About modification and amendments in some legal acts of the Republic of Uzbekistan in connection with enhancement of system of public administration in the field of cultural heritage

Within the administrative reforms performed in recent years activities, structure, tasks and functions of authorized republican executive bodies in the field of protection and use of objects of cultural heritage are reviewed, the system of public administration in this sphere was even more enhanced.

With respect thereto there is need of mutual approval of regulatory legal acts and elimination of the available legal gaps by accurate determination of powers of republican executive bodies in the field of protection and use of objects of cultural heritage.

This Law to some legal acts of the Republic of Uzbekistan makes the changes and additions specifying powers of republican executive bodies in the field of protection and use of objects of cultural heritage.

This Law will serve increase in efficiency of activities of system of public administration in the field of cultural heritage, to mutual approval of legal acts and their further enhancement.

Article 1. In the Code of the Republic of Uzbekistan about the administrative responsibility approved by the Law of the Republic of Uzbekistan of September 22, 1994 No. 2015-XII (Sheets of the Supreme Council of the Republic of Uzbekistan, 1995, No. 3, Art. 6; Sheets of Oliy Majlis of the Republic of Uzbekistan, 1995, No. 9, Art. 193, No. 12, Art. 269; 1996, Art. 1) in Article 198-5:

in the name of the word "under the Ministry of tourism and sport" to exclude;

in the name of the word "under the Ministry of tourism and sport" to exclude;

in part one of the word "under the Ministry of tourism and sport" to exclude.

Article 2. In the Law of the Republic of Uzbekistan of August 29, 1998 No. 678-I "About export and import of cultural values" (Sheets of Oliy Majlis of the Republic of Uzbekistan, 1998, No. 9, Art. 178; Sheets of chambers of Oliy Majlis of the Republic of Uzbekistan, 2005, No. 9, Art. 309; 2011, No. 12/2, of Art. 363; 2013, No. 4, Art. 98; 2014, No. 9, Art. 244; 2017, No. 6, Art. 300; 2018, No. 4, Art. 224; 2021, appendix to No. 4) to make the following changes:

1) in Article 5:

in part one of the word "Ministry of Culture of the Republic of Uzbekistan and State Customs Committee of the Republic of Uzbekistan" shall be replaced with words "The agency of cultural heritage of the Republic of Uzbekistan and Customs committee under the Ministry of Economics and finance of the Republic of Uzbekistan";

in paragraph one of part two of the word Ministry of Culture shall be replaced with words "The agency of cultural heritage";

Ministry of Culture shall be replaced with words 2) in part one of Article 7 of the word "The agency of cultural heritage";

Ministry of Culture shall be replaced with words 3) in part one of Article 10 of the word "The agency of cultural heritage";

Part the second Article 17 to state 4) in the following edition:

"Representation of cultural values on the public biddings (auctions) is performed in coordination with the Agency of cultural heritage of the Republic of Uzbekistan. The legal entities participating in realization of cultural values perform the activities with the notification of the Agency of cultural heritage of the Republic of Uzbekistan in accordance with the established procedure".

Article 3. In the Law of the Republic of Uzbekistan of August 30, 2001 No. 269-II "About protection and use of objects of cultural heritage" (Sheets of Oliy Majlis of the Republic of Uzbekistan, 2001, No. 9-10, of Art. 180; 2004, No. 5, Art. 90; Sheets of chambers of Oliy Majlis of the Republic of Uzbekistan, 2005, No. 9, Art. 309; 2009, No. 10, Art. 381; 2013, No. 4, Art. 98; 2017, No. 6, Art. 300; 2018, No. 4, Art. 224; 2021, appendix to No. 4; 2022, No. 5, Art. 464, No. 6, Art. 577; 2025, No. 12, of the Art. 1329) to make the following additions and changes:

The text of article 5 after words "The Ministry of Culture of the Republic of Uzbekistan" to add 1) with words ", the Agency of cultural heritage of the Republic of Uzbekistan";

The text of Article 7 to state 2) in the following edition:

"Ministry of Culture of the Republic of Uzbekistan:

exercises the state control of observance by legal entities and physical persons of the legislation on protection and use of objects of non-material cultural heritage;

participates in development and implementation of state programs of protection, preserving, promoting and use of objects of non-material cultural heritage;

provides identification, accounting, protection, promoting and use of objects of non-material cultural heritage;

performs coordination of activities of republican executive bodies concerning protection and use of objects of non-material cultural heritage;

keeps the List of objects of non-material cultural heritage;

will organize and performs historical and cultural examination of objects of non-material cultural heritage;

performs other powers according to the legislation";

To add 3) with Article 7-1 of the following content:

"Article 7-1. Powers of the Agency of cultural heritage of the Republic of Uzbekistan in the field of protection and use of objects of cultural heritage

Agency of cultural heritage of the Republic of Uzbekistan:

exercises the state control of observance by legal entities and physical persons of the legislation on protection and use of objects of material cultural heritage;

participates in development and implementation of state programs of protection, preserving, promoting and use of objects of material cultural heritage;

realizes state programs on scientific and scientific and technical research, preservation, restoration and the device for modern use of objects of material cultural heritage;

provides identification, accounting, protection, promoting and use of objects of material cultural heritage;

performs coordination of activities of state bodies concerning protection and use of objects of material cultural heritage;

keeps the State inventory of objects of material cultural heritage;

will organize and performs historical and cultural examination of objects of material cultural heritage;

performs other powers according to the legislation.";

4) in Article 12:

state part one in the following edition:

"Inclusion of the objects which are of historical and cultural value in the State inventory of objects of material cultural heritage is performed by the Agency of cultural heritage of the Republic of Uzbekistan, and inclusion in the List of objects of non-material cultural heritage - the Ministry of Culture of the Republic of Uzbekistan based on offers of public authorities on places, and also legal entities and physical persons";

in part five of the word Ministry of Culture shall be replaced with words "The agency of cultural heritage";

Ministry of Culture shall be replaced with words 5) in part one of Article 14 of the word "The agency of cultural heritage";

Part the second Article 15 to state 6) in the following edition:

"Historical and cultural examination of objects of material cultural heritage will be organized and performed by the Agency of cultural heritage of the Republic of Uzbekistan, and historical and cultural examination of samples of non-material cultural heritage - the Ministry of Culture of the Republic of Uzbekistan";

The text of Article 18 to state 7) in the following edition:

"The Ministry of Culture of the Republic of Uzbekistan, public authorities on places shall control condition of the objects of cultural heritage included in the List of objects of non-material cultural heritage.

The agency of cultural heritage of the Republic of Uzbekistan, public authorities on places shall control condition of the objects of cultural heritage included in the State inventory of objects of material cultural heritage and also once in five years conduct examination of condition and fixing of objects of material cultural heritage for the purpose of development of the current and perspective programs for their preserving";

8) in part seven of Article 20 of the word Ministry of Culture shall be replaced with words "The agency of cultural heritage";

Part third of Article 21 to replace 9) with parts three and the fourth the following content:

"The decision on reconstruction of the lost object of non-material cultural heritage at the expense of means of the Government budget of the Republic of Uzbekistan is made by the Cabinet of Ministers of the Republic of Uzbekistan on representation of the Ministry of Culture of the Republic of Uzbekistan based on the conclusion of historical and cultural examination of objects of cultural heritage taking into account opinions of the interested bodies and the organizations.

The decision on reconstruction of the lost object of material cultural heritage at the expense of means of the Government budget of the Republic of Uzbekistan is made by the Cabinet of Ministers of the Republic of Uzbekistan on representation of the Agency of cultural heritage of the Republic of Uzbekistan based on the conclusion of historical and cultural examination of objects of cultural heritage taking into account opinions of the interested bodies and the organizations.";

10) in Article 22:

state part one in the following edition:

"Conducting researches of archaeological monuments is allowed only in the presence of the permissions issued by the Agency of cultural heritage of the Republic of Uzbekistan";

in word part three to Ministry of Culture shall be replaced with words to "The agency of cultural heritage";

11) in paragraph three of Article 24 of the word of Ministry of Culture shall be replaced with words "The agencies of cultural heritage";

Ministry of Culture shall be replaced with words 12) in part one of Article 25 of the word "The agency of cultural heritage";

Ministry of Culture shall be replaced with words 13) in part one of Article 31 of the word "The agency of cultural heritage".

Article 4. In the Law of the Republic of Uzbekistan of September 12, 2008 No. ZRU-177 "About the museums" (Sheets of chambers of Oliy Majlis of the Republic of Uzbekistan, 2008, No. 9, Art. 483; 2013, No. 4, Art. 98; 2017, No. 6, Art. 300; 2018, No. 4, Art. 224; 2021, appendix to No. 4, No. 10, Art. 968, No. 11, Art. 1064; 2025, No. 12, of the Art. 1329) to make the following changes:

1) in Article 5:

in the name of the word of Ministry of Culture shall be replaced with words "The agencies of cultural heritage";

in paragraph one of the word Ministry of Culture shall be replaced with words "The agency of cultural heritage";

2) in part one of Article 12 of the word of Ministry of Culture shall be replaced with words "The agencies of cultural heritage";

Ministry of Culture shall be replaced with words 3) in part two of Article 15 of the word "The agency of cultural heritage";

Ministry of Culture shall be replaced with words 4) in part five of Article 23 of the word "The agency of cultural heritage".

Article 5. Article 6. In part one of article 76 of the Town-planning code of the Republic of Uzbekistan, No. ZRU-676 approved by the Law of the Republic of Uzbekistan of February 22, 2021 (The sheet of chambers of Oliy Majlis of the Republic of Uzbekistan, 2021, No. 2, Art. 145; 2022, No. 6, Art. 570, 577, No. 11, Art. 1061; 2023, No. 10, Art. 795, No. 11, Art. 923, No. 12, Art. 1010; 2024, No. 8, Art. 830, 831, No. 9, Art. 961; 2025, No. 2, of the Art. 188, No. 5, of the Art. 643, No. 12, of the Art. 1329) to make the following changes:

in paragraph five of the word of Ministry of Culture shall be replaced with words "The agencies of cultural heritage";

in paragraph seven of the word of Ministry of Culture shall be replaced with words "The agencies of cultural heritage".

Article 7. In part seven of article 35 of the Law of the Republic of Uzbekistan of October 31, 2024 No. ZRU-987 "About subsoil" (Sheets of chambers of Oliy Majlis of the Republic of Uzbekistan, 2024, No. 11, of the Art. 1185) of the word Ministry of Culture shall be replaced with words "The agency of cultural heritage".

Article 8. To provide to the agency of cultural heritage, the Ministry of Justice of the Republic of Uzbekistan and other interested organizations execution of this Law, finishing it to contractors, and also explanation of its essence and value among the population.

Article 9. To the Cabinet of Ministers of the Republic of Uzbekistan:

bring the orders of the Government into accord with this Law;

provide review and cancellation by republican executive bodies of the regulatory legal acts contradicting this Law.

Article 10. This Law becomes effective from the date of its official publication.
