About introduction of amendments to some orders

I ORDER:

1. Approve the enclosed list of some orders to which changes are made (further – the List).

2. To provide to department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan.

4. This order becomes effective since July 12, 2026, except for the paragraph of the third and fourth Item 2, of paragraphs two, third, fifth, sixth, thirteenth, fourteenth and thirty third Item 8 of the List which become effective after ten calendar days after day of its first official publication.

Determine that till July 12, 2026 Appendix 3 to the Rules of conducting medico-social examination approved by the order of the Deputy prime minister – the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of June 29, 2023 No. 260 "About approval of Rules of conducting medico-social examination" (it is registered in the Register of state registration of regulatory legal acts at No. 32922) and Appendix 3 to Rules of rendering the state service "Issue of Permission according to the Order Property, to Removal of Pensions, Benefits, the Social Payments Which Arrived into the Account Incapacitated or Restrictedly Capable Full Age Person and on Property Acquisition of the Citizens Recognized by a Court Decision as Incapacitated or It Is Limited by Capable", the approved order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of November 15, 2024 No. 428 "About approval of Rules of rendering the state service "Issue of Permission according to the Order Property, to Removal of Pensions, Benefits, the Social Payments Which Arrived into the Account Incapacitated or Restrictedly Capable Full Age Person and on Property Acquisition of the Citizens Recognized by a Court Decision as Incapacitated or It Is Limited by Capable" (it is registered in the Register of state registration of regulatory legal acts at No. 35384), are effective in edition according to appendices 1 and 2 to the Order.

The list of some orders to which changes are made

1. Bring in the order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of September 3, 2020 No. 353 "About approval of Rules of representation and receipt of data on the employment contract in single system of accounting of employment contracts" (it is registered in the Register of state registration of regulatory legal acts for No. 21173) the following changes:

For submission of data through single digital platform of employment "Electronic employment exchange" the employer registers personal account with confirmation by the digital signature and fills in the necessary data specified in Item 3 of these rules in personal account and sends them to ESUTD, having signed the digital signature.";

"11. With the changes made by the employer in the data provided by Items 9 and 10 of these rules, the worker examines in personal account on the web portal of "the digital government".";

state Items 16 and 17 in the following edition:

"16. The worker receives the data specified in Items 3 and 8 of these rules, containing in ESUTD through personal account of physical person on the web portal of "the digital government" in which these data are reflected automatically within one working day after entering by their employer into ESUTD.

17. The employer receives the data on labor activity of applicants and workers specified in Item 3 of these rules, containing in ESUTD from their prior consent in the presence of integration according to item 4 of these rules.

Prior consent is provided by the applicant and the worker in digital system of staffing of the employer by means of use of the digital signature.".

Bring in the order of the Deputy prime minister – the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of June 29, 2023 No. 260 "About approval of Rules of conducting medico-social examination" (it is registered in the Register of state registration of regulatory legal acts at No. 32922) the following changes:

in the Rules of conducting medico-social examination approved by the specified order:
