About modification of the order of the Minister of Internal Affairs of the Republic of Kazakhstan of March 13, 2020 No. 211 "About approval of Rules of selection on initial professional training and conditions of its passing for persons arriving in law-enforcement bodies and also the bases of their assignment from initial professional training"

I ORDER:

1. Bring in the order of the Minister of Internal Affairs of the Republic of Kazakhstan of March 13, 2020 No. 211 "About approval of Rules of selection on initial professional training and conditions of its passing for persons arriving in law-enforcement bodies and also the bases of their assignment from initial professional training" (it is registered in the Register of state registration of regulatory legal acts at No. 20123) the following change:

Rules of selection on initial professional training and conditions of its passing for persons arriving in law-enforcement bodies, and also the bases of their assignment from initial professional training approved by the specified order to be reworded as follows according to appendix to this order.

2. To provide to department on work with staff of the Ministry of Internal Affairs of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan after its official publication;

3) within five calendar days after state registration of this order to provide to Department of legal and rule-making coordination of the Ministry of Internal Affairs of the Republic of Kazakhstan data on execution of the actions provided by Items 1) and 2) of this order.

3. To impose control of execution of this order on the supervising deputy minister of internal affairs of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of selection on initial professional training and conditions of its passing for persons arriving in law-enforcement bodies, and also the bases of their assignment from initial professional training

Chapter 1. General provisions

1. These rules of selection on initial professional training and conditions of its passing for persons arriving in law-enforcement bodies, and also the bases of their assignment from initial professional training (further – Rules) are developed according to Item 2-1 of article 7 of the Law of the Republic of Kazakhstan "About law-enforcement service" (further – the Law) and determine procedure for selection on initial professional training, conditions of its passing for persons arriving in law-enforcement bodies, and also the bases of their assignment from initial professional training.

2. In these rules the following concepts are used:

1) the information automated database (information system) – the hardware and software system providing collection, storage, transfer and information processing, the activities intended for automation connected with planning, selection (documents acceptance) and personnel management concerning revenues to law-enforcement service;

2) personal account – the Section in information system which is created for the specific user after its registration;

3) the candidate – person undergoing selection on initial professional training;

4) the cadet – person enlisted on initial professional training;

5) online proktoring – system of verification of the personality and confirmation of results of passing of online examinations which provides preserving record, recognition and identification of the personality, the analysis of movements of the head and body, with determination of noise level, recognition of multiface, request for record of the room in the mode of 360 degrees, logging of suspicious events.

3. Arrival of candidates for service for law-enforcement bodies (further – Department of Internal Affairs) to positions of the ordinary, younger and average commanding structure is performed after passing of initial professional training by them in the organizations of formation of the Ministry of Internal Affairs of the Republic of Kazakhstan (further – the Ministry of Internal Affairs).

4. Annually the service on work with staff of the Ministry of Internal Affairs till December 1 develops and approves as the Minister of Internal Affairs of the Republic of Kazakhstan (further – the Minister) the schedule of initial professional training the next calendar year based on the submitted applications of services on work with staff of departments of the Ministry of Internal Affairs, the territorial authorities which are under authority of the Ministry of Internal Affairs and its departments, the public institutions which are under authority of the Ministry of Internal Affairs and its departments (further – territorial subdivisions).

Chapter 2. Procedure for selection on initial professional training

5. Candidate screen is performed through information system where the candidate undergoes the corresponding registration by means of individual identification number (further – IIN).

6. In case of registration the candidate confirms the consent to collection and processing of its personal data.

7. After registration the personal account of the candidate is created.

8. During passing of the stages requiring control proktoring online, the candidate:

provides personal participation and absence of strangers;

does not leave the place;

does not turn away from the screen;

does not close the image;

does not switch-off the video camera;

does not speak by phone;

does not use and provides lack of the third-party software allowing to get access to the personal computer by other persons (the program of remote access), audio to set (earphones), auxiliary electronic, printed, paper and other materials, and also objects.

In case non-compliance with the ordered requirements the procedure of selection is subject to the termination, and its results are cancelled.

9. In case of impossibility of passing of stages for the reason which is not depending on the candidate (technical failure of information system, electricity outage or the Internet), the candidate is given the chance of repeated passing of stage within three working days.

10. The candidate who did not pass in information system the stages provided by subitems 3), 6), 7), 9) and 10) of Item 11 of these rules, and also did not be on the stages specified in subitems 4), 5) and 8) of Item 11 of these rules without valid excuse is not allowed to further stages of selection.

11. The organization of work on candidate screen on initial professional training is assigned to service on work with staff and includes number of consecutive stages:

1) publication of the announcement of carrying out selection;

2) documents acceptance from the citizens who showed willingness to take part in selection;

3) verification of documents on reliability and completeness;

4) the direction of candidates for medical examination for the military-medical commissions of Department of Internal Affairs (further – VVK) for determination of the validity to service;

5) passing of polygraphological research;

6) testing delivery;

7) writing of the essay (for positions in divisions of the investigation or of cybercrime counteraction);

8) delivery of standard rates on physical training;

9) holding interview;

10) the direction of the selected candidates for the organizations of formation of the Ministry of Internal Affairs for initial professional training.

12. The candidate makes expenses on participation in selection on initial professional training (journey to the venue of selection and back, passing of medical commission, employment of premises, accommodation) at the expense of own means.

13. Holding interview and delivery of standard rates on physical training are fixed by means of technical means of video.

14. The materials fixed by means of technical means of video are stored in service on work with staff at least one year from the moment of selection completion.

15. The announcement of carrying out selection is placed on Internet resource of the Ministry of Internal Affairs or territorial subdivisions.

16. The announcement contains data on vacant positions and qualification requirements imposed to them, about procedure for revenues to service in Department of Internal Affairs and about conditions of service.

The announcement may contain the additional information which is not contradicting the current legislation of the Republic of Kazakhstan.

17. The citizens of the Republic of Kazakhstan who showed willingness to take part in selection file the following documents through personal account:

1) the statement for the admission to selection which is created by information system and is signed by means of the digital signature;

2) the completed electronic version of the autobiography in form according to appendix 1 to these rules;

3) the electronic document revision about education with appendix;

4) the additional information concerning their education, work experience and professional level (copies of documents on advanced training, assignment of academic (academic) degrees and knowledge, the documents confirming sporting achievements, characteristics, recommendations, scientific publications and other) (in the presence);

5) results of testing for knowledge of the legislation and personal evaluation of the citizens arriving on law-enforcement service.

After signing of the statement for the admission to selection these identity certificates, labor activity, the relation to military service are integrated automatically into information system.

18. In case of submission of documents the candidate needs to fill in in information system data on close relatives (First name, middle initial, last name, IIN, relationship degree) and to confirm the consent to collection and processing of personal data.
