About approval of Rules of issue of veterinary documents on subjects to the state veterinary health control
In pursuance of the subitem 9) of article 1 of the Law of the Republic of Kazakhstan of July 10, 2002 "About veterinary science" I ORDER:
1. Approve the enclosed Rules of issue of veterinary documents on subjects to the state veterinary health control.
2. Recognize to invalid:
1) the subitem 2) Item 1 of the order of the Deputy prime minister of the Minister of Agriculture of the Republic of Kazakhstan of November 15, 2002 No. 372 "About approval of regulatory legal acts in the field of veterinary science" (registered in the Register of state registration of regulatory legal acts for No. 2087);
2) the order of the Minister of Agriculture of the Republic of Kazakhstan of May 20, 2008 No. 318 "About introduction of amendments to the order of the Minister of Agriculture of the Republic of Kazakhstan of November 15, 2002 No. 372 "About approval of regulatory legal acts in the field of veterinary science" (registered in the Register of state registration of regulatory legal acts for No. 5227, published in the Collection of acts of the central executive and other central state bodies of the Republic of Kazakhstan, 2008, No. 8).
3. To development department of livestock production and veterinary safety of the Ministry of Agriculture of the Republic of Kazakhstan (Tokseitova R. A.) in the procedure established by the legislation to provide state registration of this order in the Ministry of Justice of the Republic of Kazakhstan.
4. This order becomes effective after ten calendar days after day of its first official publication.

1. These rules of issue of veterinary documents on subjects to the state veterinary health control (further - Rules), are developed according to the subitem 9) of article 1 of the Law of the Republic of Kazakhstan of July 10, 2002 "About veterinary science", regulate single procedure for the organization of work on registration and issue of veterinary documents on subjects to the state veterinary health control.
2. In rules the following concepts are used:
1) department - the central office of Committee of the state inspection in agro-industrial complex of the Ministry of Agriculture of the Republic of Kazakhstan exercising veterinary health control;
2) permission - sequence number in the Register of import permits, the import, transit of the moved (transported) objects appropriated by department of authorized body on the moved (transported) objects in case of their import;
3) the veterinary and sanitary conclusion - the document certifying compliance (discrepancy) of subject to the state veterinary health control to veterinary (veterinary and sanitary) rules, requirements and regulations, and also to regulations of process design, construction projects, reconstruction and modernization of object;
4) the veterinary certificate - the document existing in the Republic of Kazakhstan and for export on the moved (transported) object certifying veterinary and sanitary safety;
5) the veterinary reference - the document issued by the veterinarian of division of local executive body of the city of district value, the settlement, aul (village), aulny (rural) district on animal, about epizootic situation in the territory of the corresponding administrative and territorial unit;
6) the importing country - the country of final purpose of controlled goods;
7) the exporting country (exporting country) - the country from which controlled goods go to the importing country;
8) the transit country - the state through which territory controlled goods follow to the importing country;
9) competent authority - body of the country of the exporter authorized to issue the veterinary document certifying safety of the exported products;
10) animal - agricultural, house, wild, mammals, birds, bees, fishes, Amphibia, insects and other representatives of fauna;
11) the breeding certificate - the document issued by the certified breeding plant, breeding economy, the breeding center, the distribyyuterny center, confirming origin, productivity and other qualities of breeding animal, and also genetic origin of parents and quality of seed or embryo;
12) batch - quantity of the transported (moved) subject of one name, with identical date of development, made (made) by one producer in identical conditions and delivered at the same time;
13) the owner - physical persons and legal entities, the individual entrepreneurs who addressed for issue of veterinary documents;
14) individual identification number - the unique number created for physical person, including the individual entrepreneur performing activities in the form of personal entrepreneurship (further - IIN);
15) business - identification number - the unique number created for the legal entity (branch and representation) and the individual entrepreneur performing activities in the form of joint venture (further - the BIN);
16) veterinary control post - the division of department of authorized body located in the territory of border and customs clearance stations (check points through Frontier of the Republic of Kazakhstan), equipped with the necessary equipment and devices, exercising veterinary health control of the moved (transported) objects.
3. Requirements of these rules extend for execution by officials, representatives to perform registration and issue of veterinary documents, the physical persons and legal entities occupied with content, cultivation, procurement (slaughter), production, conversion, transportation, storage and realization of the moved (transported) objects.
4. Execution of the veterinary and sanitary conclusion, veterinary certificate and veterinary reference is performed free of charge, the payment is levied for the form of the required veterinary document on its actual cost at the time of issue with transfer of the arriving means in budget receipt according to the tax legislation of the Republic of Kazakhstan.
5. The form of the veterinary document and root number by typographical method, identical number, provide with degree of protection at the level of security.
6. Forms of veterinary documents are numbered by symbols and figures and have the following designations:
the first two symbols - warranty code of the Republic of Kazakhstan (the two-letter reduced name corresponding to the Isomezhdunarodnoy code of standardization organization);
the third figure - warranty code of area;
the fourth figure - warranty code of the area;
the fifth figure - sequence number of the document.
7. Forms of veterinary documents are considered invalid: the corrections filled with different ink, handwriting, font, having, are not certified by seal, having not clear impress of a seal, in case of lack of date of issue, full name of position, initials of the official who issued the veterinary document, signatures in case of discrepancy to requirements of Item 6 of these rules.
8. Corrections bring in the text only by deletion, at the same time near correction the seal is appended, the legible signature also is entered by copy-book surname, name, middle name of the official who made correction.
9. In forms of veterinary documents accounting number of object of production, individual number of animal, except cases when it does not practice (for example is specified, when moving daily chickens).
10. Forms of the veterinary and sanitary conclusion, the veterinary reference, the veterinary certificate are drawn up in the state and Russian languages, the veterinary certificate - in addition in English.
11. Accounting of forms of veterinary documents, is carried out on an equal basis with documents of the strict reporting, the issued second copies of the veterinary and sanitary conclusion, roots of the veterinary certificate, the veterinary references are subject to storage within 3 years.
12. The veterinary and sanitary conclusion is issued by the chief state veterinary health inspector of the city of republican value, the capital and his deputy, the state veterinary health inspector of the area (the city of regional value) by results of the state veterinary health control, in form, according to appendix 1 to these rules.
13. The chief state veterinary health inspector of the city of republican value, the capital and his deputy, the state veterinary health inspector of the area (the city of regional value) the list of the state veterinary health inspectors to which the right of execution of the veterinary and sanitary conclusion is provided affirms.
14. Physical persons and legal entities (further - the owner), for receipt of the veterinary and sanitary conclusion in writing (the statement of any form) address the state veterinary health inspector (responsible for registration) the relevant territorial subdivision of department of authorized body in the field of veterinary science of the city of republican value, the capital, the area (the city of regional value) with indication of:
for physical persons - surname, name, middle name, IIN and the address of subject to the state veterinary health control:
for legal entities - names, the BIN, addresses of subject to the state veterinary health control, its profile;
Enclose the following documents to the application:
for physical person - the copy of the identity document;
for legal entities - the copy of the certificate on state registration (re-registration);
the appraisal certificate of veterinary laboratories about the conducted necessary laboratory researches.
The paragraph of the eighth is excluded according to the Order of the Minister of Agriculture of the Republic of Kazakhstan of 03.05.2011 No. 08-3-233
15. The term of execution of the veterinary and sanitary conclusion no more than five working days from the date of receipt of the statement.
16. The state veterinary health inspector responsible for registration from the moment of the address of the owner of object:
checks completeness (correctness) of the submitted documents;
registers in the magazine of registration of statements;
on specifying of the chief state veterinary health inspector of the city of republican value, the capital and his deputy, state veterinary health inspector of the area (city of regional value) from the moment of registration of a statement transfers to the state veterinary health inspector for conducting inspection.
17. State veterinary health inspector:
performs inspection of object of the state veterinary control;
checks object compliance to the submitted documents;
checks compliance to veterinary (veterinary and sanitary) rules, requirements and regulations, and in case of production commissioning of the object to regulations of process design, construction projects, reconstruction and modernization of object;
draws up the act of inspection and together with document package submits for consideration to the chief state veterinary health inspector of the city of republican value, the capital and his deputy, the state veterinary health inspector of the area (the city of regional value) for decision making.
18. The chief state veterinary health inspector of the city of republican value, the capital and his deputy, the state veterinary health inspector of the area (the city of regional value) within one working day takes out one of the following decisions:
issues the veterinary and sanitary conclusion about compliance of object of the state veterinary control to veterinary (veterinary and sanitary) rules, requirements and regulations, in case of issue on object of production to regulations of process design, construction projects, reconstruction and modernization of object;
issues the veterinary and sanitary conclusion about discrepancy of object with issue of the recommendation in elimination of the revealed violations.
Is the reason of discrepancy of object of the state veterinary control:
establishment not of compliance of object of the state veterinary control to veterinary (veterinary and sanitary) rules, requirements and regulations;
lack of complete (correct) document package, exhaustive information in the submitted documents on compliance of object of the state veterinary control to veterinary (veterinary and sanitary) rules, requirements and regulations, and also to requirements, the these rules specified in Item 14;
change (deterioration) of epizootic situation of the place of origin (stay) of object of the state veterinary control on infectious diseases of animals.
19. The veterinary and sanitary conclusion is constituted in duplicate, the first copy is issued to the owner or the head (representative) of object, and the second copy remains at the Chief state veterinary health inspector and his deputy who issued this document.
20. Veterinary certificates of form No. 1, 2 and 3 are issued according to the list constituted according to the appendix 2 and forms specified in appendix 3 to these rules on each batch of the moved (transported) object and are valid for the period of transportation of the moved (transported) object to destination.
21. The veterinary certificate is issued by the chief state veterinary health inspector of the city of republican value, the capital and his deputy, the state veterinary health inspector of the area (the city of regional value) on the moved (transported) subjects to the state veterinary health control. The chief state veterinary health inspector of area approves the list (further - the list) the state veterinary health inspectors to whom the right of issue of the veterinary certificate to the moved (transported) object on the corresponding territorial administrative unit is allowed (the area, the city of regional or republican value, the capital).
The list (further - the approved list) the state veterinary health inspectors to whom the right of issue of the veterinary certificate to export is allowed is approved with the chief state veterinary health inspector of the Republic of Kazakhstan.
The impress of a seal and specimen signatures of the state veterinary health inspectors to which the right to sign in issue of the veterinary certificate is allowed is posted on the website of the Ministry of Agriculture of the Republic of Kazakhstan.
22. The veterinary certificate is issued taking into account division of the territory into zones. The veterinary certificate on the moved (transported) objects from unsuccessful zone is not issued.
23. When moving animals in quantity to 5 heads record about them, with indication of nickname and individual number of animal, and also floor, breed, age is brought directly in the veterinary certificate of form No. 1.
When transporting animals in number of more than 5 heads the inventory certified by seal and the signature of the state veterinary health inspector who issued the above-named certificate is attached to the veterinary certificate.
24. When moving (transportation) of subject to the state veterinary health control in the Republic of Kazakhstan execution of the veterinary certificate or written motivated refusal are made in day of the address of the owner to the state veterinary health inspector included in the list.
The owner addresses in writing (the statement of any form) till the expected beginning of movement with indication of:
for physical persons - surname, name, middle name, IIN, the address, individual number of animal, when moving animal (except fishes, bees, amphibiouses, insects) and products of animal origin - individual number of animal;
for legal entities - names, the BIN, addresses, accounting number of object of the production issued by department when moving animal (except fishes, bees, amphibiouses, insects) and products of animal origin - individual number of animal;
names of the moved (transported) object;
quantities of the moved (transported) object, units of its measurement;
the mode of transport assumed to use in transit the moved (transported) object;
route of the moved (transported) object;
the movement purposes (for live animals - cultivation and content, sale, slaughter on meat; for products - on realization, conversion; for forages and feed additives - type of animals to which it is intended);
destination in the territory of the Republic of Kazakhstan with indication of the objects of production performing storage (conversion, realization) the moved (transported) object, and their accounting number.
Enclose the following documents to the application:
when transporting breeding animals - the copy of the breeding certificate;
in transit animal - the veterinary passport of animal or the veterinary reference;
when transporting products and animal raw materials происхожденияакт examinations of veterinary laboratories about the conducted necessary laboratory researches.
The state veterinary health inspector determines completeness of the submitted documents on compliance to veterinary health requirements and safety requirements, registers the statement in the magazine of registration of the moved (transported) objects, studies the appraisal certificate of laboratory of veterinary and sanitary examination or division of production supervision, performs inspection of the moved (transported) object, carries out assessment of veterinary and sanitary condition of the vehicle.
In case of establishment of compliance of the moved (transported) object to veterinary health requirements and safety requirements the veterinary certificate is issued for maintenance to destination.
The paragraph the seventeenth is excluded according to the Order of the Minister of Agriculture of the Republic of Kazakhstan of 03.05.2011 No. 08-3-233
The basis for refusal in issue of the veterinary certificate on the moved (transported) object are:
unsuccessful zone;
provision by the owner of incomplete and doubtful data;
discrepancy of the moved (transported) object, the vehicle to veterinary health requirements and safety requirements.
25. On the moved (transported) object exported from the Republic of Kazakhstan to other states the veterinary certificate according to requirements of the exporting country is issued. Before export of the moved (transported) object the import permit issued by department of authorized body is drawn up. The owner (exporter) in case of receipt of the export permit not later than 3 working days prior to transportation addresses the state veterinary health inspector included in the approved list.
The owner (exporter) addresses in writing (the statement of any form) till the expected beginning of movement with indication of:
for physical persons - surname, name, middle name. IIN, addresses, individual number of animal, when moving animal (except fishes, bees, amphibiouses, insects) and products of animal origin - individual number of animal;
for legal entities - names, the BIN, addresses, accounting number of object of the production issued by department when moving animal (except fishes, bees, amphibiouses, insects) and products of animal origin - individual number of animal;
names of the moved (transported) object;
quantities of the moved (transported) object, units of its measurement;
the exporting country and destination of the moved (transported) object;
the mode of transport assumed to use when exporting of the moved (transported) object;
route of the moved (transported) object, with indication of check points on frontier through which it is supposed to perform transportation of the moved (transported) object;
the export purposes (for live animals - cultivation and content, sale, slaughter on meat; for products - on realization, conversion; for forages and feed additives - type of animals to which it is intended);
numbers and dates of permission, issued by the Chief state veterinary health inspector of the Republic of Kazakhstan or his deputy.
Enclose the following documents to the application:
when moving breeding animals - the copy of the breeding certificate;
in transit animal - the veterinary passport of animal or the veterinary reference;
when transporting products and animal raw materials происхожденияакт examinations of veterinary laboratories about the conducted necessary laboratory researches.
The state veterinary health inspector determines completeness of the submitted documents on compliance to veterinary health requirements and safety requirements, registers the statement in the magazine of registration of the moved (transported) objects, studies the appraisal certificate of laboratory of veterinary and sanitary examination or division of production supervision, performs inspection of the moved (transported) object, assessment of veterinary and sanitary condition of the vehicle.
In case of establishment of compliance of the moved (transported) object to veterinary health requirements and safety requirements the veterinary certificate is issued for maintenance to destination.
When crossing border of the Republic of Kazakhstan by the state veterinary health inspector of veterinary control post by results of documentary, physical and, if necessary, laboratory control, the corresponding stamp in the graph of the veterinary certificate is put.
The basis for refusal in issue of the veterinary certificate on the moved (transported) object is:
unsuccessful zone;
provision by the owner of incomplete and doubtful data;
discrepancy of the moved (transported) object, the vehicle to veterinary health requirements and safety requirements;
lack of the import permit.
26. The moved (transported) object arriving to the Republic of Kazakhstan from other states to final destination is affected by the veterinary certificate of the exporting country in which graph there is stamp "Import is resolved".
27. On tanning and fur raw materials the veterinary certificate is issued only after their branding, based on the appraisal certificate of the state veterinary laboratory.
28. In the absence of clear prints of brand on the meat, tanning and fur raw materials which are exported out of the limits of the area, area, republic issued on their export veterinary certificates are considered as invalid.
29. The veterinary reference is drawn up in day of the address which is issued on animal, proceeding from availability of the veterinary passport and individual number of animal, results of veterinary survey of animal, and also on products and the raw materials received from this animal by results of veterinary survey of products and raw materials, epizootic situation in the territory of the corresponding administrativnoterritorialny unit.
The veterinary reference is issued within the administrative and territorial unit territory - the city of district value, the settlement, the aul (village), the aulny (rural) district and drawn up in form according to appendix 4 to these rules.
The veterinary reference issued on animal and products of its slaughter is valid within 3 days, for the milk from animal directed to the milk-processing companies within a month from the moment of issue. In case of change of epizootic situation of the place of exit of animal and his products, earlier issued veterinary reference is withdrawn before liquidation of infectious disease.
30. The official (head) of division of local executive body of the city of district value performing activities in the field of veterinary science approves the list of veterinarians which grants the right of issue of the veterinary reference. The impress of a seal and specimen signatures of veterinarians from the list are transferred to the relevant division of authorized body.
31. The owner transporting the moved (transported) objects sees the veterinarian of division of local executive body of the city of district value, the settlement, aul (village), the aulny (rural) district performing activities in the field of veterinary science in the place of origin of object.
32. The veterinarian on the basis of results of the laboratory researches which are available in the database on identification of farm animals, the veterinary passport, and also assessment of epizootic situation of the territory at the time of the address issues the veterinary reference. In case of slaughter of animal on the lethal platform performs veterinary inspection of animal and products of its slaughter with the subsequent branding of meat. On skin of animal after slaughter attaches in the right upper corner the label (made of nerazmokayemy material) on which individual number of animal is specified indelible ink.
The veterinarian issues motivated refusal in issue of the veterinary reference in the following cases:
to unsuccessful zone;
detection of disease of infectious nature;
lack of individual number of animal;
discrepancy of the moved (transported) object, the vehicle to veterinary health requirements and safety requirements.
33. On tanning and fur raw materials the veterinary reference is issued in the presence of label where individual number of animal is specified.

ПЕРЕЧЕНЬ

1. Все виды животных (сельскохозяйственных, домашних, диких,
зоопарковых, морских, промысловых пушных, цирковых, лабораторных и
др.).
2. Все виды птиц (домашних, диких, декоративных).
3. Пчелы, коконы шелкопряда, пригодные для разматывания.
4. Декоративные насекомые, земноводные, пресмыкающиеся и рептилии.
5. Рыбы (в т.ч. декоративные), лягушки, раки, морские
беспозвоночные и другие гидробионаты, винные улитки для содержания и
разведения.
6. Оплодотворенная икра, эмбрионы, зиготы, сперма животных.
7. Инкубационное яйцо.
8. Живые корма для рыб(в т.ч. гамарус, артемия салина).
На перемещаемые (перевозимые) объекты,
на которые выдается ветеринарный сертификат формы № 2
1. Мясо в тушах, полутушах, четвертинах, блоках, полученное от
домашних, диких и морских животных и птиц и продукты его переработки
(полуфабрикаты), разрешенные к употреблению в пищу.
2. Субпродукты убоя животных, шпик, жиры нетопленные и топленные,
кровь сушенная и консервированная и другие продукты продовольственного
назначения.
3. Сырокопченые, вяленые, соленые, вареные, варено-копченые,
полукопченые мясные продукты.
4. Пищевой альбумин, желатин, казеин.
5. Молоко и молочные продукты.
6. Консервы мясные, рыбные, молочные.
7. Мед пчелиный.
8. Рыба, ракообразные, другие гидробионаты и продукты их
переработки для пищевых целей.
9. Яйцо птиц товарное, яичный порошок и яичный меланж.
На перемещаемые (перевозимые) объекты,
на которые выдается ветеринарный сертификат формы № 3
1. Эндокринное сырье.
2. Кишечное сырье.
3. Субпродукты непищевые.
4. Рогокопытное сырье невыделанное, в том числе кости.
5. Кожевенное и пушномеховое сырье.
6. Волос(щетина, шерсть, пух, перо, очесы, линька).
7. Мездра и обрезки кожсырья.
8. Альбумин, казеин и желатин технические.
9. Желчь.
10. Воск, прополис, мерва, маточное молоко, яд пчелиный.
11. Яд змеиный.
12. Сырье для биологической промышленности.
13. Охотничьи трофеи.
14. Муляжи, музейные препараты, коллекции и предметы
коллекционирования по зоологии, анатомии и палеонтологии животных.
15. Корма животного происхождения.
16. Премиксы, кормовые добавки.
17. Продукты микробиологического синтеза кормового назначения.
18. Другие корма при вывозе за пределы субъекта таможенного союза
или по требованию владельца получателя) или госветслужбы территорий
(стран) транзита, в том числе растительного происхождения, и корма для
домашних животных.
