons performing activities in the field of physical culture and sport;

ensuring medical observation of the state of health of the athletes and other physical persons playing physical culture and sport;

preparation, retraining and advanced training of personnel in the field of physical culture and sport;

carrying out research and development in the field of physical culture and sport;

financing of physical culture and sport at the expense of means republican and (or) local budgets, creation of conditions for attraction of financial resources of physical persons and legal entities for financing of physical culture and sport;

implementation of international cooperation in the field of physical culture and sport, integration into the international sports community;

ensuring accomplishment of standard rates of the state social standards on servicing of the population in the field of physical culture and sport established by Council of Ministers of the Republic of Belarus.
