About Regulations on service by the ordinary and commanding structure of law-enforcement bodies of the Republic of Tajikistan

1. Approve Regulations on service by the ordinary and commanding structure of law-enforcement bodies of the Republic of Tajikistan it (is applied).

2. Declare invalid the order of the Government of the Republic of Tajikistan of April 5, 2005 No. 137 "About approval of the Regulations on service by the ordinary and commanding structure of law-enforcement bodies of the Republic of Tajikistan".

Regulations on service by the ordinary and commanding structure of law-enforcement bodies of the Republic of Tajikistan

1. General provisions

1. The regulations on service by the ordinary and commanding structure of law-enforcement bodies of the Republic of Tajikistan (further – the Provision) regulate procedure and conditions of service in law-enforcement bodies of the Republic of Tajikistan (further – law-enforcement bodies), determine legal status of staff of these bodies.

2. The person who is only the citizen of the Republic of Tajikistan, being on service to whom according to the procedure, established by this Provision, the special rank of the private or the commanding structure is given is considered the employee of law-enforcement bodies.

3. The employee of law-enforcement bodies carries out obligations according to the Constitution of the Republic of Tajikistan, other regulatory legal acts of the Republic of Tajikistan, the international legal acts recognized by Tajikistan, the Law of the Republic of Tajikistan "About militia" and this Provision.

4. The staff of law-enforcement bodies, as well as other citizens of the Republic of Tajikistan have all rights, stipulated by the legislation the Republic of Tajikistan, and also perform the duties of citizens of the Republic of Tajikistan provided by the Constitution of the Republic of Tajikistan, other regulatory legal acts of the Republic of Tajikistan and the international legal acts recognized by Tajikistan.

5. On duty the employee of law-enforcement bodies, and also members of his family is under protection of the state. Nobody, except bodies and the officials who are directly authorized on that by the Law having the right to interfere with activities of the employee of law-enforcement bodies which performs the office activities according to requirements of the legislation of the Republic of Tajikistan.

6. The employee of law-enforcement bodies is made responsible for non-compliance with office discipline, execution and legality according to the procedure, established by the legislation of the Republic of Tajikistan.

7. The employee of law-enforcement bodies has the right on:

- acquaintance with the documents determining its rights and obligations by post, the quality criterions of service and conditions of job development and other conditions necessary for execution of service duties by it;

- in case of need to obtain information and the materials necessary for accomplishment of service duties;

- make in accordance with the established procedure suggestions for improvement of service and the legislation of the Republic of Tajikistan;

- make decisions within office powers;

- participation on the initiative in tender, on substitution of vacant position;

- participate in republican tenders and based on the consent of relevant organs to leave the countries for advanced training;

- taking into account qualification, professional capabilities and level of execution of the service duties to be appointed to higher positions;

- examine materials of the personal record except for of archive part and materials of special check;

- be involved in elementary training, retraining and advanced training;

- according to the procedure, established by the legislation to receive financial, material and social security taking into account service length, length of service and the state of health;

- require conducting office investigation for confutation of the data discrediting his honor and advantage;

- have the rights to labor protection, social protection, health protection and other provided privileges according to the procedure, established by the legislation;

- require ensuring social, legal and labor protection, and also protection of life and health of members of the family from threats;

- address to higher bodies of internal affairs (the management which is directly authorized by the Minister of Internal Affairs of the Republic of Tajikistan (further - the Minister of Internal Affairs) for permission of questions of human rights violation) or to court for the dispute resolution, connected with service.

8. The rights and other service duties of the employee are determined according to the legislation of the Republic of Tajikistan, the employment contract on service in law-enforcement bodies and the approved job description.

9. Chiefs (commanders) are forbidden to make the orders and orders which do not have relations to execution of service duties or contradicting the legislation of the Republic of Tajikistan.

10. Chiefs (commanders) who made illegal orders and orders are made responsible according to the legislation of the Republic of Tajikistan.

11. Cancellation or changes of the decision made by the employee when implementing service duties does not form the basis for attraction it to responsibility if they were not result of deliberate violation of the law.

12. For the solution of special tasks on protection of law and order and fight against crime the staff of law-enforcement bodies temporarily is involved in service to different regions of the republic.

13. Proceeding from need of ensuring effective fulfillment of the tasks and obligations assigned to law-enforcement bodies with the consent of the staff of law-enforcement bodies according to the legislation of the Republic of Tajikistan they can be attached to public authorities and other organizations with preserving the privileges provided to them.

14. The list of positions ordinary, younger, average and the senior commanding structure and special ranks corresponding to these positions affirm the Minister of Internal Affairs.

15. The list of the positions replaced by colonels and generals affirms the President of the Republic of Tajikistan on representation of the Minister of Internal Affairs.

16. Qualification requirements to the staff of law-enforcement bodies holding positions of the private and the commanding structure are determined by the Minister of Internal Affairs.

17. For the purpose of completion of law-enforcement bodies by highly qualified specialists the Ministry of Internal Affairs of the Republic of Tajikistan (further – the Ministry of Internal Affairs) performs professional training of staff of law-enforcement bodies which includes special initial training, special combat and physical training, including recurring inspection on suitability to actions in the conditions connected using physical force, special means and firearms, training of specialists in educational institutions of advanced training and knowledge of employees.

18. Professional personnel for law-enforcement bodies is prepared by educational institutions of system of the Ministry of Internal Affairs.

19. Listeners and cadets of educational institutions of professional training of structure of the Ministry of Internal Affairs, and also the commanding structure, professors and teachers having special rank of the employee of law-enforcement bodies and performing training of staff of law-enforcement bodies according to the list of positions approved by the Minister of Internal Affairs treat persons, the acting as staff of law-enforcement bodies.

20. The method of the organization and procedure for carrying out professional training are determined by the Minister of Internal Affairs.

2. Procedure for acceptance on service and movements of staff of law-enforcement bodies

21. In law-enforcement bodies only citizens of the Republic of Tajikistan aged from 18 up to 35 years, irrespective of the residence, floor, nationality, race, language, religious beliefs, political views, social position, capable on the personal, moral qualities, mental stability, education, qualification, physical training, the state of health and knowledge of state language to fulfill the assigned service duties of staff of law-enforcement bodies, after passing of compulsory military service at the call of or in the presence of the military ID (except for cadets of educational institutions of system of the Ministry of Internal Affairs and women), on voluntary basis are employed.

22. For persons passing to service into law-enforcement bodies from other power and law enforcement agencies, age restrictions do not extend.

23. For study in educational institutions of higher education of the Ministry of Internal Affairs and abroad citizens of the Republic of Tajikistan aged from 17 up to 25 years and in secondary vocational education institutions aged from 15 up to 25 years, having the main, general or secondary professional education are accepted. Citizens of other states are accepted on the basis of interstate agreements.

24. The staff of law-enforcement bodies, and also persons having special ranks with addition "in inventory" or "in resignation" lose special rank according to the court verdict in case of condemnation for making of heavy or especially serious crime.

25 The staff of law-enforcement bodies sent for execution of certain obligations to state bodies or other organizations carries out the obligations on site and remains in personnel reserve of the Ministry of Internal Affairs.
