About modification and amendments in some orders

I ORDER:

1. Make the following changes and amendments to some orders:

1) in the order of the Acting Minister of ecology, geology and natural resources of the Republic of Kazakhstan of June 29, 2021 No. 221 "About approval of Rules of trade in carbon units" (it is registered in the Register of state registration of regulatory legal acts at No. 23719) the following change:

The rules of trade in carbon units approved by the specified order to be reworded as follows according to appendix 1, to this order;

2) in the order of the Minister of ecology, geology and natural resources of the Republic of Kazakhstan of July 14, 2021 No. 251 "About approval of Rules of forming and maintaining the state register of carbon units" (it is registered in the Register of state registration of regulatory legal acts at No. 23555) the following changes and amendments:

The rules of forming and maintaining the state register of carbon units approved by the specified order to be reworded as follows according to appendix 2, to this order;

3) in the order of the Minister of ecology, geology and natural resources of the Republic of Kazakhstan of January 14, 2022 No. 12 "About approval of Rules of carrying out validation and verification" (it is registered in the Register of state registration of regulatory legal acts at No. 26587) the following changes and amendments:

in the Rules of carrying out validation and verification approved by the specified order:

in Item 2:

state subitem 9-1) in the following edition:

"9-1) verifier - the competent and impartial person responsible for carrying out verification and the report on verification;";

add with subitem 9-2) of the following content:

"9-2) Body for validation and verification within market mechanisms of the Parisian agreement - the legal entity accredited at the international level according to decisions of the Meeting of the Parties of the Parisian agreement including under control of supervisory authority of the mechanism of item 4 of article 6 of the Parisian agreement;";

10) to state the subitem in the following edition:

"10) verification - the systematic, independent and documentary drawn up process of assessment of conformity to the requirements established by international standards and the legislation of the Republic of Kazakhstan, and confirmation of reliability of the data specified in the inventory report of greenhouse gases and in the report on projects implementation on emission reduction or increase in absorption of greenhouse gases, projects of market mechanisms of the Parisian agreement;";

19) to state the subitem in the following edition:

"19) the plan of monitoring of the subject of quoting - the document containing the data necessary for implementation of monitoring of emissions of greenhouse gases of the quota installation, constituted in form according to Item 1 of article 293 of the Ecological code of the Republic of Kazakhstan;".

4) in the order of the Minister of ecology, geology and natural resources of the Republic of Kazakhstan of March 28, 2022 No. 91 "About approval of Rules of state regulation in the field of emissions and absorption of greenhouse gases" (it is registered in the Register of state registration of regulatory legal acts at No. 27301) the following amendment and change:

in Rules of state regulation in the field of emissions and absorption of the greenhouse gases approved by the specified order:

add with Item 87-3 of the following content:

"87-3. The operator of system no later than the day preceding expiry date of units of carbon quota stipulated in Item the 8th article 289 of the Code, performs transfer of outstanding units of carbon quota from the current National plan in the subsequent National plan.";

state Item 90 in the following edition:

"90. The operator of system annually withdraws units of carbon quota specified in Item 89 of these rules.

The operator of system annually withdraws units of carbon quota on the basis of the verified reports registered in accordance with the established procedure within 10 (ten) working days after registration date of reports on the following formula:

I = ((At - X) x Z) x K, where:

I - amount of the withdrawn carbon quota;

At - the value of amount of products used for calculation of carbon quota for installation for one year according to the existing National plan;

X - the confirmed products amount specified in the verified report for the previous accounting year;

Z - benchmark;

K - the coefficient of reducing carbon quota applied to calculation of carbon quota for installation for one year according to the existing National plan.";

2. To provide to department of climatic policy of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan;

3) within ten working days after state registration in the Ministry of Justice of the Republic of Kazakhstan of this order submission to Department of legal service of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Ecology and Natural Resources of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication, except for the fourth paragraph of the subitem 4) of Item 1, which becomes effective on September 29, 2026.
