According to Item 3 of article 48 of the Ecological code of the Republic of Kazakhstan of January 2, 2021 I ORDER:

1. Approve the Instruction on the organization and carrying out ecological assessment.

2. To provide to department of environmental policy and sustainable development of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and this Item.

3. Recognize invalid some orders of the Minister of environmental protection of the Republic of Kazakhstan, the acting minister of environmental protection of the Republic of Kazakhstan and the Minister of Energy of the Republic of Kazakhstan according to appendix to this order.

4. To impose control of execution of this order on the supervising vice-minister of ecology, geology and natural resources of the Republic of Kazakhstan.

5. This order becomes effective from the date of its first official publication and extends to the legal relationship which arose since July 1, 2021.

Instruction on the organization and carrying out ecological assessment

Chapter 1. General provisions

1. This Instruction on the organization and carrying out ecological assessment (further - the Instruction) is developed according to Item 3 of article 48 of the Ecological code of the Republic of Kazakhstan of January 2, 2021 (further - the Code) and determines the organization and carrying out ecological assessment.

2. In the Instruction the following terms and determinations are used:

1) ecological assessment - process of identification, studying, the description and assessment of possible straight lines and indirect essential impacts of realization of the planned and performed activities or the developed document for the environment. Types of ecological assessment are strategic ecological assessment, environmental impact assessment, assessment of cross-border impacts and ecological assessment on the simplified procedure;

2) strategic ecological assessment - the process of identification, studying, the description and assessment on the basis of the corresponding researches of possible essential impacts of implementation of state programs in the industries listed in Item 3 of article 52 of the Code, development programs of the territories and master plans of settlements (further - Documents) on the environment including stages, stipulated in Article 53 Codes;

3) environmental impact assessment - the process of identification, studying, the description and assessment on the basis of the corresponding researches of possible essential impacts on the environment in case of realization of the planned activities including stages, stipulated in Article 67 Codes;

4) assessment of cross-border impacts - process of identification, studying, the description and assessment on the basis of the corresponding researches of possible essential negative impacts, in the area which is under jurisdiction of one state (the mentioned party) from source which is connected with implementation of the plan, the program or the planned activities and is physically located under jurisdiction of other state (the party of origin);

5) ecological assessment on the simplified procedure - type of ecological assessment which is carried out for the planned and performed activities which are not subject according to the Code, obligatory environmental impact assessment, in case of project development of standard rates of issues for objects I and II of categories, and also in case of development of the Section "Environmental protection" as a part of the project documentation on the planned activities and by preparation of the declaration on impact on the environment.

Chapter 2. Organization of ecological assessment

3. The organization of ecological assessment includes the organization of process of identification, studying, the description and assessment of possible straight lines and indirect essential impacts (further - essential impacts) realization of the planned and performed activities or the developed Document for the environment.
