About adoption of the technical regulation of the Customs union "About safety of machines and the equipment"
According to article 13 of the Agreement on the single principles and rules of technical regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation of November 18, 2010 the Commission of the Customs union (further - the Commission) solved:
1. Accept the technical regulation of the Customs union "About safety of machines and the equipment" (TR CU 010/2011) (is applied).
2. Ceased to be valid according to the Decision of Board of the Eurasian economic commission of 09.03.2021 No. 28
3. Establish:
3.1. The technical regulation of the Customs union "About safety of machines and the equipment" (further - the Technical regulation) becomes effective since February 15, 2013;
3.2. The documents on assessment (confirmation) of compliance to the mandatory requirements established by regulatory legal acts of the Customs union or the legislation of state member of the Customs union, issued or accepted concerning products which are object of technical regulation of the Technical regulation (further - products) about day of entry into force of the Technical regulation, are valid before the termination of term of their action, but no later than March 15, 2015. The specified documents issued or accepted about day of official publication of this Decision are valid before the termination of term of their action.
From the date of entry into force of the Technical regulation issue or adoption of documents on assessment (confirmation) of compliance of products to the mandatory requirements which are earlier established by regulatory legal acts of the Customs union or the legislation of state member of the Customs union is not allowed;
3.3. Till March 15, 2015 production and release into the stream of commerce of products according to the mandatory requirements which are earlier established by regulatory legal acts of the Customs union or the legislation of state member of the Customs union in the presence of the documents on assessment (confirmation) of compliance of products specified to mandatory requirements, issued or accepted about day of entry into force of the Technical regulation is allowed.
The specified products are marked by national mark of conformity (market access mark) according to the legislation of state member of the Customs union or with the Decision of the Commission of September 20, 2010 N 386.
Marking of such products single market circulation mark of gosudarstvchlen of the Customs union is not allowed;
3.3.1. Till November 15, 2013 production and release into the stream of commerce on customs area of the Customs union of products which were not subject about day of entry into force of the Technical regulation to obligatory assessment (confirmation) of compliance to the mandatory requirements established by regulatory legal acts of the Customs union or the legislation of state member of the Customs union without documents on obligatory assessment (confirmation) of compliance and not marked national mark of conformity (market access mark) is allowed;
3.4. The product circulation, released during action of the documents on assessment (confirmation) of compliance specified in subitem 3.2 of this Decision, and also products specified in subitem 3.3.1 of this Decision is allowed during the service life of products established according to the legislation of state member of the Customs union.
4. To the secretariat of the Commission jointly with the Parties to prepare the draft of the Actions plan, necessary for implementation of the Technical regulation, and in three-months time from the date of entry into force of this Decision to provide representation it on approval of the Commission in accordance with the established procedure.
5. To provide to the Russian side with participation of the Parties based on monitoring of results of application of standards preparation of offers on updating of lists of the standards specified in Item 2 of this Decision and representation at least once a year from the date of entry into force of the Technical regulation in the Secretariat of the Commission for approval by the Commission in accordance with the established procedure.
6. To the parties:
6.1. to date of the introduction of the Technical regulation in force to determine the state control (supervision) bodies responsible for implementation of the state control (supervision) of observance of requirements of the Technical regulation and to inform on it the Commission;
6.2. provide carrying out the state control (supervision) of observance of requirements of the Technical regulation from the date of the introduction it in force.

Preface
1. This technical regulation is developed according to the Agreement on the single principles and rules of technical regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation of November 18, 2010.
2. This technical regulation is developed for the purpose of establishment on single customs area of the Customs union single obligatory for application and execution of requirements to machines and (or) the equipment in case of development (designing), production, installation, adjustment, operation, storage, transportation, realization and utilization, the ensuring free movement of machines and (or) the equipment released on single customs area of the Customs union.
3. If concerning machines and (or) the equipment other technical regulations of the Customs union, technical regulations of Eurasian economic community (further - EurAsEC) establishing requirements to machines and (or) the equipment are accepted, then machines and (or) the equipment shall conform to requirements of these technical regulations of the Customs union, EurAsEC which action extends to them.
1. This technical regulation extends to machines and (or) the equipment issued in the address on single customs area of the Customs union.
2. This technical regulation establishes minimum necessary requirements to safety of machines and (or) the equipment in case of development (designing), production, installation, adjustment, operation, storage, transportation, realization and utilization for the purpose of protection of life or health of the person, property, environmental protection, life and health of animals, the prevention of the actions misleading consumers.
3. This technical regulation extends to machines and (or) the equipment for which types of danger are revealed and identified, requirements to elimination or reduction of which are established according to the appendices N1 and N2.
4. This technical regulation does not extend to the following types of machines and (or) the equipment:
- the machines and (or) the equipment connected with ensuring integrity and stability of functioning of communication networks and use of radio-frequency range;
- the machines and (or) the equipment used in the medical purposes and used in direct contact with the patient (the x-ray, diagnostic, therapeutic, orthopedic, dental, surgical equipment);
- the machines and (or) the equipment which are specially designed for application in the field of use of atomic energy. Extends to the machines and (or) the equipment of common industrial appointment used in the field of use of atomic energy, action of this technical regulation in the part which is not contradicting requirements for ensuring nuclear and radiation safety;
- wheel vehicles, except the machines established on them and (or) the equipment;
- sea and river vehicles (vessels and watercrafts, including machines and (or) the equipment used on them);
- flying and spacecrafts;
- the railway rolling stock and technical means which are specially designed for application on rail transport and the subway;
- attractions;
- arms and military equipment;
- the machines and (or) the equipment intended for operation by persons physically challenged;
- agricultural and forest tractors and trail cars, except the machines established on them and (or) the equipment;
- drilling platforms, except the machines used on them and (or) the equipment.
5. Action of this technical regulation extends to the machines and (or) the equipment used on hazardous production facilities.
6. If the risks caused by machines and (or) the equipment are fully or partially established in other technical regulations of the Customs union, EurAsEC, then machines and (or) the equipment shall conform to requirements of technical regulations of the Customs union, EurAsEC which action extends to them.
7. In case of identification of machines and (or) the equipment compliance of specific machines and (or) the equipment to sample or their description as which the standards specified in Item 1 of Article 6 of this technical regulation, qualifiers, specifications and drawings, specifications, operational documentation can be used is established.
8. Additional requirements of safety for certain categories of machines and the equipment are installed according to the appendix N2.
