1. Approve the enclosed Rules of issue of permission to voluntary reorganization of bank (bank holding) or refusal in issue of permission, including condition of voluntary transformation of bank to the organization performing separate types of banking activities, issues of permission to converting of bank in Islamic bank and refusal in issue of permission, issue of permission to voluntary liquidation of bank, issue of permission to the voluntary termination of activities of branch of nonresident bank of the Republic of Kazakhstan and also procedure for return of deposits of physical persons, their transfer in other bank or branch of nonresident bank of the Republic of Kazakhstan. (further – Rules).

2. Recognize invalid some resolutions of Board of the Agency of the Republic of Kazakhstan on regulation and development of the financial market, and also structural element of the resolution of Board of the Agency of the Republic of Kazakhstan on regulation and development of the financial market in the list according to appendix to this resolution.

3. To provide to department of bank regulation in the procedure established by the legislation of the Republic of Kazakhstan:

1) together with Legal department state registration of this resolution in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this resolution on official Internet resource of the Agency of the Republic of Kazakhstan on regulation and development of the financial market after its official publication;

3) within ten working days after state registration of this resolution submission to Legal department of data on execution of the action provided by the subitem 2) of this Item.

4. To impose control of execution of this resolution on the supervising vice-chairman of the Agency of the Republic of Kazakhstan on regulation and development of the financial market.

5. This resolution becomes effective after ten calendar days after day of its first official publication.

"Information on the made changes and (or) additions in Rules is placed on official Internet resource of authorized body, also the Single contact center within 3 (three) working days from approval date or change of the corresponding regulatory legal act goes to the operator of information and communication infrastructure of "the electronic government".";

Item 3 of Rules, having determined that during suspension this Item is effective in the following edition:

"The bank (bank holding) (further - bank (bank holding) or uslugopoluchatel) for receipt of permission to voluntary reorganization of bank (bank holding) (further - permission to voluntary reorganization, the state service) sends to authorized body by means of the web portal of "the electronic government" www.egov.kz (further - the portal) the petition for receipt of permission to carrying out voluntary reorganization of bank (bank holding) in form according to appendix 1 to Rules or the statement for issue of permission to voluntary reorganization of bank in the form of converting in Islamic bank in form according to appendix 2 to Rules.

In case of the direction the applicant of the petition through the web portal of "the electronic government" www.egov.kz (further - the portal) in "personal account" automatically displays the status about acceptance of request for rendering the state service with indication of date and time of receipt of result.";
