The higher education - the level of the main education reached on the basis of general secondary education, or vocational training with general secondary education, or secondary vocational education during the consecutive and purposeful training process and education providing training of qualified specialists, development of capabilities and intellectual and creative potential of the personality, and coming to the end with final assessment by results of which the corresponding qualification, and also the master's degree in the cases provided by this Law are appropriated.
1. The legislation of the Republic of Belarus on the higher education is based on the Constitution of the Republic of Belarus and consists of acts of the President of the Republic of Belarus, the Law of the Republic of Belarus of October 29, 1991 "About education" (Vedamasts? Vyarkho¸naga of Council Respubl? to? Belarus, 1991, No. 33, Art. 598; National register of legal acts of the Republic of Belarus, 2002, No. 37, 2/844), this Law and other acts of the legislation of the Republic of Belarus.
2. If the international treaty existing for the Republic of Belarus establishes other rules, than those which contain in this Law then are applied rules of the international treaty.
3. Features of creation, functioning of educational institutions, including military faculties of the higher educational institutions providing training with the higher education for Armed Forces of the Republic of Belarus, other troops and military forming of the Republic of Belarus (further - the highest military educational institutions), law-enforcement bodies, bodies and divisions on emergency situations, and also feature of such preparation are determined according to acts of the President of the Republic of Belarus, this Law and other legislation of the Republic of Belarus.
4. The public relations in the field of postgraduate education, and also the public relations connected with passing by graduates of higher educational institutions of training, internship, their training in clinical internship are not regulated by the legislation of the Republic of Belarus on the higher education.
1. State policy in the field of the higher education is based on the principles determined by the Law of the Republic of Belarus "About education" and is aimed at providing:
1.1. the rights of citizens to obtaining on competitive basis of the higher education in higher educational institutions, including at the expense of means of the republican budget in the state higher educational institutions;
1.2. qualities of the higher education;
1.3. provisions of the first workplace to graduates of the state higher educational institutions according to the labor law of the Republic of Belarus;
1.4. developments of international cooperation in the field of the higher education.
2. The state creates conditions for development of system of the higher education, including by means of:
2.1. assistance to functioning and development of higher educational institutions;
2.2. financings of the state higher educational institutions.
3. Organizational basis of realization of state policy in the field of the higher education are the state programs of development of the higher education approved by the Government of the Republic of Belarus.
1. In the Republic of Belarus everyone has the right on competitive basis of the higher education, and also to liberty of choice of higher educational institution, specialty (specialization), form of receipt of the higher education according to the legislation of the Republic of Belarus, international treaties existing for the Republic of Belarus.
2. On competitive basis of the higher education at the expense of means of the republican budget in the state higher educational institutions the citizens of the Republic of Belarus, foreign citizens and persons without citizenship who are constantly living in the Republic of Belarus and also other foreign citizens and stateless persons according to the legislation of the Republic of Belarus, international treaties existing for the Republic of Belarus have the right.
The system of the higher education in the Republic of Belarus includes:
the higher educational institutions and other organizations providing functioning and development of system of the higher education;
republican state bodies and local executive and administrative organs, other state bodies and other organizations under which supervision higher educational institutions, within their powers in the field of the higher education are;
participants of educational process;
the educational standards of the higher education developed on their basis curricula and training programs.
