About modification of the technical regulation of the Customs union "About safety of machines and the equipment" (TR CU 010/2011)

According to article 52 of the Agreement on the Eurasian Economic Union of May 29, 2014, Item 29 of appendix No. 1 and Item 11 of appendix No. 2 to the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 No. 98, Council of the Eurasian economic commission DECIDED:

1. Bring in the technical regulation of the Customs union "About safety of machines and the equipment" (TR CU 010/2011) accepted by the Decision of the Commission of the Customs union of October 18, 2011 No. 823 (further – the technical regulation), changes according to appendix.

2. Determine that:

a) in the Republic of Armenia and the Kyrgyz Republic concerning products specified in Items 15 – 31 list of objects of technical regulation, subject to confirmation compliance to requirements of the technical regulation of the Customs union "About safety of machines and the equipment" in the form of certification (appendix No. 3 to the technical regulation), confirmation of conformity in the declaration form of compliance till April 1, 2040 is allowed;

b) the provisions provided by the subitem "b" of Item 2, Item 4, subitems "v" and "zh" of Item 7, the subitem "b" of Item 9, Item 11, the subitem "b" of Item 13, the paragraph the sixteenth the subitem "an" and subitems "v" – "" of Item 14, and also Item of 16 changes (appendix to this Decision), are applied in the Republic of Armenia, the Republic of Belarus, the Republic of Kazakhstan and the Kyrgyz Republic since April 1, 2028.

In the Russian Federation before the end of action of the transitional provisions specified in subitems "v" – "д" this Item, the product circulation, released in the Republic of Armenia, the Republic of Belarus, the Republic of Kazakhstan and the Kyrgyz Republic, without application of the provisions specified in paragraph one of this subitem is not limited;

c) the documents on assessment (confirmation) of compliance of products to requirements of the technical regulation accepted (issued) before the date of entry into force of this Decision are valid before the termination of term of their action, but no later than September 1, 2031;

d) till September 1, 2031 production and release into the stream of commerce of products on which are accepted is allowed the documents specified in the subitem "v" of this Item (are issued);

e) the product circulation, released during action of the documents issued on it specified in the subitem "v" of this Item is allowed during the service life of these products established by the manufacturer.

3. Release into the stream of commerce, the address, movement and operation of the products specified in the subitem "an" of Item 2 of this Decision, including which were in operation are allowed only in the territories of the Republic of Armenia or the Kyrgyz Republic respectively. At the same time in the field "Additional information" of the declaration of conformity is specified such products the following record:

"Products are not intended for release into the stream of commerce, the address, movement and operation in the territories of the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation.".

4. This Decision becomes effective since September 1, 2026, except for the subitem "an" of Item 2, of Item 3 of this Decision and Item of 15 changes (appendix to this Decision) which become effective since April 1, 2028.

The changes made to the technical regulation of the Customs union "About safety of machines and the equipment" (TR CU 010/2011)

1. Exclude the preface.

2. In Article 1:

a) Items 1 – 3 to state in the following edition:

"1. This technical regulation establishes obligatory for application and execution on customs area of the Eurasian Economic Union (further – the Union) safety requirements to machines and (or) the equipment and the related processes of development, production, installation, adjustment, operation, storage, transportation, realization and utilization according to appendices No. 1 and 2.
