About approval of the mechanisms and methodology applied in the procedure of provision of shelter (procedure for granting of material conditions of acceptance to persons petitioning for provision of shelter, expense estimation methodology on providing material conditions of acceptance, and also the mechanism of application of the concept of the safe country of origin / the safe third country)

Based on part (2) Article 28-1, of part (1) Article 63-1 and part (1) article 63-2 of the Law No. 270/2008 on shelter in the Republic of Moldova (The official monitor of the Republic of Moldova, 2009, Art. No. 53-54, 145), with subsequent changes, DECIDES: the Government

1. Approve:

1.1. Procedure for granting of material conditions of acceptance to persons petitioning for provision of shelter according to appendix No. 1;

1.2. Expense estimation methodology on providing the material conditions of acceptance provided to persons petitioning for provision of shelter according to appendix No. 2;

1.3. The mechanism of establishment and application of concepts of safe country of source and the safe third country, the list of safe countries of source and the safe third countries, according to appendix No. 3.

2. To enable the realization of provisions of this resolution at the expense of means of the annual government budget, budget of the General inspectorate for migration of the Ministry of Internal Affairs, and also other sources, stipulated by the legislation.

3. This resolution becomes effective since January 1, 2026.

Procedure for granting of material conditions of acceptance to persons petitioning for provision of shelter

This Mechanism partially shifts (shifts parts (2), (3) and (4) Articles 17, of part (8) and (9) Articles 18, of part (2) - (6) the Art. 20) the Directive of the European parliament and Council 2013/33/EU of June 26, 2013, establishing standards of acceptance of the applicants who made inquiry about provision of international protection (new edition), published in the Official magazine of the European Union by L 180 of June 29, 2013, CELEX: 32013L0033.

I. Material conditions of acceptance

1. The person who is petitioning for provision of shelter, not having funds for content according to the statement has the right to placement in the Center of placement of the General inspectorate for migration (further - the Center), and also on food, clothes and other material benefits, including expenses on use of public transport and expenses on personal hygiene means, within the amounts calculated according to expense estimation Methodology on providing the material conditions of acceptance provided to persons petitioning for provision of shelter.

2. The general inspectorate on migration informs persons petitioning for provision of shelter, in particular persons with special needs on possibility of filing of application about provision of material conditions of acceptance, and also about availability of necessary assistance.

3. The person petitioning for provision of shelter and placed in the Center according to provisions of article 28-1 of the Law No. 270/2008 on shelter in the Republic of Moldova (further - the Law No. 270/2008) has the right to monthly payment on providing with daily food within the following regulations of physiological needs for energy and feedstuffs:

3.1. Kcal 2733,9 - for the able-bodied man petitioning for provision of shelter;

3.2. Kcal 2330,4 - for the able-bodied woman petitioning

about provision of shelter;

3.3. Kcal 2518,6 - for the expectant mother petitioning

about provision of shelter;

3.4. Kcal 2054,8 - for person is more senior than the retirement age petitioning for provision of shelter;

3.5. Kcal 583,7 - for the child aged till 1 year which is together with one or both parents petitioning for provision of shelter;

3.6. Kcal 1702,1 - for the child aged from 1 up to 7 years, being together with one or both parents petitioning for provision of shelter;

3.7. Kcal 2298,2 - for the child aged from 7 up to 18 years, being together with one or both parents petitioning for provision of shelter.
