About modification of some orders of the Government (regarding the procedure of provision of shelter and functioning of the Center of placement)

Based on part (1) article 7 of the Law No. 270/2008 on shelter in the Republic of Moldova (The official monitor of the Republic of Moldova, 2009, Art. No. 53-54, 145), with subsequent changes, DECIDES: the Government

1. The provision of the Center of placement approved by the Order of the Government No. 1023/2012 (2013, 30), with subsequent changes, to state the official monitor of the Republic of Moldova to Art. No. 1-5, in the following edition:

Provision of the Center of placement

Chapter I. General provisions

1. The provision of the Center of placement (further - the Provision) establishes procedure for the organization and functioning of the Center of placement (further - the Center), regulations and ensuring its safety, the right and obligation of the placed persons, the relations between the placed faces and personnel of the Center, and also other rights and obligations of his employees.

2. For the purposes of this provision the concepts determined in the Law No. 270/2008 on shelter in the Republic of Moldova are used (further - the Law No. 270/2008), and also the following concept:

temporary access - the measure for preliminary placement in the isolation center of the Center applied as preliminary stage before performing medical examination and decision about placement.

3. The center is the specialized structure without the status of the legal entity submitting to the General inspectorate on the migration of the Ministry of Internal Affairs (further - the Inspectorate) intended for temporary placement of the following categories of persons:

3.1. the persons who are petitioning for provision of shelter, not having sufficient means of content according to part provisions (1) article 28-1 of the Law 270/2008, and also person, petitioning for provision of shelter on which within the procedure on provision of shelter the decision which took legal effect is not made;

3.2. persons petitioning for provision of shelter on whom the decision on application of measure for placement in the Center according to Item b was made) parts (1) article 64-1 of the Law No. 270/2008;

3.3. members of families of persons petitioning for provision of shelter on whom the decision on application of the measure provided in Item b was made) parts (1) article 64-1 of the Law No. 270/2008, for the purpose of preserving unity of family and respect for the principle of the highest interests of the child;

3.4. persons using international protection according to the Law No. 274/2011 on integration of foreigners in the Republic of Moldova (further - the Law No. 274/2011);

3.5. the persons using political asylum, requesting placement in the Center.

4. The center provides:

4.1. acceptance, temporary access and placement of categories of persons provided in Item 3;

4.2. safety of persons placed in the Center;

4.3. safety of the material values transferred to storage according to Item 43;

4.4. the organization and implementation of cultural and educational, sports, entertaining and creative activities by means of the centers of creativity operating in the Center;

4.5. provision of legal consultation and legal assistance through representatives of the High Commissioner of the United Nations for refugees and national or international non-profit organizations with which agreements on cooperation were signed;

4.6. cooperation with the Ministry of Labour and Social Protection, with the Ministry of Health and other competent organizations / bodies for the purpose of rendering public, psychological and medical care according to provisions of the Law No. 274/2011 and Item 37 of the Order of the Government No. 720/2025 on approval of the mechanisms and methodology applied in the procedure of provision of shelter (procedure for granting of material conditions of acceptance to persons petitioning for provision of shelter, expense estimation methodology on providing material conditions of acceptance, and also the mechanism of application of the concept of the safe country of origin / the safe third country) (further - the Order of the Government No. 720/2025).

5. The person using international protection, requesting the placement and not concordant with conditions of placement or with the rights and obligations provided by this Provision having the right to submit the declaration of abandonment of placement.

6. The inspectorate provides to representatives of national or international non-profit organizations with whom agreements on cooperation, access to the Center and necessary space for proper implementation of activities for consultation were signed.

7. The center is financed by the assignments from the government budget approved for the Ministry of Internal Affairs and also from other sources of financing which do not violate the law.

8. The inspectorate provides continuous training of personnel of the Center, being obliged to observe according to provisions of the legislation the principles of confidentiality, equality and nondiscrimination concerning any information obtained when implementing activities.
