1. Bring in the order of the Minister of investments and development of the Republic of Kazakhstan of April 30, 2015 No. 551 "About approval of Rules of technical operation and repair of civil aircrafts of the Republic of Kazakhstan" (it is registered in the Register of state registration of regulatory legal acts for No. 11573) the following changes:

2. To provide to committee of civil aviation of the Ministry of transport of the Republic of Kazakhstan in the established legislative procedure:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of transport of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Transport of the Republic of Kazakhstan.

4. This order becomes effective after sixty calendar days after day of its first official publication.

Rules of technical operation and repair of civil aircrafts of the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules of technical operation and repair of civil aircrafts of the Republic of Kazakhstan (further - Rules) are developed according to subitem 41-24) of Item 1 of article 14 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further - the Law) and determine procedure for technical operation and repair of civil aircrafts of the Republic of Kazakhstan.

2. In these rules the following terms and determinations are applied:

1) aviation product - the aircraft, the aircraft engine, the air screw of the aircraft or the component intended for installation on them;

2) the organization for maintenance and repair of the aircraft equipment (further - the organization for TO and PAT) - the legal entity or structural division of the legal entity which is performing the maintenance and (or) repair of the aircraft equipment and having the existing certificate of the organization for maintenance and repair of the aircraft equipment;

3) aspects of human factor - the principles applicable to design processes, certification, trainings, maintenance and operational activities in aircraft and aimed at ensuring safe interaction between the person and other components of system by means of proper accounting of opportunities of the person;

4) authorized organization in the field of civil aviation (further - authorized organization) - the joint-stock company with absolute participation of the state in the authorized capital performing the activities aimed at providing sustainable development of industry of civil aviation of the Republic of Kazakhstan, safety of flights and aviation safety;

5) the state developer - the state having jurisdiction concerning the organization responsible for design like the aircraft, Item of remote piloting, the engine or the air screw;

6) operational maintenance of AF is maintenance which is performed in use by AF. Operational maintenance includes identification and elimination of refusals and defects, elimination of defects, and if necessary - replacement of components with use of the external checking equipment (including replacement of such components as engines and screws), and also the maintenance directed to identification of the obvious unsatisfactory conditions, discrepancies and defects which are not requiring conducting profound checks. Operational maintenance covers the internal design, systems and elements of the power plant available via quickly opening panels, doors or illuminators, and also includes the repair, modification and other categories of maintenance which are not requiring extensive disassembly and carried out by simple methods;

7) the aircraft (further - AF) - the device supported in the atmosphere due to its interaction with air excepting interaction with the air reflected from land (water) surface;

8) the program of maintenance of AF (further - the AF program) - the document containing the description of specific planned works on maintenance and frequency of their accomplishment, and also the related procedures including the program of reliability, the corresponding AF, necessary for ensuring safe operation;

9) management on flight operation of the aircraft - the management acceptable for the state of the operator and including operations procedure in regular, special and emergency situations, control cards, restrictions, information on flight technical characteristics and data on systems of the aircraft, and also the materials connected with operation of the aircraft;

10) the minimum list of the equipment (further - MEL) - the list providing operation of AF in certain conditions in case of refusal of specific component of the equipment which is constituted by the operator according to the standard minimum list of the equipment for the AF this type or in case of its absence on the basis of the management on flight operation developed for the AF type by the organization responsible for standard design and approved by the state of the AF developer;

11) repair - recovery of the flight validity of AF, the engine, air screw or the corresponding part after their damage or depreciation according to airworthiness standards;

12) periodic maintenance - maintenance of AF, except operational maintenance;

13) extensive fatigue damages (WFD) - simultaneous availability of cracks in several places of design of AF which size and density specify to decrease in residual durability of design below of the established requirements;

14) commercial air transportation - activities of legal entities for transportation of passengers, baggage, loads and mailings by civil aircrafts for a fee or on hiring according to the agreement of airborne transportation;

15) the list of variations from configuration (further - CDL) - the list constituted by the organization responsible for standard design, approved by the state of developer, determining all external parts of standard AF which can be absent at the beginning of flight, and containing, if necessary, data on the corresponding operational restrictions and changes of flight technical characteristics;

16) modification - change of design of the AF type, the engine or air screw;

17) operational documentation - documentation regulating flight and technical operation of AF, including their maintenance and repair, and also containing service conditions and operational restrictions;

18) component with finite useful life - component, for which in standard design, in obligatory information on maintenance of the flight validity or in instructions for maintenance of the flight validity fixed term of obligatory replacement (in hours, cycles or calendar time) on reaching which or before its achievement the component is subject to conclusion from operation;

19) the operator - the physical person or legal entity which is engaged in operation of civil AF or offering the services in this area;

20) the state of the operator - the state in which there is the main place of activities of the operator, and in the absence of such place of activities - the permanent place of stay of the operator;

21) component with limited resource - component, for which in standard design, in obligatory information on maintenance of the flight validity or in instructions for maintenance of the flight validity fixed term of obligatory replacement (in hours, cycles or calendar service life) on reaching which or before its achievement the component is subject to removal from operation;

22) the certifying personnel - the personnel responsible for the admission of AF or component to operation after maintenance accomplishment;

23) maintenance (further - THAT) - work on AF, the Item of remote piloting, the engine, the air screw or component necessary for maintenance of the flight validity of AF, the engine, the air screw or component, including control recovery work, checks, replacements, elimination of defects which are carried out as separately, and in combination, and also practical implementation of modification or repair;

24) the state of registration - the state in which register it is entered by AF;

25) the directive on the flight validity - the document determining aviation products which condition is unsafe or in which such condition can take place or develops in other products of the same standard design, and ordering corrective actions, conditions or restrictions, obligatory for accomplishment, in case of which further operation of the specified products is allowed;

26) requirements of the flight validity - the requirement of the flight validity of civil AF of the Republic of Kazakhstan (further - requirements of the flight validity) - the comprehensive and detailed requirements of the flight validity established for the considered class AF, the engine or the air screw;

27) maintenance of the flight validity - set of the processes providing compliance of AF, Item of remote piloting, the engine, air screw or component to the existing requirements to the flight validity and their maintenance in the condition corresponding to conditions of safe operation throughout the term of their service;

28) accounting data on maintenance of the flight validity - the accounting data relating to the status of the flight validity of the aircraft equipment;

29) obligatory information on maintenance of the flight validity - mandatory requirements on modification accomplishment, replacement of components or inspection of AF and modification of operational restrictions and procedures for safe operation of AF, including the directives of the flight validity issued by authorized organization, the state of developer, the state of registration or the state of developer of modification;
