About modification of the order of the Minister of ecology, geology and natural resources of the Republic of Kazakhstan of July 30, 2021 No. 280 "About approval of the Instruction on the organization and carrying out ecological assessment"

I ORDER:

1. Bring in the order of the Minister of ecology, geology and natural resources of the Republic of Kazakhstan of the Republic of Kazakhstan of July 30, 2021 No. 280 "About approval of the Instruction on the organization and carrying out ecological assessment" (it is registered in the Register of state registration of regulatory legal acts for No. 23809) the following change:

in the Instruction on the organization and carrying out the ecological assessment approved by the specified order:

to be reworded as follows appendix 3 to the Instruction on the organization and carrying out ecological assessment, according to appendix to this order.

2. To provide to department of ecological culture and policy of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on official Internet resource of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Ecology and Natural Resources of the Republic of Kazakhstan.

4. This order becomes effective since September 8, 2026 and is subject to official publication.

Contents of the Section "Environmental protection" as a part of the project documentation of the planned activities

1. Assessment of impacts on condition of atmospheric air:

1) the characteristic of climatic conditions necessary for assessment of impact of the planned activities on the environment;

2) the characteristic of the current state of the air circle (the list of the pollutants which are thrown out in atmospheric air with indication of their actual concentration in atmospheric air in comparison with ecological standard rates of quality or target indicators of quality of atmospheric air, and before their approval - with hygienic standard rates, on the available materials of natural measurements);

3) sources and scales of settlement chemical pollution: in case of the maximum loading of the equipment provided by the project, and also in case of possible volley and emergency emissions. Calculations of the expected pollution of atmospheric air are carried out taking into account the companies (objects) and the existing background pollution operating, under construction and planned to construction;

4) implementation of low-waste and wasteless technologies, and also the special events for prevention (reducing) of emissions in atmospheric air providing observance in the field of impact of the planned activities of ecological standard rates of quality of atmospheric air or target indicators of its quality, and before their approval - hygienic standard rates;

5) determination of standard rates of admissible emissions of pollutants for objects for objects I and II of categories according to the Technique of determination of standard rates of issues to the environment approved by the order of the Minister of ecology, geology and natural resources of March 10, 2021 No. 63 (it is registered in the Register of state registration of regulatory legal acts for No. 22317) (further - the Technique);

6) calculations of number of emissions of pollutants in the atmosphere made with observance of article 202 of the Code for the purpose of filling of the declaration on impact on the environment for category objects III;

7) assessment of effects of pollution and action for decrease in negative impact;

8) offers on the organization of monitoring and control of condition of atmospheric air;

9) development of actions for regulation of emissions in the period of especially adverse weather conditions providing observance of ecological standard rates of quality of atmospheric air or target indicators of its quality, and before their approval - hygienic standard rates.

2. Assessment of impacts on condition of waters:

1) the need for water resources for the planned activities for construction and operation, the quality requirement of the used water;

2) characteristic of source of water supply, its economic use, location of water intake, its characteristic;

3) water balance of object, with obligatory specifying of dynamics of annual amount of the taken-away fresh water, as main indicator of ecological system effectiveness of water consumption and water disposal;

4) surface water:

hydrographic characteristic of the territory;

the characteristic of the water objects which are potentially affected by the planned activities (with use of these observation alignments as close as possible), in comparison with ecological standard rates or target indicators of quality of waters, and before their approval - with hygienic standard rates;

the hydrological, hydrochemical, ice, thermal, high-speed modes of water flow, the modes of deposits, the dangerous phenomena - flood floodings, jams, sludge ice availability, the wind-induced phenomena;

assessment of possibility of withdrawal of normative reasonable amount of water from superficial source in the natural mode, without additional regulation of drain;

need and procedure for the organization of zones of sanitary protection of sources of drinking water supply;

quantity and the characteristic of the dumped sewage (with indication of the place of dumping, design features of release, the list of pollutants and their concentration);

reasons for the greatest possible implementation of turnover systems, reuse of sewage, methods of utilization of rainfall of treatment facilities;

offers on achievement of standard rates of maximum permissible dumpings which part shall be:

assessment of impact of the planned object on the water circle in the course of its construction and operation, including possible thermal pollution of reservoir and effect of impact of selection of water on ecosystem;

assessment of changes of the river-bed processes connected with laying of constructions, constructions of bridges, water intakes and identification of negative effects;

the water preserving actions, their efficiency, cost and priority of realization;

recommendations about the organization of production monitoring of impact on superficial water objects;

5) underground waters:

hydrogeological parameters of the description of the area, availability and the characteristic of the reconnoitered fields of underground waters;

the description of the current state of the operated water-bearing horizon (chemical composition, operational inventories, security), providing conditions for its safe operation, need of the organization of zones of sanitary protection of water intakes;

object impact assessment in the period of construction and operation on quality and amount of underground waters, probability of their pollution;

analysis of effects of possible pollution and depletion of underground waters;

reasons for actions for protection of underground waters against pollution and depletion;

recommendations about the organization of production monitoring of impact on underground waters;

6) determination of standard rates of admissible dumpings of pollutants for objects I and II of categories according to the Technique;

7) calculations of number of dumpings of pollutants into the environment made with observance of item 4 of article 216 of the Code for the purpose of filling of the declaration on impact on the environment for category objects III.

3. Assessment of impacts on subsoil:

1) availability of mineral and raw material resources in zone of impact of the planned object (inventories and quality);

2) the need of object for mineral and raw material resources in the period of construction and operation (types, amounts, obtaining sources);

3) forecasting of impact of production of mineral and raw material resources for different components of the environment and natural resources;

4) reasons for nature protection actions for regulation of the water mode and to use of the broken territories;

5) when carrying out transactions on subsurface use, production and conversion of minerals the following materials are represented:

the characteristic of the used fields (inventories of minerals, their geological features and another);

the materials confirming possibility of extraction and realization of harmful components, and for the most toxic - method of their burial;

the radiation characteristic of the minerals and overburden breeds (which are especially used for recultivation and in production of construction materials);

recommendations about structure and placement of regime network of wells for studying, control and assessment of condition of rocks and underground waters in use objects of the planned construction;

the offers on the greatest possible extraction of minerals from subsoil excluding decrease in inventories of underground minerals on the neighboring sites and around their production (as a result of flood, aeration, oxidation, ignition);

assessment of possibility of burial of hazardous substances and production wastes in subsoil.

4. Environmental impact assessment of production wastes and consumption:

1) types and amounts of formation of waste;

2) features of pollution of the territory production wastes and consumption (dangerous properties and physical condition of waste);

3) recommendations about waste management: to accumulating, collection, transportation, recovery (preparation of waste for reuse, conversion, waste recycling) or removal (burial, destruction), and also auxillary operations: to sorting, processing, neutralization); technologies for accomplishment of the specified transactions;

4) types and amount of the production wastes and consumption (formed, accumulated and transferred to the specialized organizations for waste management), subject to inclusion in the declaration on impact on the environment.

5. Assessment of physical impacts on the environment:

1) assessment possible thermal, electromagnetic, noise, impact and other types of impact, and also their effects;

2) the characteristic of radiation situation around works, identification of natural and technogenic sources of radiation pollution.

6. Assessment of impacts on land resources and soils:

1) condition and conditions of land use, land balance of the territory planned for placement of object and adjacent farms according to property type, the offered changes in land management, calculation of losses of agricultural production and losses of owners of the parcels of land and land users who are subject to compensation during creation and operation of object;

2) the characteristic of the current state of the soil in zone of impact of the planned object (the soil card with site class points, water and physical, chemical properties, pollution, violation, erosion, deflation, fertility and mechanical structure of soils);

3) the characteristic of the expected impact on the soil (mechanical violations, chemical pollution), the change of properties of soils and soil in zone of influence of object as a result of change of geochemical processes, creation of new forms of relief caused by re-planning of surface of the territory, activation of natural processes, pollution by production wastes and consumption;

4) the planned actions and project decisions in impact zone on removal, transportation and storage of fertile layer of earth and overburden breeds, on preserving the soil on the sites which are not affected by direct activities on recovery of the broken soil and reduction of the territory in the condition suitable for initial or other use (technical and biological recultivation);

5) organization of environmental monitoring of soils.

7. Impact assessment on vegetation:

1) the current state of vegetable cover in zone of impact of object (the geobotanical card, floristic structure, functional value, productivity of vegetable communities, their natural dynamics, fire danger, availability of the medicinal, rare, endemic and included in the Red List types of plants, condition of green plantings, impurity and prevalence of plants; the successions happening as a result of modern anthropogenous impact on vegetation);

2) the characteristic of factors of the habitat of the plants influencing their condition;

3) the characteristic of impact of object and the accompanying productions on vegetable communities of the territory, including through impact on the habitat of plants; threat to rare, endemic species of plants in zone of influence of the planned activities;

4) reasons for amounts of use of vegetable resources;

5) determination of zone of influence of the planned activities on vegetation;

6) the expected changes in vegetable cover (specific structure, condition, productivity of communities, assessment of adaptivity of genotypes, economic and functional value, impurity, prevalence wreckers), in the action area of object and effect of these changes for life and health of the population;

7) recommendations about preserving vegetable communities, to improvement of their condition, preserving and reproduction of flora, including on preserving and improvement of the circle of their dwelling;

8) actions for prevention of negative impacts on biodiversity, its minimization, mitigation, loss estimate of biodiversity and action for their compensation, and also for monitoring of holding these actions and their efficiency.

8. Assessment of impacts on fauna:

1) initial condition of water and land fauna;

2) availability of the rare, disappearing and included in the Red List animal species;

3) the characteristic of impact of object on specific structure, fauna number, its gene pool, the habitat, conditions of reproduction, way of migration and the place of concentration of animals in the course of construction and operation of object, assessment of adaptivity of types;

4) possible violations of integrity of natural communities, habitats, reproduction conditions, impact on the ways of migration and the place of concentration of animals, reducing their specific variety in zone of impact of object, assessment of effects of these changes and caused environmental damage;

5) actions for prevention of negative impacts on biodiversity, its minimization, mitigation, loss estimate of biodiversity and action for their compensation, monitoring of holding these actions and their efficiency (including monitoring of noise levels, environmental pollution, unpleasant smells, impacts of light, other negative impacts on animals).

9. Assessment of impacts on landscapes and measures for prevention, minimization, mitigation of negative impacts, to recovery of landscapes in cases of their violation.

10. Assessment of impacts on the social and economic circle:

1) modern social and economic living conditions of local population, characteristic of its labor activity;

2) security of object in the period of construction, operation and liquidation by manpower, participation of local population;

3) influence of the planned object on regional and territorial environmental management;

4) the forecast of changes of social and economic living conditions of local population in case of implementation of project solutions of object (under normal conditions operation of object and possible emergencies);

5) sanitary and epidemiologic condition of the territory and the forecast of its changes in result of the planned activities;

6) offers on regulation of the social relations in the course of the planned economic activity.

11. Assessment of environmental risk of realization of the planned activities in the region:

1) the value of natural complexes (functional value, especially protected objects), resistance of the allocated complexes (landscapes) to impact of the planned activities;

2) complex assessment of effects of impact on the environment in case of normal (without accidents) the mode of operation of object;

3) probability of emergencies (taking into account technological level of object and availability of natural hazards), at the same time sources, types of emergencies, their repeatability, impact zone are determined;

4) the forecast of effects of emergencies for the environment (including real estate and objects of historical and cultural heritage) and the population;

5) recommendations about the prevention of emergencies and liquidation of their effects.
