I ORDER:

1. Bring in the order of the Minister of the industry and infrastructure development of the Republic of Kazakhstan of May 30, 2020 No. 323 "About approval of Rules of rendering the state services in the field of subsurface use, except for hydrocarbonic raw material and uranium and about modification and amendments in the order of the Minister of investments and development of the Republic of Kazakhstan of May 17, 2018 No. 339 "About approval of Rules of giving and consideration of the applications on issue of licenses for prospecting" (it is registered in the Register of state registration of regulatory legal acts at No. 20787) the following changes:

To be reworded as follows appendix 1 to the order according to appendix 1 to this order.

2) placement of this order on Internet resource of the Industry ministry and construction of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Industry and construction of the Republic of Kazakhstan.

4. This order becomes effective since July 12, 2026 and is subject to official publication.

Rules of rendering the state service "Registration of the Agreement of Pledge of the Right of Subsurface Use for Investigation, Production or the Combined Exploration and Production for Underground Waters, Therapeutic Muds and Solid Minerals"

Chapter 1. General provisions

1. These rules of rendering the state service "Registration of the Agreement of Pledge of the Right of Subsurface Use for Investigation, Production or the Combined Exploration and Production for Underground Waters, Therapeutic Muds and Solid Minerals" (further - Rules) are developed according to the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state and socially responsible services".

2. The state service "Registration of the Agreement of Pledge of the Right of Subsurface Use for Investigation, Production or the Combined Exploration and Production for Underground Waters, Therapeutic Muds and Solid Minerals" (further - the state service) also appears the Industry ministry and constructions of the Republic of Kazakhstan (further - the service provider) according to these rules.

3. Rules extend on the physical persons and legal entity performing activities in the field of subsurface use (further – uslugopoluchatel).

Chapter 2. Procedure for rendering the state service

4. Uslugopoluchatel for receipt of the state service submits by means of the web portal of "the digital government" www.egov.kz the application signed by the digital signature of uslugopoluchatel in form according to appendix 1 to these rules with application of documents of the main requirements to rendering the state service "Registration of the Agreement of Pledge of the Right of Subsurface Use for Investigation, Production or the Combined Exploration and Production for Underground Waters, Therapeutic Muds and Solid Minerals" specified in Item 10 of the List (further – the List). The list including characteristics of process, form, content and result of rendering, and also other data taking into account features of rendering the state service are stated in annex 2 to these rules.

5. The statement with the enclosed documents is registered in EPN in day of their receipt with assignment of unique accounting number, date and time (hours, minutes) of registration.

In case of the address of uslugopoluchatel after the termination of working hours of the service provider, in days off and holidays according to the labor law of the Republic of Kazakhstan, reception of an application and issue of result of rendering the state service is performed the next working day.

At the same time before signing of the document EPN performs request for the web portal of "the digital government" of www.egov.kz for assignment of number assigned to the electronic document by the state digital system of permissions and notifications (NIKAD).

6. After registration of a statement in EPN in personal account of uslugopoluchatel the status about acceptance of request for rendering the state service with indication of the date of receipt of result of the state service is displayed.

Data on the identity documents of uslugopoluchatel, on state registration (re-registration) of the legal entity containing in the state digital systems, the service provider receives from the corresponding state digital systems through lock of "the digital government".

7. Aggregate term of rendering the state service constitutes 2 (two) working days.

8. The executive in charge checks reliability of the submitted documents specified in Item 10 of the List both issues following and issues the following result of the state service:

1) the registration certificate of pledge of the right of subsurface use in form according to appendix 3 to these rules;

2) motivated refusal in rendering the state service in form according to appendix 4 to these rules, on the bases specified in Item 11 of the List.

The result of rendering the state service goes to uslugopoluchatel to personal account in electronic form, signed by the digital signature (further – the EDS) the authorized person of the service provider.

Registration these statements and result of rendering the state service automatically is registered in the single inventory of the state fund of subsoil.

9. When rendering the state service by means of EPN data on stage of rendering the state service arrive in the automatic mode in digital monitoring system of rendering the state services.

Chapter 3. Procedure for appeal of decisions, actions (failure to act) of the service provider concerning rendering the state services

10. The claim to the decision, actions (bezdeystviye) of the service provider concerning rendering the state services moves to the service provider, in authorized body by assessment and control of quality of rendering the state services according to the legislation of the Republic of Kazakhstan.

The service provider, no later than three working days from the date of receipt of the claim send the claim and administrative case to the body considering the claim.

11. The claim of uslugopoluchatel according to the subitem 2) of article 25 of the Law "About the State and Socially Responsible Services" is subject to consideration:

authorized body - within 5 (five) working days from the date of its registration;

authorized body by assessment and control of quality of rendering the state services – within 15 (fifteen) working days from the date of its registration.

12. The term of consideration of the claim by the service provider, authorized body, authorized body by assessment and control of quality of rendering the state services according to item 4 of article 25 of the Law is prolonged no more than for 10 (ten) working days in need cases:

1) carrying out additional studying or check according to the claim or checks with departure into place;

2) receipts of the additional information.

In case of prolongation of term of consideration of the claim the official given authority on consideration of claims within 3 (three) working days from the moment of prolongation of term of consideration of the claim reports in writing (in case of submission of the claim on paper) or electronic form (in case of submission of the claim in electronic form) to the applicant who made the complaint about prolongation of term of consideration of the claim with indication of the prolongation reasons.

13. In case of disagreement with result of rendering the state service, the uslugopoluchatel takes a legal action according to the subitem 6) of Item 1 of article 4 of the Law of the Republic of Kazakhstan "About the state and socially responsible services".

If other is not provided by the law, appeal to the court is allowed after appeal in pre-judicial procedure.
